Defense Logistics Agency
Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity The Contracting Activity for this action is the Defense Logistics
Agency - Warren (DLA - WRN)
2. Description of Action The proposed action is to award a new, firm fixed price contract with a 100% option for Display Set, Mission for the Bradley (114 items). Competition will be limited to Raytheon Systems (CAGE 96214; P/N 3227398-1). This action will be funded using
Army Working Capital Funds (AWCF).
3. Description of Supplies/Services This contract is to provide the Display Set, Mission for
Bradley per part number 3227398-1. The unit value is and quantity of this contract is 114 each with option quantity of 114 each. The estimated value of the contract is with option value for a total estimated value of .
Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the manufacturer.
Acquisition Method Suffix Code: (AMSC): H - The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC.
4. Authority Cited: The statutory authority permitting other than full and open competition is
10 USC 2304(c) (1), as implemented by FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: Raytheon is the designer and producer of most of these assemblies, and has proprietary rights to the design as well as the proper test equipment needed to assure that the items produced will not introduce problems with other subsystems within the
Bradley Fighting Vehicle upon installation.
6. Efforts to Obtain Competition: To date the government has not purchased the data from
Raytheon regarding the present proprietary design by which competition of this item may be accomplished. At this time funding to purchase or develop competitive data is not available. It is estimated that to develop competitive tech data that it would take 12 months and $1,000,000 to reverse engineer this item after which it would then take an additional $2,000,000 and 24 months in order to qualify a new vendor. Although this will be restricted to the above source, every effort will be made to obtain potential sources by posting in the TACOM contracting
Web Site. Any supplier who can provide the item referenced by the National Stock Number in the quantities required by the contract may bid on this solicitation. Interested sources can seek approval through the Source Approval Program with the Competition Management Office. To date, no other sources have expressed a written interest in the acquisition of this item.
7. Actions to Increase Competition: It is not cost effective for the Government to consider competition of this spares requirement because of the lack of funding for developing competitive technical data, the length of time to qualify new technical data, and the absence of any future cost savings due to low purchase quantities.
8. Market Research: This item does not appear on the Competition Advocate’s APPL or
CASL. Computer based market research was conducted in the preparation of this J&A, but did not result in the identification of any new sources.
9. Interested Sources A Sources Sought Synopsis was posted to FedBizOpps on 01/12/2018 and is valid for one year. To date, no sources have written to express an interest, nor has the
Government identified any other source possessing an interest in being an alternate source for this NSN. The notices required by FAR 5.201 have been published and any other bid or proposals received will be considered.
