About this file

This justification document outlines a sole source award for cable assembly procurement. The Pearl Harbor Naval Shipyard requires cable assemblies compatible with their existing proprietary design currently in use for dockside electrical services and shore power systems. Utilizing a different brand could pose safety hazards or lead to catastrophic shore power failures. A sources sought notice from June 17 to 25, 2021 and market survey sent June 17 with response due June 24 identified TPC Wire & Cable Corp. as the only source able to meet this requirement due to their compatible design. The Defense Logistics Agency Land and Maritime awarded contract SPMYM421P0336 for an unknown quantity of these cable assemblies to an unknown vendor on August 19, 2021 as a sole source procurement.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION: SPMYM4-21-Q-0108

the required cable assemblies that would be compatible with this proprietary design of the existing cable assemblies currently in use.

The Pearl Harbor Naval Shipyard (PHNSY) currently has an extensive inventory of the TPC cable assemblies on hand and in use to support the overhauls and planned maintenance availabilities. These cable assemblies are used to provide dockside electrical services and shore power systems to U.S. Navy vessels and submarines. The use of any other cable assembly brand or product would be incompatible with the existing material on hand and could also lead to catastrophic shore power system failure when assembled. Utilizing a different brand in conjunction with the proprietary design could also pose a significant safety hazard to employees and contractors. If the shipyard were to use another type of cable assembly, this would render their existing inventory inoperable, as no other known type of cable assembly is compatible with the TPC’s design. The purchase of any other manufacturing source or equipment would result in the duplication of resources, cost, and time to the Government that would not be recovered through competition.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

TPC Wire & Cable Corp., Cage Code – 1GLC4.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

This acquisition will be synopsized for five (5) days and solicited on beta.SAM.gov for a minimum of twelve (12) days to encourage potential supplier participation. Any interested party that requests a copy of the solicitation will be provided one. The Government will continue to conduct market research, to see if changes occur in the marketplace that would enable future actions for these items to be competitive.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

In accordance with FAR 13.106-3(a), the Procuring Contracting Officer will make a determination of fair and reasonable of pricing based upon comparison of the proposed price with prices found fair and reasonable on previous contracts, as well as other cost, price, and buyer analysis. Information from market research, governmental sources, and Producer Price Index Industry (PPI) Data will also be used to help establish price reasonableness when needed.

8. Market Research/Efforts to Obtain Competition:

A sources sought notice was posted to beta.SAM.gov on 17 June 2021 with a closing date of 25 June 2021 in order to seek out and encourage additional sources and vendor participation. No responses were received as a result of this notice. A market survey was sent to TPC Wire & Cable Corp. (TPC) via email on 17 June 2021 with a requested response date of 24 June 2021. TPC returned a completed copy of the survey on 21 June 2021. The market survey requested information such as identifying if the cable assemblies are commercial items, state if available on a GSA Schedule, state if the same or substantially similar cable assemblies have been sold or offered for sale to non-Governmental customers, identify the availability of a commercial catalog or price list, state if production limitations exist, state if
