4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.

If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

Graflex (1DBZ2) was the approved source for both NSN’s. Graflex (1DBZ2) was acquired by MSA Safety on July 2021. During market research, MSA Safety communicated they are the highest-level CAGE of Parasense, Inc.

(09WX1) as reflected in SAM.gov. MSA Safety is planning to let their exclusive distributors submit an offer:

Commercial determination:

Commercial Determination—for the reasons stated below, items covered by this initiative will be Commercial and will be procured under FAR Part 13.5—Acquisition of Commercial Items.

Per Far 2.101 Commercial item means:

(1) Any item, other than real property, that is of a type customarily used by the general public or by non-governmental entities for purposes other than governmental purposes, and-

(i) Has been sold, leased, or licensed to the general public; or

(ii) Has been offered for sale, lease, or license to the general public; Based on market research, buyer has determined that the item is commercial.

The Contracting Officer determined both NSN’s are commercial items as it meets the definition of commercial items as found in FAR 2.101. Market research analysis I/A/W FAR 12.1 was conducted and based on the market survey received, it was noted that the items are commercial, purchased commercially and sold in the commercial marketplace. Furthermore, both NSN’s and Part Numbers were found to be offered to the general public in MSA Safety Sales, LLC (8B9P7) catalog.

Based on market research, the contracting officer has determined that the item is commercial under FAR 13.5 procedures.

10. The following actions are being taken to overcome barriers to competition before any subsequent acquisition is made:
