I. Contracting Activity.

II. Nature and/or description of the action being processed.

An upgrade to the current QHR System will allow the Air Force to operate an intrinsic standard without the additional operating cost of Liquid Helium. Utilizing a helium re-liquification, recycling, or reclaiming system will remove the operational cost of liquid helium that has only increased due to low liquid helium reserves. The system shall operate in a closed-loop with no external plumbing. The Quantum Hall Resistance (QHR) System will have a dual Sample Probe for Gallium QHR Sample (NRCC) and Graphene QHR Sample (NIST). The system will be a 9 Tesla Cryogen Free, with water Chiller. The System needs to be verified against an NMI QHR at 5 points to verify System Accuracy of < 0.02 ppm, prior to delivery. The system will be used to transfer the QHR value to 1 k Ohms and 10 k Ohm lab standards

III. Description of supplies/services required to meet agency needs.

Quantum Hall Resistance (QHR) System to incorporate a liquid helium re-liquification to reduce the amount of helium lost due to ambient temperature boil off. The QHR shall be able to maintain liquid helium during long periods of system shut down. The boil off shall be collected and stored in a separate storage tank. The separate storage tank shall be portable to allow easy configuration in a lab environment. The system shall operate in a closed-loop with no external plumbing. The Quantum Hall Resistance (QHR) System shall have a dual Sample Probe for Gallium QHR Sample (NRCC) and Graphene QHR Sample (NIST). The system shall be a 9 Tesla Cryogen Free with water Chiller. The System shall be verified against an NMI QHR at 5 points to verify System Accuracy of < 0.02 ppm, prior to delivery. The system shall be used to transfer the QHR value to 1 k Ohms and 10 k Ohm lab standards. Mandatory on-site Installation and on-site or factory training with uncertainty analysis, for three technicians / Engineers is required. The system shall have a 5 year warranty included.

IV. Statutory authority permitting other than full and open competition.

10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and required by FAR 6.303-2(b)(4).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The QHR described in Section III is highly specialized and has resulted in one responsible source. The Graphene Chip has been developed by NIST, but needs to be utilized in a complete system to function properly and meet the needs of the Air Force. NIST cannot supply the chip to Measurements International, the only source, and is unwilling to provide and support a system of their own. Measurements International can only obtain the chip from NIST and they can provide a functional system once the chip is in their possession. This system was developed as a joint effort between NIST and Measurements International.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

All efforts taken to ensure that offers are solicited from as many potential sources as possible are outlined in the Market Research Report performed for the QHR Upgrade 20E-516A-DC. The survey of the market place confirms that no other vendor has the capability to meet the requirements for QHR Upgrade 20E-516A-DC (FAR 6.302-1). A Sources Sought Synopsis was utilized to ensure that offers are solicited from as many potential sources as possible. The Sources Sought Synopsis provided the following content:

Sources Sought did not result in any additional vendor interest.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

By signing this J&A, the Contracting Officer makes a preliminary determination that the estimated cost of $532,200 is fair and reasonable. At the conclusion of negotiations, the Contracting Officer will determine the price to be fair and reasonable. Necessary steps to determine a fair and reasonable price will include cost or pricing data, technical evaluation, and comparison to historical buys.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

Internet Searches: "Quantum Hall Resistance" yielded NIST information, but no manufacturers of products that are similar to the Air Force requirement

Contacting known sources of products or services included discussions with Measurements International, the current provider of the QHR, and NIST

Email: Email correspondence has yielded a price estimate from Measurements International

Phone: Phone conversations have established answered questions about the system asked by Measurements International

Sources Sought: Interest was indicated by Measurements International

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Supporting facts for Other Than Full and Open Competition are outlined throughout this document. No additional facts have been identified. There is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities as indicated in market research. Sole source effort is required for more than one year due to monthly acceptance testing limitations that include availability of standards, current workload, and man hours.

X. List of any sources that expressed, in writing, an interest in the acquisition.

Only one vendor, Measurements International, has expressed interest in this acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Air Force will monitor the market for future acquisitions of the supplies or services being acquired. Techniques used to continuously monitor the market will include those outlined in Section O of the Market Research Report.

Additional techniques shall include reviewing publications as they become available and attending trade shows if the agency's budget allows.
