JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a brand name basis for critical equipment to be used by the NSWCDD Dam Neck Activity

(NSWCDD DNA), ,

, manufactured by Orbital Systems, LLC.

3. Description of Supplies/Services

A quantity of 310 each PRE-255B Pre-Amp, 240-270 MHZ, Low Noise

Amplifiers (LNAs), part number 990012201, are required. Delivery of the 310 units is required as soon as possible after receipt of the order. The first delivery of 100 units is expected nine (9) months after receipt of the order with monthly deliveries of 50-

100 units thereafter.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is

. Fiscal year 2022 Procurement, Marine Corps, funds will be used for this procurement.

5. Rationale Justifying Use of Cited Statutory Authority has tasked NSWCDD DNA to provide design and development, acquisition, and engineering support for the

In support of this role, NSWCDD DNA must procure the requested LNAs.

Only Orbital Systems possesses the drawings, facility and parts required to manufacture these assemblies. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed.

, no other products have been identified that are form, fit and functionally equivalent and that can serve as a replacement for this part.

These LNAs are direct replacements parts/components for existing equipment in the .

Proprietary data and information prohibits other manufacturers from providing this specific design to the Program. No other company has the data rights or test capability to manufacture these assemblies and have them ready for timely support.

Following successful completion of system operational tests, approved this unit as the LNA for the configuration. The impact to the Navy should this specific LNA be competed for an alternative design would include: a) Inability to provide the , the LNA as required by system design; b) Inability to meet deployment schedules; and

c) Deficient system that would not allow to meet mission requirements. Redesigning this unit is not feasible and this specific LNA is the only LNA that will satisfy the current system requirements. Also, redesigning this unit would in return, affect operational event schedules. Any other component will require further engineering, development, increased testing, certification, configuration and documentation efforts estimated at over 2,200 direct productive person hours to complete additional government redesign and integration resulting in a cost in excess of at least $475,000.00. This additional cost to the government would not be recovered through a full and open competition.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research consisted of review of technical websites, correspondence with the previous government Acquisition Engineer for the , and obtaining information regarding all previous communications and procurement actions for these assemblies.

Additional market research performed through internet searches revealed that in August 2018, Communications & Power Industries

(CPI) acquired Quorum Communications and Orbital Systems. These companies now operate under the name Orbital Systems as part of

CPI’s Antenna Systems Division. This market research also indicated that Orbital Systems LLC has multiple authorized resellers.

The proposed contract is being synopsized on the SAM.gov website to create fair opportunity. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than

Orbital Systems, LLC. to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract

Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
