About this file
This document is a justification and approval for a sole source contract award. The Naval Surface Warfare Center Corona Division plans to award a firm-fixed price contract to Weibel Doppler Radars to upgrade one of its existing Weibel Tracking Radar Systems and purchase supporting accessories and software. The total estimated value is $438,575 to be funded by Procurement of Ammunition, Navy/Marine Corps funds for fiscal year 2020. A sole source award is justified as Weibel Doppler Radars is the original equipment manufacturer and sole authorized distributor with proprietary rights over the required components, ensuring compatibility with the agency's existing radar systems. Market research found no other capable sources. The agency will continue seeking alternative suppliers in the future to promote competition on similar requirements.

IN REPLY REFER TO
J&A No. 50,197 Ser 02/3698
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.
2. Description of the Action Being Approved
This Justification and Approval (J&A) authorizes the award of a Firm-Fixed-Price, Contract on a sole source basis for the procurement of a Chronograph and upgrade two Weibel Tracking Radar System Antennas in support of Corona Division Range Expeditionary Systems Engineering Division (ESED) to Weibel Doppler Radars (WDR). Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies/Services
ESED currently owns three WDR radar systems. The purpose of this requirement is to upgrade one of the current WDR radar systems while maintaining form, fit, and function across all three radar systems. WDR is the sole distributor and manufacturer of the radar systems.
This specific radar upgrade and supporting accessories/software is required to ensure compatibility and interface with all three existing radars and capabilities, and to obtain consistent data across past and future testing. Weibel Scientific is the original equipment manufacturer with no authorized resellers or distributors of the required system. The modernized WDR radar system will offer the Government enhanced reliability and functionality with increased capability in the same type of operational and physical footprint currently fielded to the fleet.
This J&A has a total estimated value of $438,575.00. The type of funds associated with this requirement is Procurement of Ammunition, Navy/Marine Corps (PANMC) for Fiscal Year 2020.
Funding FY20 Total
PANMC $438,575.00 $438,575.00
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only one responsible source, and no supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C 1901.
5. Rationale Justifying Use of Cited Statutory Authority
Only WDR holds the proprietary and patent rights to the schematic diagrams, calibration procedures, assembly instructions and component technical data to upgrade ESED’s current radar system with low noise Doppler antennas, install the instrument controller computer, and upgrade the current 60-watt transmitter to 120 watt. The antennas, transmitter rework and calibration to the system will be a form fit and functional drop in replacement of the legacy system.
The WDR Radar Tracking System is the radar system used by ESED and the U.S. Army proving grounds in conducting ammunition and weapons evaluation for the U.S. Marine Corps (USMC) and the U.S.
Army (USA). ESED began purchasing tracking radar systems in 1993 when the use of such systems became mandatory for conducting ammunition acceptance testing. The WDR Radar Tracking System plays a critical role in evaluating the safety, serviceability, and performance of the USMC and USA ground ammunition stockpile.
Three dimensional space and time data is collected from the time of firing a weapon until weapon impact. The data collected and analyzed can be used to not only assess weapon performance throughout its flight or trajectory but also to detect performance degradation of stockpiled ammunition. Additionally, it can assess performance of new ammunition being produced by vendors through Factory Acceptance Test (FAT) and Lot Acceptance Test (LAT) programs to assure weapons entering the stockpile perform in accordance with specifications, provide data for special investigations including Failure Mode Investigations, provide data that can be used to project end-of-life predictions for ammunition, and provide a variety of weapon flight data analysis collected during firing of new weapons being developed by governmental agencies.
ESED procured the first two of its three WDR Radar Tracking Systems from Weibel Scientific in May of 1993 under full and open competition via a U.S Army (Aberdeen Proving Ground) contract (DAAD05-92-D-7026). The third system was procured from Weibel Scientific in February of 2002 under full and open competition via Aberdeen Proving Ground contract (DAAD05-99-D- 7018/FC01). An upgrade was purchased via sole source procurement with Weibel Scientific in 2008 under contract N00164-08-C- JN41. Another upgrade was purchased with Weibel Scientific in 2015 under contract N00164-15-C-JP01. Since 1993, ESED has spent over $4.0M procuring, updating and maintaining WDR tracking radar systems and accessories.
This upgrade is required to continue conducting quality evaluation of U.S. Marine Corps and U.S. Army ammunition stockpiles by keeping pace with the advances in the technology of weapons and ammunition. The upgrade provides a significant savings for the government since the existing outer case and framing is reused and all parts are replaced with state of the art components instead of purchasing a new radar system for over $1.8M. The upgraded components are also interchangeable with
ESED’s two other WDR radar systems. The upgrade requirement for this action will allow ESED to continue to meet customer requirements Should another solution be procured, there would be compatibility issues with the existing system that would create unnecessary adverse risks, Based on the information contained above, a sole source procurement is in the best interest of the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted to determine if other firms manufacture a commercially available Doppler Radar and antennas that’s capable of meeting the Government’s requirement. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal any sources for the requested equipment other than WDR.
A Sources Sought Notice (SSN) was posted on the beta.SAM website indicating the Government’s intent to sole source this requirement to WDR. The posting was issued on 15 September 2020 and closed on 18 September 2020. At the close of the SSN, no responses from industry were received. A capabilities analysis was performed by the certifying technical and requirements personnel, in which concluded that WDR was the only source able to meet the Government’s minimum requirement in the Statement of Work.
Additionally, market research was conducted to verify if WDR has other authorized distributors or resellers with the ability to provide the new radar and antenna upgrades. An email was sent to WDR on 26 June 2020 requesting information on any authorized distributors or resellers with the ability to offer the radar and antenna upgrades. WDR responded with confirmation that they are the sole authorized distributor and did not intend to authorize other businesses to distribute their products.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Corona Division will utilize price analysis, commercial price lists, historical costs, and cost estimating relationships from previous procurements to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Competition
Corona Division will continue to perform market research to identify capable sources for future requirements related to this effort and if another potential source emerges, Corona Division will assess whether full and open competition is feasible.
