REFERENCES:

• FAR 13.106-1(b)(1)(i) states that, “For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). The following documentation constitutes the rationale for this decision.

DOCUMENTATION:

(1) Requiring Activity:

Defense Counterintelligence & Security Agency (DCSA) Logistics Management Division (LMD) 27130 Telegraph Road Quantico, VA 22134

Contracting Activity:

DCSA Acquisition and Contracting (AQ) 27130 Telegraph Road Quantico, VA 22134

(2) Supplies or services being procured:

The DCSA, LMD has a requirement for 10,000 two layer reusable cloth face masks with attached ear loops for issue to DCSA employees and embedded contractors enterprise-wide to facilitate the phased reconstitution of the Agency post HPCON-Charlie operations. Attachment 1,”Department of Defense Guidance for the Use of Cloth Face Coverings” directed that “all individuals on DoD property, installations, and facilities are required to wear cloth face coverings when they cannot maintain 6 feet of social distance in public areas or work centers.”

The estimated cost of this acquisition is: $

(3) Reason that this is a sole source procurement (i.e., proposed contractor's unique qualifications, etc.):

41 U.S.C. 1903 Special Emergency Procurement authority is authorized as the President of the United States made an emergency declaration under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as defined by 42 U.S.C. 5122 (the "Stafford Act") in response to the COVID-19 pandemic on 13 March 2020. DCSA has a public responsibility to comply with the World Health Organization (WHO) and the Centers for. Disease

Control and Prevention (CDC) guidance to prevent further spread of COVID-19. The masks are required to comply with Department of Defense guidance to implement plans to ensure compliance with directed force health protection measures throughout the area of operations in order to prevent an outbreak of COVID-19 among personnel (service members, civilians, contractors, and dependents) or confine any outbreak to as small a population as possible. In order to comply with these directives, DCSA has an urgent need for cloth face masks. Procurement of these masks is imperative in order to protect public health. The U.S. Government cannot apply standard procurement time lines to this acquisition due to the urgent nature of the requirement and the adverse public health impact if these masks were not procured.

An award will be issued on a sole-source basis to under the listed above and FAR 13.106-1(b)(1)(i), Urgency. Market research was conducted and is the only firm able to provide the quality of masks needed to meet the needs of the Government. A quantity of 10,000 masks will ship the week of 22 June and arrive at our location no-later-than 30 June 2020.

(4) Market survey

Market research was conducted through the DCSA Small Business Office, with the purpose of seeking as many potential sources as possible. Multiple companies responded saying that they could meet the Agency’s needs in quantity and delivery schedule, but only three were solid leads.

Those companies were:

. LMD received a sample mask from each of these companies with the following evaluations:

: Mask construction appears that it would withstand repeated laundering; edges are finished and seams double stitched to create an integrated unit; ear loops are integrated into the edge hem and double stitched; cloth used is comfortable on the face; mask fits well and conforms to the wearers face; is easy to breathe through; pricing falls at the mid-point of the three vendors;

vendor indicated they can meet the delivery window.

: Mask construction does not appear that it would withstand repeated laundering; edges are not finished; second layer of cloth is stitched at each end at the ear loop and at the bottom center seam of the mask which creates a pocket of sorts; ear loops are cut from the outer mask layer and not reinforced; cloth used comfortable on the face; fits well and conforms to the wearer’s face; pricing is low end of the three vendors; vendor indicates they can meet delivery window.

: Mask construction appears that it would withstand repeated laundering; edges are finished and seams are single stitched to create an integrated unit; ear loops are elastic and sewn into the corners of the mask seam; cloth used is comfortable on the face; mask

is not as pliable and does not conform to the face as well as other samples tested; pricing is at the high end of the three vendors; vendor indicated they can meet the delivery window.

The following sources were contacted for pricing and availability information:

Vendor Cost/Unit Quantity Sub Total Shipping Total

As shown in the market research, interest exists in the commercial marketplace; however, other sources cannot provide the required quantities within the required timeframes with required levels of quality to meet the needs of the Government. This is a one-time procurement which includes FAR 52.217-6 Option for Increased Quantity. A notice of procurement action was not publicized as required by FAR Subpart 5.2 due to exception cited under FAR 5.202(a)(2), unusual and compelling urgency precludes competition and the Government would be seriously injured if the agency complies with the time periods specified under FAR 5.203. If a future requirement becomes known, the Government intends to compete the requirement, provided market conditions and production capability of alternate firms improves.

(5) Technical requirements personnel certification

I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available.

(6) Price Reasonableness Determination:

In determining a fair and reasonable price, the Contracting Officer (KO) will evaluate the Independent Government Cost Estimate (IGCE). Additionally, price comparisons will also be

accomplished from as many other sources as possible within the commercial market e.g. General Services Administration’s Federal Supply Schedule and online pricing and if needed, negotiate pricing.

Although these cloth face masks are available from multiple vendors, based on the above, it is anticipated that the sole source pricing will be fair and reasonable.

(7) Contracting Officer’s certification

I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge.
