Description of Acquisition: Modify contract HDECO4-21-D-0006 with Gill Group, Inc., which provides ovens, proofers and racks, to increase the scope of the contract adding quantities for Option Year 2. The current contract ordering period ends February 29, 2024. The contract includes commissaries located throughout the Continental United States, Alaska, Hawaii, Puerto Rico, and the Far East.
Statutory Authority: 10 U. S.C.3204(a)(1) as implemented by FAR 6.302-1(a)(2) Only one responsible source and no other supplies or services will satisfy agency requirements.

JUSTIFICATION AND APPROVAL
FOR OThER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Defense CommissaryAgency, Supply and Equipment Maintenance Branch, CCQSM, 1300 Eisenhower Avenue, Fort Gregg-Adams, Virginia 23801-1800.
2. Type of Contract Action: Modify contract HDECO4-21-D-0006, which provides ovens, proofers and racks, to increase the scope of the contract adding quantities for Option Year 2. The current contract ordering period ends February 29, 2024. The contract includes commissaries located throughout the Continental United States, Alaska, Hawaii, Puerto Rico, and the Far East.
3. Description of Supplies/Services: The Defense Commissary Agency, Sales, Marketing & Logistics Group (MPLRE) has an on-going requirement to obtain ovens, proofers and racks for the commissaries located in the Continental United States, Alaska, Hawaii, Puerto Rico, and the Far East.
4. Authority Cited: 10 U.S.C.3204(a)(1) as implemented by FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: Option Year 2 under contract HDECO4-2 1-D-0006 failed to capture the correct quantity of ovens, proofers and racks required to support the agency needs during the period of March 2023 - February 2024. Due to a ramp up in quantity of ovens, proofers and racks needed to support commissaries during Option Year 2, an increase in quantity is needed to close the gap and ensure adequate quantities for commissary demand. The current contractor has the ability to fulfill the need without a gap.
It is likely that award to any other source would result in an unacceptable delay to the government given the time it would take to award a contract and ramp up production to meet the agency's needs. It is noted that this is only for Option Year 2.
6. Efforts to Obtain Competition: No efforts were made to obtain competition for the intended action. In accordance with FAR 5.20 1(b)(1)(ii), notice of the contract modification to include this justification will be published for 15 days notifying the public of the intended action. IfDeCA receives any responses based on this synopsis, DeCA will review those responses to determine whether an alternate source is feasible.
7. Fair and Reasonable Cost Determination: At the time of the award, the pricing was considered fair and reasonable for the supplies. The increased quantities contemplated by this modification exceed the estimated quantities under the original contract; however, pricing for the added quantities remains the same as for the original awarded quantities.
8. Market Research: Market research was not completed for this intended action. DeCA received limited vendor engagement in response to the original requirement solicited with full and open competition, after exclusion of sources for small business concerns. Considering the interest received with regard to the full requirement, there is an expectation that a short-term contract with a lower quantity would be even less appealing to vendors. As mentioned in section 6 above, DeCA will publish a notice of the contract modification to include this justification for 15 days notifying the public of the intended action. The Contracting Officer will review all

submissions in response to the published notice and will determine if an alternate method of acquiring the ovens, proofers and racks is reasonable.
9. Actions to Increase/Foster Competition: No actions were taken to increase or foster competition. This justification is limited to Option Year 2. Upon discovery that contracted quantities were insufficient to satisfy the agency's requirement for Option Year 2, the agency began reviewing Option Years 3 and 4. It is expected that the agency will have sufficient time to take necessary actions to increase competition should additional quantities be required for Option Years 3 and 4. The agency expects to compete the follow-on contract when the current contract expires.
10. Other Factors:
Procurement History - The original contract was solicited as full and open competition.
DeCA received two offers. The contract number is HDECO4-21-D-0006 and was awarded on March 17, 2021 as a finn, fixed price contract with a base year and four option years to Gill Group, Inc.
11. Interested Sources: As mentioned in section 6, a notice of the contract modification to include this justification will be published for 15 days notifying the public of the intended action.
All parties that submit a response to the public posting will be reviewed to determine whether there is another viable source.
