JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ 08733
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves on a sole source basis a Firm Fixed- Priced contract with Waygate Technologies USA, LP (formally G.E. Inspection Technologies, LP) 721 Visions Dr., Skaneateles, NY, Cage: 052B7 for the procurement of Defect Measurement Video Borescopes in support of the Kuwait Air Force F/A-18 E-F Foreign Military Sales (FMS) Kuwait Platform.
3. Description of Supplies/Services.
This procurement action is for a total of four (4) Defect Measurement Video Borescope 6MM, Part Number XLGOB6120M-N, NSN: 6650-01-583-8302 in support of the F/A-18 E-F FMS Kuwait Platform. The Defect Measurement Video Borescope 6MM is required to inspect, analyze, and record data for defects found on the internal surface areas of the aircraft engine/airframe.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c) (1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Waygate Technologies USA, LP is the Original Equipment Manufacturer (OEM) of the Defect Measurement Video Borescope 6MM. The U.S. Government does not have data in its possession to acquire these items from anywhere other than the original source/manufacturer. Market research identified Waygate Technologies USA, LP as the only known source for this end item. Waygate Technologies USA, LP is the only known manufacturer and source with sufficient technical data, drawings, software, and trained technical personnel to satisfy this requirement.
Any attempt to develop these items would incur costs that are not expected to be recouped through competition. Any attempt to procure a different part number would require the Government to fund a Preliminary Design Review, Critical Design Review, First Article Test, and Test & Evaluation effort to qualify a new vendor. In addition, any change in form, fit, or function would require changes to the existing Integrated Logistics Support (technical publications, spares inventory, calibration). The actions
J&A 20-0550 described above would incur additional costs in the amount of $350,000 to $500,000. Therefore, the process required to obtain an alternate asset is cost-prohibitive. In addition, not properly qualifying a new source would force the FMS Partner to utilize an asset that is not supported, compatible, or interchangeable with the USN-approved configuration.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The F/A-18 Program Technical Team conducted various searches using Part Number, Nomenclature, and NSN information. A Google search returned results for Part Target and WBParts. These vendors are recognized as after-market resellers and are not authorized to sell or distribute the items. The search engines for The Federal Procurement Data System and Dynamic Small Business Search were queried and returned results that Waygate Technologies USA, LP is the only source capable of meeting the Government’s requirements for the Defect Measurement Video Borescope.
A Request For Information was posted from 14 October 2020 through 19 October 2020 to the Beta.Sam web portal. In response to the RFI, the Government received a Statement of Capability and Brochure from Olympus America Inc. (Cage 1KY21). The Government Technical Team carefully reviewed the Olympus submittal. However, their item has not been tested to determine whether the functionality can provide the Government the required end result. As stated above, the Government would need to execute additional steps (time and cost) for separate testing, evaluation, and logistical support (creation of technical manuals) to certify this particular model. These additional steps are cost-prohibitive and time consuming to the Government, and the costs would not be recouped through competition.
The Synopsis required by FAR 5.201 was published on the Beta.Sam web portal from 20 October 2020 through 04 November 2020. No additional responses were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate.
The proposal will be reviewed by experienced technical analysts and contract specialists with the aid of field pricing support, if necessary. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price for the supplies covered under this J&A.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR Lakehurst does not have adequate proprietary rights to compete future contracts for the parts covered by this document at this time. If another requirement emerges and potential sources for that requirement are identified, NAVAIR will assess whether competition for future requirements is feasible.
