DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C261-23-AP-2588
1. Contracting Activity: Department of Veterans Affairs, VISN 21, VA Southern Nevada
Healthcare System (VASNHCS) is requesting approval of a justification for Other Than Full and Open Competition for the requirement specified in 2237 Number 593-23-4-543-0362.
2. Nature and/or Description of the Action Being Processed: The VA Southern Nevada Healthcare System (VASNHCS) has a need for fire alarm upgrade services. This would be for a one year period of performance. The estimated dollar amount is $503,500.00.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Fire alarm system is currently an EST III system. It will be upgraded to an EST IIII system requiring replacement specific devices in the Fire alarm Panel. The Existing EST-3 Fire Alarm System will be upgraded to an EST-4. Twenty-One (21) New CPU’s will be installed along with all necessary components to fully upgrade the Fire Alarm System to an EST-4 Network. All existing cable and circuiting will be reutilized including all 120vac emergency power. The existing Fireworks Graphics System will be reprogrammed to receive points from the newly upgraded Fire Alarm System. All System Pre and Acceptance and re-Testing projections are based on having Full Facility Accessibility and Standard Testing Practices.
4. Statutory Authority Permitting Other than Full and Open Competition:
( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4
(X) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;
( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Authorized or Required by Statute (FAR 6.302-5) – This acquisition is being made under the authority of 38 U.S.C. 8127 and 8128, Sections 502 and 503 of Public Law (PL) 109-461 and VAAR 819.7008 and VAAR 819.7009, which allows the VA to make a sole source award to a VOSB if the following conditions are met:
