About this file

The contract will be awarded to Philadelphia Gear to provide on-site technical representative services for inspection and replacement of turning gears on the USS MILIUS located in Yokosuka, Japan. Philadelphia Gear is the original equipment manufacturer of the turning gears and possesses the required expertise to ensure system integrity and avoid failure, which could endanger ship and crew safety. The estimated value of the contract is $745,660 to be funded by FY20 operations and maintenance funds. The sole source justification was synopsized on March 12, 2020 with only Philadelphia Gear expressing interest in the requirement. The contracting officer has determined the cost to be fair and reasonable.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
NAVSUP Fleet Logistics Center Puget Sound.
2. Description of Action Being Approved.
Award of a firm-fixed price service contract, on a sole source basis, for on-site technical representative services in support of USS MILIUS (DDG-69) waterborne, at U.S. Naval Ship Repair Facility SRF-JRMC, Yokosuka, Japan.
3. Description of Supplies/Services.
Technical representative services includes onsite guidance, oversight and technical expertise during shipboard inspection of the NR 2 TG (turning gear) as well as to provide onsite guidance, oversight and technical expertise for replacement (including operational testing) of the NR 1 TG shipboard.
Original Equipment Manufacturer (OEM) also to provide services to validate Main Reduction Gear (MRG) gear casing turning gear flange is aligned/machined/mounted as required to receive a newly installed Turning Gear. A report is to be submitted to the supervisor documenting a satisfactory measurement/inspection of the MRG gear casing turning gear flange.
OEM is to remain onsite to provide guidance, oversight and technical expertise until NR 1 TG operational testing procedures are complete with satisfactory results. Satisfactory results to include the absence of brass particles in the NR 1 MRG lube oil system as a result of NR 1 TG operation as determined by SRF-JRMC.

4. Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C. 1901 – A sole source acquisition under the authority of the simplified acquisition procedures for certain commercial items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority.
Philadelphia Gear is the OEM for the MRG’s TG and the subject matter expert for all condition specification requirements, questions, and corrective actions. Currently, there are no other known manufacturers or service providers capable of providing the required services. OEM expertise is required to ensure system integrity. Use of any other manufacturer’s service technicians could cause the MRG TG Systems to fail putting the mission and safety of the ship and crew at risk.
Therefore, Philadelphia Gear is the only acceptable source for the needed technical representative services.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed solicitation was synopsized on the beta.sam.gov website on 12 March 2020 as a sole source and only Philadelphia Gear expressed interest in this requirement. Previously synopsized requirements for similar work have not resulted in any companies, other than the OEM, Philadelphia Gear expressing interest. No additional market research was conducted as it is not practicable for the reasons discussed in paragraph 5 above, for any company other than Philadelphia Gear to provide the required services.
7. Determination of Fair and Reasonable Cost.
The contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable utilizing the appropriate methodology for the contract type.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVSUP FLCPS has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLCPS will assess whether competition for future requirements is feasible.
