JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency:

The U.S. Army Corps of Engineers, Vicksburg District Contracting Office, 4155 Clay Street, Vicksburg, MS 39183-3435.

2. Description of Action:

This requirement is being procured as a sole source to Mississippi State Chemical Laboratory (CAGE Code: 4E756). The purchase request and certification (PR&C) number is W807PM01348189. The estimated value is The period of performance is three years.

3. Description of Supplies/Services:

The United States Army Corps Of Engineers Vicksburg District (USACE-MVK) has a requirement for water sample analysis to enable permit compliance for the USDA Agricultural Research Service (USDA-ARS) GTIP pilot site in Leflore County, Mississippi. The primary purpose of the USDA-ARS GTIP pilot site is to test the feasibility of transferring excess groundwater during wet seasons for subsequent use and replenishment of groundwater during dry seasons to arrest the expansion of one of the cones of depression in the Mississippi River Valley Alluvial Aquifer (MRVAA) located within the Quiver River Watershed. Groundwater extracted from a well adjacent to the Tallahatchie River is transported via sub-surface pipeline and then injected through an aquifer storage and recovery (ASR) well into the MRVAA. The deliverables include all tests listed below for up to 24 samples along with certified test results and QA/QC documentation over the contract period.

Each sample collected will have all analyses conducted. Six samples will be collected at a time with four rounds of samples collected from the initiation of well operations through August 2023 for a total of up to 24 samples over the contract. The six samples will consist of a single sample from the two injection well heads as well as two samples at different depths from each of the MDEQ paired observation wells located near the extraction and injection well sites. The samples will be collected on an approximately annual basis. The Contractor shall be responsible for providing coolers, sample bottles, preservation solutions, trip blanks (if applicable), and supplies. The certified test results will be provided to the Government, by mail or email (preferred), within 21 calendar days from the date of sample receipt in the Laboratory.

4. Authority Cited:

Authority permitting other than full and open competition for this requirement is 10 U.S.C.

§2304(c)(1) and FAR 13.106-1(b)(1)(i) which states “Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).” The following section details the circumstances that have deemed Mississippi State Chemical Laboratory as the as the only source reasonably available.

5. Reason for Authority Cited:

Mississippi State Chemical Laboratory has the capability to test the water samples for all of the compounds identified in table 1. Market Research has determined there are no other known sources that can support this requirement.

6. Efforts to Obtain Competition:

Efforts to obtain competition were made via SAM.gov, SBA quick market search, and by communications with other USACE Districts. We were unable to locate any sources via SAM or SBA quick market research that are capable of providing all the required testing. An attempt was made to borrow capacity from a BPA with the Savannah District which would have permitted competition amongst the 4 BPA holders however upon review of the BPA and communications with the BPA holders it was determined none of the BPA holders were capable of providing the required testing. A notice of intent to award sole source will be posted to www.BetaSam.gov on 26 June 2020. Any sources identified through the notice of intent will be given consideration.

7. Actions to Increase Competition:

Any potential sources identified through the notice of intent to award sole source will be given consideration.

8. Market Research:

Market Research determined Mississippi State Chemical Laboratory is the only known source that can support this requirement. This justification and approval will be posted on or around 26 June 2020 to www.BetaSam.gov as the Government’s notice of intent to award sole source.

Any source(s) that respond to this notice that are determined capable of meeting this requirement will be given an opportunity to compete for future testing requirements that may be needed.
