2. Nature and/or Description of the Action Being Processed:
This procurement is for immediate unusual and compelling urgency for Alternate Clinical Site Operations to include Restroom and Shower Trailers, Janitorial Services, and Unarmed Security Guard Services. This is an individual sole source justification to award a single, firm-fixed price contract.
In accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requiremsn, acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
This procurement is in support of Hurricane Laura Contingency operations for the Lake Charles, Louisiana catchment area.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Estimated Contract Value with Options: (28-day base with four (4) – twenty-eight (28) day option periods.
Base period of 28 days:
Period of Performance: Base Period: August 30, 2020 to September 26, 2020.
A. The Contractor shall provide Janitorial services for the Off-Site Clinical contingency locations to include all Workspaces and common areas include wood or similar floors, shelving, office desks, waiting areas, trash receptacles, and two restroom trailers with multiple men’s and women’s restrooms. Additional locations may be identified and requested. Services are 7 days per week.
Contractor shall provide FULL-SITE Janitorial Services to include labor, tools, equipment, materials, consumable items, supervision, transportation, lodging, and any other elements deemed necessary for the off-site Lake Charles, LA or other designated temporary clinic in accordance with the Statement of Work.

Includes: Cleaning supplies for COVID 19 Virus disinfecting (non-invasive). All restrooms and showers shall be maintained 2-3 times daily and make sure soap, towels, and hand sanitizer is maintained. Sweeping and cleaning up of all auxiliary tents and areas use by the Nurses and VA Staff will be done regularly and upon request.
2 custodians on-site with supervisor on site at all times.
Full-Site Services: per day per 28 days
Contractor shall provide PARTIAL-SITE Janitorial Services to include labor, tools, equipment, materials, consumable items, supervision, transportation, lodging, and any other elements deemed necessary for the off-site Lake Charles, LA or other designated temporary clinic in accordance with the Statement of Work. (Showers/Restroom Trailers, 2 Tents, 1 work-n-play) Location of site may change based on mission needs.

Partial Site Services: per day per 28 days
It is noted that janitorial services should be either full-site or partial site unless mission dictates more than one site to be maintained.
B. The Contractor shall provide labor, supervision, equipment, tools, consumable supplies, materials and transportation necessary to deliver, set-up, relocate, and perform periodic servicing of clean, fully supplied and operational standard portable restrooms, shower trailers and hand wash stations (as applicable). Restroom and Shower Trailers shall accommodate between 10-100 people as determined at the time of need and equipment availability and have handicap accessibility.
Stations will be located at Lake Charles VA 3601 Gerstner Memorial Drive, Lake Charles, LA or alternate location based on access or the mission.

Relocation of assets may be requested based on mission needs.
C. The Contractor shall provide all personnel, equipment, labor, administration, supervision, and other items and services necessary to perform Uniformed Security Guard Services including all transportation required in order perform in accordance with the terms and conditions set forth within this Performance Work Statement (PWS). Contractor is required to possess all applicable State licensures, liability insurance coverage, as well as be compliant with any other regulatory laws that apply to laws and pertinent regulations, and commercial practices.
Provide (3) unarmed security guards per shift to provide deterrence against unauthorized, illegal or potentially life-threatening activities directed toward Facility employees, visitors, information, programs, resources and property. The Contractor shall provide three security guards per shift to properly perform the specific duties outlined below. The Government will secure all areas/buildings at the end of the business day and will continue to be secured throughout the night.

4. Statutory Authority Permitting Other than Full and Open Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement due to the unusual and compelling urgency of the required services.
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Unusual and Compelling Urgency applies to this procurement. The Alexandria Veterans Healthcare System, Lake Charles, Louisiana Community Based Outpatient Clinic (CBOC) sustained structural damage as a result of Hurricane Laura. The services requested with this acquisition provides janitorial services, restroom and shower trailers, and unarmed security guard services for the off-site temporary clinic location for VA staff and Veteran support.

The VISN Emergency Operations Center (EOC) requested the services on August 30, 2020, with mobilization of the Restroom and Shower trailers immediately. Janitorial Services to begin on August 31, 2020 as the restrooms/showers are to be in place August 30, 2020, in the evening.
Unarmed Security guards are not requested at this time due to VA Police Officers are covering security however, it is anticipated that once full assets are deployed the need for unarmed security guard support will be needed.
The Contractor, Wolverton Property Management LLC, is a Service-Disabled Veteran Owned Small Business (SDVOSB). Due to the impacts of the Category 4 hurricane, there were no immediate local contractors to meet the needs of the EOC. Wolverton Property Management, located in Biloxi, Mississippi, could provide equipment and disaster assistance as needed to include immediate delivery/services for the restroom and shower trailers and janitorial services. Unarmed security guards can be on-site within 24 hours or less of request (if needed). The Contractor is familiar with Hurricane contingency operations with previous contract performance for VISN 16 natural disasters and emergencies.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
The VIP database was used to pull potential SDVOSB and Veteran Owned Small Businesses (VOSB) with NAICS 561720, Facilities Support Services. There were 1204 SDVOSBs and 120 VOSBs listed.
GSA illustrates several business that are able to provide disaster response services however, the companies will not be able to respond to site for at least 3 days.
As a result of the urgency for the services, market research was not performed at full length and for competition to occur.
Wolverton Property Management LLC, an SDVOSB, can meet the needs of the Government at the time of request. The Contractor has the equipment and staff to assist with hurricane contingency operations with Lake Charles, Louisiana.
Future acquisitions will provide for competition if time and the individual procurement needs will allow.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The anticipated cost is considered fair and reasonable. Pricing shall be compared with current and/or previous contracts in FPDS to ensure pricing is fair and reasonable when compared with similar types of contracts in size and scope. Wage Determination 2015-4185, Revision 12, dated June 26, 2020, Calcasieu Parish, Louisiana, is in effect for the janitorial and unarmed security guard services.
The price reasonableness will be determined using any of the appropriate methodologies listed at FAR 13.106-3(a)(2).

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
The VIP database was used to pull potential SDVOSBs/VOSBs with NAICS 561210.
This request is for emergency hurricane contingency operations for the Alexandria Veterans Health Care System, Lake Charles, Louisiana catchment. Unusual and compelling urgency exists for immediate disaster relief caused by Hurricane Laura, a rated Category 4, natural disaster. Due to this urgency, the requirements will not be competed.
Any Other Facts Supporting the Use of Other than Full and Open Competition: Due to the catastrophic damage, many of the businesses in the area are unable to meet the requirements and are not able to be contacted with communications infrastructures being impacted.

Future acquisitions will be reviewed on a cas by case basis to promote market research and competition.
