2. Description of Action:
Purchase and delivery of 4 Gearboxes for Berwick Lock
3. Description of Supplies/Services:
The Contractor shall furnish all labor, materials, services, etc., to supply Berwick Lock with two (2) new right handed and two (2) new left handed right angle speed reducers, also known as heavy duty parallel offset drives, in accordance with these specifications.
The right angle speed reducers shall be manufactured by Philadelphia Gear, the original equipment manufacturer (OEM), to interchangeable with Berwick Lock’s existing equipment and machinery.
4. Authority Cited:
Authority permitting other than full and open competition for procurement of these services is 10 U.S.C. 2304(c)(1) and FAR 6.302-1(b)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, and FAR 13.106-1(b)(1)(i), Soliciting from a single source for purchases exceeding the simplified acquisition threshold.
5. Reason for Authority Cited:
All of the gearboxes/drives are very specialized and custom built to meet specific requirements at Berwick Lock. Philadelphia Gear is the original manufacturer for the vast amount of this, and several other area lock’s components. Due to contracting actions from more than 60 years ago, Philadelphia Gear retains the rights to the original drawings and designs of the subject component, and well as various other lock components. Along with the aforementioned, Philadelphia Gear has the in-house knowledge of aging lock structures to build these units so that they are compatible with the existing machinery.
6. Market Survey (e.g. Notice of Intent posting, SAM search, SBA recommendation):
As stated in #5, Philadelphia Gear who is the original manufacture of most of the components at Berwick Lock; in addition, Philadelphia Gear has vast experience and expertise with these custom made gearboxes for aging lock structures. If competition was sought out, it would require extraction of the original gear box, a complete breakdown of the component so that selected vendor can attempt to re-create the design. There is a high probability that any attempted redesign of the original gearbox component will not fit correctly, and therefore, unusable. This failure would cause extended lock closures impacting the navigation industry and hurricane protection. Regarding additional costs, the aforementioned would take up to a year to re-design and build, at the additional estimated cost of $2.5 Million, and is at a high-risk of not yielding a fully functioning gear box.

APPROVAL
Based on the foregoing justification, I hereby approve the procurement of these gearboxes on an Other Than Full and Open Competition basis pursuant to the authority of 10. U.S.C 2304(c)(1) as implemented by FAR 6.302-1(b)(1), subject to the availability of funds, and provided the services herein described have otherwise been authorized for acquisition.
