Justification and Approval (J&A) for Other Than Full and Open Competition

I. Agency and Contracting Activity.
This section remains unchanged from original approved J&A dated 25 Aug 2020.
II. Nature and/or description of the action being approved.
This section is amended to change the dates from 24 Sep 2020 to 30 Sep 2020 and to include commissioning as part of the services being acquired. The 66 ABG/CE needs to have an Operations and Maintenance (O&M) contract by 30 Sep 2020, in order to place our newly constructed natural gas take station into service. Contract delays beyond 30 Sep 2020 will result in an unacceptable delay on two mission critical construction projects. The work included under this contract will ensure the safe operation of our high pressure natural gas take station, pressure reducing skids, associated take station infrastructure, commissioning services, and emergency response to gas distribution system failures. Impacts to existing contracts include:
Contract FA2835-16-C-0010 Repair Gas Lines
- Project requirements includes the connection of newly constructed gas take station to the bases existing gas distribution system. The work associated with this connection will require an 8 hour gas outage. During that time critical base facilities such as base housing, Hanscom Middle School, Hanscom Primary School, Hanscom Medical Clinic, the dorm, and fitness center will be without heat and/or hot water. This connection must be made prior to 15 Oct 2020, after this date the risk of property damage is too high.
- The connection to the base distribution system is critical path to the completion of this project. If delayed past 15 Oct 2020, this connection will need to be delayed until at least the Spring of 2021. This places the Government at risk for a delay claim.
Contract W912DY-15-D-0047 Hanscom Energy Savings Performance Contract (ESPC)
- The scope of this contract includes the construction of a new gas line (complete) and the replacement of heating equipment (in-progress) in B1810, B1811, & B1814.
- Without the O&M contract we cannot flow gas into the newly constructed gas line. Without natural gas we cannot run heating equipment in B1810, B1811, or B1814. B1810 houses critical Civil Engineering functions such as our Unit Control Center, Customer Service, Operations Flight, and Engineering Flight.
III. Description of supplies/services required to meet agency needs (including the estimated value).
Hanscom CE requires a firm fixed price contract to provide O&M and emergency response to Hanscom AFBs natural gas take station. Work includes O&M on the medium pressure regulator station, low pressure regulator station, and supervisory control and data acquisition system. The work additionally requires the contractor to perform the commission of the take station in order to transfer from the old gas lines to the new gas system and document the start up from the construction contractor Tantara. Work under this contract includes O&M requirements required to meet:
• 49 CFR 192 - Transportation of Natural and Other Gas by Pipeline: Minimum Federal Safety Standards
• 49 CFR 191 - Transportation of Natural and Other Gas by Pipeline: Annual Reports, Incident Reports, and Safety-Related Condition Reports
• 220 CMR 101: Massachusetts Natural Gas Pipeline Safety Code
• AFI 32-1067 - Water and Fuel Systems
The acquisition will be for a two year period of performance (1 Year Base period with a 1 Year Option period)

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
CE requires an O&M contract in order to complete the remaining construction and utilize the newly constructed natural gas take station. By awarding a base plus one option year contract, CE will be able to leverage 12 months of initial O&M data from this contract to further define a follow on contract or contracts. A contract solely focused on O&M may prove to be more attractive to the limited number of firms in this area. The Government plans to perform additional market research and to provide and promote for competition for these future services.
