JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
Naval Sea Systems Command, Surface Warfare Center Port Hueneme Division (NSWC PHD).
2. Description of the Action Being Approved
NSWC PHD intends to award a single contract on the basis of other than full and open competition as a Sole Source to Raytheon for TACLINK 3310 Modem and cabling parts. The TACLINK are required as part of the MK 160 Gun Computer System (GCS) for essential communication with shipboard radio equipment and subsequent communication with Forward Observation forces ashore.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency’s needs.
5. Rationale Justifying Use of Cited Statutory Authority
The current technical requirement for the MK160 is TACLINK 2000, is now obsolete.
Design agency for the MK 160 and identified the only suitable replacement that meets the Form, Fit and Function specifications needed is the TACLINK 3310.
The functions that this product must support include TCP/UDP/IPv4 networking connections, transmitting and receiving RS-232 and RS422 data signals, contain at least two configurable communication channels, and the ability to configure and control remotely via an Ethernet LAN by a Linux-based operating system.
This TACLINK is small enough to fit within the equipment drawer that it is to be placed in. It is also able to be powered by the 12V from the power supply that feeds into the drawer. Due to drawer size constraints we require a product that is roughly the same size/dimensions, approximately 16" x 8" x 2" or smaller, as the TL2000 and cannot be larger. The product is also required to be compatible with DC power and CAT5 LAN that are supplied within the drawer. Shock and vibration testing has been done and certified with this unit.
Part of this procurement is the Host Interface Cable, USB/Ethernet and the Glenair 19 Pin Cable, SINCGARS that Raytheon makes to interface the TACLINK 3310 Modem with the rest of the system. These cables are specific to this modem and cannot be purchased off the shelf. Raytheon is the sole manufacturer of the TACLINK 3310. There are no other resellers or distributors that sell this product, and no other products that meet the form/fit/function requirements described above. All other vendors that were provided with the minimum operational and interface requirements did not have an available product that could meet said requirements, or the ability to make or support such a product. Since no other products are currently available, an attempt to identify and qualify alternate parts would result in a delayed procurement beyond the requirement need date of FY22, which would be unacceptable because the TACLINK Modem and cabling parts are required as part of the GCS MK 160 Gun Computer System for essential communication with shipboard radio room equipment and subsequent communication with Forward Observer forces ashore.
This procurement is required to meet customer needs for ships under new construction and lab replacements to meet current configuration.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The market research was conducted through GSA Advantage, Google.
DODESI, Ability One, Haystack Gold, UNICOR, and Used Line and was unsuccessful in identifying another provider of the TACKLINK 3310 modem. Verification was requested and received from Raytheon that no authorized resellers exist to support this requirement.
7. Determination of Fair and Reasonable Costs
The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the Justification and Approval will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For reasons set forth in Paragraph 5, NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
