I. Contracting Activity.

Department of Air Force, 1st Special Operations Contracting Squadron, Hurlburt Field, FL. This document serves as a Justification for Other Than Full and Open Competition.

II. Nature and/or description of the action being processed.

Air Force Special Operations Command (AFSOC) has a brand name requirement to procure Harris Test Sets. This action will be awarded as a new firm-fixed-price contract.

The contractor will be determined after issuance and receipt of quotes in response to the Solicitation.

III. Description of supplies/services required to meet agency needs.

The contractor shall provide seven Integrated Radio Test Systems to provide complete and thorough testing of the Harris 152/152A/117G/150 radio sets. The test set and ancillary items being purchased are provided below:

RF-7801 Test Set, PN: RF-7801-TE101, Quantity of 7

Bench Assy, LC Maintenance System for RF-7801, PN: 11285-5000-01, Quantity of 7

Test Station, HW/SW, AN/PRC-117G, PN: RF-7801-TE110, Quantity of 7

Test Station, SW/HW, AN/PRC-152, PN: RF-7801-TE114, Quantity of 7

Power Kit, USA Style NEMA 5-15R RF-7801 W/UPS, PN: 11285-3008-01, Quantity of 7

This is currently an unfunded requirement. This is intended to be funded with 97 0100 (Operations and Maintenance) appropriations.

Delivery is estimated within 200 days after receipt of award.

IV. Statutory authority permitting other than full and open competition.

Procurement under the contract will be conducted on a brand name basis in accordance with the statutory authority 41 U.S.C. 1901 and implemented by AFFARS 5313.501, Sole Source acquisitions, to include Brand Name, conducted under simplified acquisition procedures. Only one brand is suitable for this requirement because the supplies are unique or highly specialized.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The requested Test Set is specifically designed and built for Harris products. The test set allows direct control of radio maintenance and provides functionality of multiple test instruments.

Aeroflex is a known product on the market and was previously used by the Government. This test set is a quick bit test that does not provide specific information; only a pass or fail analysis. The RF-7801 Test Set provides a specific data analysis of the preventive and corrective maintenance required on the radio, which ensures operations are not going into the filed with radios that could potentially fail.

These test sets will be used with the Harris 152/152A/117G/150 radio sets. The 152A Maintenance Manual (Attachment 1, Paragraph 4.3) indicates that in order to provide a complete test setup, the RF-7801-TE101 and RF-7801-TE115 are required. Both items are included in the Integrated Radio Test Set Systems being procured.

The RF-7801 is also listed in the required test equipment for the 117G radio instruction guide.

Lastly, the RF-7801 system is the only system that allows users to conduct both narrowband and wideband radio testing, with the capability to test multi-channel radios. This is especially important since the U.S. Special Operations Command awarded Harris Corporation H92222-17-D-0021, a IDIQ to supply multi-channel radios to Special Operations Forces. As these radios continue to be purchased for all of the SOF units, the testing system on hand will work with these multi-channel radios. There are no other systems on the market that provide this capability.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Combined Synopsis Solicitation will be issued via BetaSAM.gov, limited to the specific brand name products to allow L3Harris and their authorized distributors to provide a quote for the requested items.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated price will be determined fair and reasonable based on competition.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A sources sought notice was issued to BetaSAM.gov on 10 August 2020 with responses due 17 August 2020. The sources sought provided requirements of the test system to allow for equivalent product capabilities to be submitted.

One response was received from L3Harris stating that L3Harris is the OEM for this equipment and no other company makes the equipment requested. L3Harris also stated that the equipment can be purchased through third party vendors, but will require additional fees for services and pass-through charges.

1 SOCONS awarded contract FA441717P0148 to Harris Corporation (currently L3Harris) in the amount of $2,010,760 on 22 September 2017. Five quotes were received in response to solicitation issued for this requirement. The lowest was an equivalent product quoted by . Although the solicitation required the specific Harris Corporation RF-7801 system, the product was reviewed by the technical POC and determined technically unacceptable for the following reasons:

IX. Any other facts supporting the use of Other Than Full and Open Competition.

USSOCOM has previously funded L3Harris Level 3 training courses to AFSOC personnel on the requested test system in order for the technicians to be able to provide Level 3 maintenance.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Market research will be performed prior on future purchases to determine if any other products have been fielded in the market that meet the requirements described in this justification. Due to the proprietary nature of L3Harris products, it is not anticipated that the market place will be able to provide another test set that will provide the full spectrum of preventive and corrective maintenance offered by the Harris RF-7801 Test Set. Fully testing L3Harris products requires L3Harris proprietary information and expertise that other manufacturers do not possess.

XII. Certification by the Contracting Officer.
