JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment (C&E) Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for supplies on an other than full and open competition basis.
3. Following are the supplies required to meet DLA’s needs:

4. The applicable statutory authority permitting other than full and open competition is 41 U.S.C. 1901, as implemented by FAR 13.501(a), Sole Source Acquisition.
5. The use of this authority is necessary because DRS Network Imaging Systems (DRS) is the only known approved manufacturer of the subject Disk Drive Unit that meets the needs of the Government for use on military armored vehicles. The vehicles use this Disk Drive Unit as an electromechanical component of an electronic computer, which accepts and systematically retains digital input data in such a manner as to facilitate the rapid recovery of stored information. The Disk Drive Unit stores information and runs applications and software to safely allow information and communication flow
DRS also produces the which is the final end product mounted on most armored vehicles in the military, consisting of all of the systems and subsystems to include hardware, such as the Disk Drive Unit, and software.
This item is essential and critical
A competing company would have to meet specification criteria and obtain the user interface software from DRS or develop a new interface, which would require re-fielding the Disk Drive Unit to thousands of military and government vehicles in order to maintain unit cohesion.
This NSN is a commercial item and is not manufactured exclusively for government purposes.
There is no known similar model of the Disk Drive
Unit available in the commercial marketplace that will meet the government’s requirements.
6. The proposed acquisition will be published to Contract Opportunities (beta.SAM.Gov). In addition, this J&A will be posted with the solicitation in accordance with FAR 5.102(a)(6)
7. As the contracting officer, I hereby determine the anticipated cost to the Government will be fair and reasonable based on price analysis techniques in accordance with FAR 15.404-1(b)(2), specifically comparison to historical prices paid and prices obtained through market research for the same item or price list.
8. Market Research was conducted in February 2020 through a Market Research Survey provided to DRS Network Imaging Systems, and potential dealers and distributors:
additional market research was conducted with DRS and they stated they would be interested in providing the item under a Fixed Quantity Contract.

A Sources Sought Notice (SSN) was issued by DLA Troop Support to identify potential sources that could provide a fully qualified Disk Drive Unit. The SSN was issued on 27 January 2020 and closed on 28 February 2020. DLA Troop Support received zero (0) responses to the SSN.
9. There are no other facts supporting the use of this authority.
10. Sources expressing an interest in this acquisition include DRS Networking Systems, (1RWE7) the manufacturer, and

Procurement Notes M06, Evaluation of Offers for Part Numbered Items and L04, Offers for Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation. Any alternate offers received will be forwarded to the Product Specialist for evaluation and approval. Prior to option exercise, a technical review and market research will be conducted in an attempt to identify additional sources.
