Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

II. Nature and/or description of the action being processed.

The purpose of this Justification and Approval (J&A) for other than full and open competition is to award a new 12 month contract with a six month Extension Of Services (EOS) Clause for the Consolidated Headquarters Advisory and Assistance Services (CHAAS) contract. Due to a significant change in scope, an extension to the current contract IAW FAR 16.505(b)(2)(i)(C) is not applicable. The Period of Performance is 3 Dec 2020 to 2 Dec 2021 with the EOS allowing for an additional period of 3 Dec 2021 to 2 Jun 2022. This will prevent a break in service and allow the necessary time to finalize the acquisition strategy for the follow-on effort. The previous effort was a task order initially competitively awarded under OASIS - SB Pool 1 to the prime contractor, Solutions Through Innovative Technologies Inc. (STI), Cage Code 3EMZ0. This J&A is to justify awarding an interim contract to STI to allow for the future alignment of services for all Headquarters (HQ) AFRL required service support, which is to be consolidated under one competitively awarded service contract. Due to the "consolidated" nature of the follow-on HQ Service Contract, the scope of this new effort differs from the scope of the current effort on contract and is therefore not considered a bridge action, as defined in AFFARS 5302.101. This effort will allow the Government to fulfill the HQ required services until the follow-on is awarded and avoid gaps in service. The cost estimate is based on historical pricing with an increase to account for escalation and inflation.

III. Description of supplies/services required to meet agency needs.

The current Services contract (FA8650-16-F-4102) Period of Performance ends 2 December 2020. The current contract was competitively awarded as a five-year (base + options) IDIQ contract and is currently in its fourth option period, which expires 2 December 2020. This effort is an interim contract that will provide a period of performance of 12 months with a six month EOS Clause to allow for the award of a follow-on contract to be competed. The contract shall serve as a vehicle to provide service support for twenty-two contract Users within the HQ AFRL Executive Leadership and Functional Directorates at Wright-Patterson AFB, OH. The Services provide support to AFRL/CC, SAF/AQ, and SECAF highly visible programs. Specific services required include project/program management support, facilitation and training support, event planning, administrative, public affairs, teaching material and instruction, communications, integrated marketing support, knowledge management support, flight safety support, special project assistance, administrative support, program protection, information assurance, workforce development, technical writing support, and most importantly the implementation of the Air Force Science and Technology 2030 Strategy.

This effort will be a mix of Firm-Fixed Price (FFP), Cost-Plus Fixed-Fee (CPFF) and Cost-Reimbursable. Labor will be established as a Cost-Plus Fixed-Fee CLIN. Cost-Reimbursement CLINs will include Travel and ODCs. This follows the current contract type CLINs.

IV. Statutory authority permitting other than full and open competition.

10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii), and required by FAR 6.303-2(b)(4).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Only one source (contractor) is capable of responding to or providing our needs within the required timeframe. AFRL HQ encompasses more than a dozen functional directorates and staff offices which vary in mission. These directorates range from Plans & Programs and Operations, to Financial Management and Engineering & Technical Management.

The staff offices and functional directorates at AFRL HQ directly support the Laboratory Commander. For this interim contract, STI is the only contractor that is capable of meeting the requirements. STI has everyone in place therefore avoiding a break in service while the follow-on is being competed. STI has been performing the requirement for years and has intimate knowledge of the program. Because of the complexity of the requirement, it would take a new contractor several months to get caught up to speed. Due to reorganizations as well as changes in acquisition strategy and requirements, the follow-on effort was delayed and therefore this interim contract is needed. Further market research is ongoing but will concentrate on the OASIS pools due to the acquisition strategy being approved.

This acquisition will result in a 12 month interim contract effort to include a six month EOS clause for a period of performance of 3 Dec 2020 to 2 Dec 2021 with the EOS allowing for an additional period ending 2 Jun 2022. This will allow the Government flexibility in choosing the most appropriate strategy for the follow-on effort.

In accordance with FAR 6.302-1(a)(2)(iii), awarding to STI will prevent an unacceptable delay in essential services to the Government. During the acquisition planning phase, a determination by leadership was made resulting in a significant change to the acquisition strategy and consequently, delaying the schedule in its entirety. This effort will provide time to align the requirements for the consolidated HQ AFRL services follow-on, as described in Section II. Without an interim contract, the Government would have a break in service of up to one year while a new source is sought, which would result in significant and detrimental impacts to high visibility programs within AFRL.

Therefore, due to the foregoing facts and in accordance with FAR 6.302-1(a)(2)(iii), a sole source award is in the best interests of the Government.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

This Justification and Approval document will be posted within 14 days after awarding the resulting contract in accordance with FAR 6.305(a). A request for information (RFI) was posted onto Beta.SAM/FedBizOps; however, it was determined from leadership that the future of CHAAS needs to be competed under the OASIS contract in the future.

For this interim contract, STI is the only contractor that is capable of meeting the requirements in the timeframe required. STI has everyone in place therefore avoiding a break in service while the follow-on is being competed. Due to reorganizations as well as changes in acquisition strategy and requirements, the follow-on effort is delayed and therefore the interim contract is needed. Further market research is ongoing but will concentrate on the OASIS pools due to the acquisition strategy being approved.

Pursuing a competitive award would be unacceptable due to the unacceptable delays associated with such a strategy and in the interest of efficiency and economy, it is not reasonable or prudent. We will include this requirement in a consolidated HQ AFRL services contract that will be competed and competitively awarded. Awarding a 12 month interim contract with a six month EOS Clause will allow time to compete the follow-on effort. A notice will be posted for this effort, IAW FAR 5.201, within 15 days of RFP release.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine the price to be fair and reasonable in accordance with the FAR, utilizing available historical pricing on previously paid contracts with this company and will be in line with the initial order (current effort). Certified cost or pricing data will be obtained IAW FAR 15.403-4(a)(1) and cost analysis will accomplished IAW FAR 15.404-1(a)(3). Proposed costs will be compared to an independent government cost estimate.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A follow-on initiative is now in progress; however, it will not be awarded prior to the 2 December 2020 PoP end date.

The services being acquired are all inclusive, with some being potentially commercial as a stand alone, but while being grouped under this effort are not a commercial opportunity. Market research was started to include the release of a RFI on FedBizOps. Leadership has decided that this follow-on effort needs to be competed against the OASIS Indefinite Delivery, Indefinite Quantity contract. The only market research that will be conducted for the follow-on will be with the OASIS pools of contractors. Competing and awarding a one-year "gap" contract would create unnecessary duplication of work, reducing efficiency and increasing cost to the Government. Therefore, no further market research was conducted specific to this effort.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

A follow-on initiative is in progress. The current contract period of performance ends 2 December 2020 and therefore, the schedule to begin the performance for this follow-on requirement must begin by 3 December 2020 or there will be a break in service. The initiative for a consolidated follow-on contract has not progressed in a timely manner that would allow for an open competition and award by 3 December 2020.

X. List of any sources that expressed, in writing, an interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Due to reorganizations as well as changes in acquisition strategy and requirements, the follow-on effort was delayed and therefore this interim contract is needed. Further market research is ongoing but will concentrate on the OASIS pools.
