JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF BRAND NAME OR EQUAL DESCRIPTIONS, OR PROPRIETARY SPECIFICATIONS
AND STANDARDS, IN SOLICITATIONS
1. Contracting Activity.

2. Description of the Action Being Approved.
Inclusion of a brand name or equal description in RFQ M67400-24-Q-0035 for a breathing air compressor and breathing air fill station that are able to support the current inventory of SCOTT 4500psi SCBA/SCUBA cylinders currently in use by the Environmental Support Team (EST).
3. Description of the Supplies/Services.
The below supplies are brand name products of Bauer Compressors:
1. Breathing Air Compressor (Quantity: 1) Part Number: DMT II 08-DY Estimated Price: $20,895.00
2. Wheel Kit (Quantity: 1) Part Number: N/A (Attachment for Breathing Air Compressor) Estimated Price: $1,168.65
3. PFP2 Breathing Air Two Position Fill Station (Quantity: 1) Part Number: PFP2 Estimated Price: $1,688.40
Estimated Total Price: $23,752.05
4. Statutory Authority Permitting Other Than Full and Open Competition.
N/A. Full and Open Competition will be utilized. This document meets the regulatory requirement at DFARS 206.302-1(c)(2) to execute the justification and approval addressed at FAR 6.303 in order to use brand name or equal descriptions.

5. Rationale Justifying Use of Cited Statutory Authority.
The Environmental Support Team (EST) as well as similar units such as the MCIPAC Fire Department and CBRN on-island currently utilize Bauer Compressors for their SCBA/SCUBA cylinder refill systems, providing units on island with ease of training and parts compatibility. The EST’s current breathing air compressor system is a brand name product of Bauer Compressors which has provided exceptional service for over five years. It is in the Government’s best interest for the EST to continue utilizing these brand name products or products that can support the SCOTT 4500psi SCBA/SCUBA cylinders currently in use and that are deemed technically acceptable by the requiring activity.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted in accordance with FAR Part 10, and revealed that there are multiple vendors in the commercial market capable of providing the required supplies. A synopsis for this requirement will not be posted in accordance with FAR 5.202(a)(13). There will be an open market Request for Quotes posted on SAM.gov that will permit the public to respond to the solicitation electronically.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, the activity has no plans at this time to eliminate the use of brand name or equal descriptions from future solicitations for the types of supplies/services covered by this document; however, this will be reassessed during follow-on acquisition planning.
