BRAND NAME JUSTIFICATION AND APPROVAL

Purchase Request / Requisition # 11739716 / W5654Q-1299-0100

Organization/Line Office: Utah Army National Guard / 19th SFG (A) S4

Description of Action being approved: New contract, firm fixed price

Description of Product, Supplies or Services required to meet the Agency’s needs: Mobile Gym Boxes to be distribute to 19th SFG (A) units that do not have a THOR program in place since they are located across multiple States. 19th SFG (A) battalions and AOB in multiple states to include California, Texas, Rhode Island, West Virginia Utah, and Washington and these locations are managed by three different States and funding processes.

Statutory Authority permitting other than full and open competition: This acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 6.302-1(c).

Identification of the Justification Rationale:

1. Solution must include external functional training rig and attachments to include: external climbing wings, 3” x 3” steel, and 11 gauge hot dip galvanized steel. Steel must be “hot dip galvanized” to ensure survivability in harsh climates. Electro-galvanic powder coat is NOT equivalent and will not be accepted. In the event they are shipped via sea or via air, the container needs to be resistant to element conditions and compatible with shipping practices and procedures.

2. To remain consistent with the product purchased last FY, the 19th SFG (A) would like to purchase the exact same model, specs and brand as last year’s contract.

3. Previously order solution was tailored to meet specific requirements unique to 19th SFG (A) personnel count and skill set.

Fair and Reasonable Price Determination: Award issued under this individual limited sources justification represents a fair and reasonable price as the agreed to pricing will be based upon competitive quotes received from authorized retailers of the brand in a competitive environment. Price analysis will be performed on all quotes received. Therefore, the price paid will represent the best value and result in the lowest overall cost to meet the needs of the Utah National Guard. Price will be determined fair and reasonable based on adequate competition among multiple small business vendors’ pricing.

Actions to Increase Competition: This Brand-Name requirement will be competed among multiple small business vendors in the marketplace who can supply this item, thus ensuring increased competition.

Market Research conducted: Reviewed publicly available information in the marketplace and on various websites.

Conducted additional market research from researching prior year contracts awarded from our agency and other government agencies.

Technical Cognizance: As the technical or requirement personnel, I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.
