Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C776-21-AP-5050
1. Contracting Activity:
Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC) The proposed procurement, Request For Proposal (RFQ) 36C77621Q0497 is to upgrade the Avid Media Central Assest Management system for the Education Employee System (EES) at both Veterans Administration (VA) Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs. The purchase request 2237 number is 131-21-4-4292-0048.
2. Nature and/or Description of the Action Being Processed:
This justification is to support the Media Central Asset Management system that will be an upgrade to the two existing EES MediaCentral Production Management systems at both the VA Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs facilities that will integrate with the existing Avid equipment and IP networks. The project will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of a particular brand name Avid software system equipment/services.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Avid system equipment/service brand name item section only applies to a portion of the purchase requrirng the brand-name items. This procurement is to upgrade the Avid Media Central Assest Management system for the Education Employee System (EES) at both VA Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs. Avid system equipment/service are necessary for standardization and integration at both the VA Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs facilities. There are 21 brand name Avid items and 12 brand name Avid services items listed below for which the VA is not able to accept equal or alternate items. The value of these items listed below are estimated at $350,000.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The Veterans Administration (VA) began purchasing and migrating toward the Avid Media Central | Production system technology in 2019 and 2020 to simplify adding upgrades, such as this one, in

Revision 10 Date: 09/10/2020 subsequent years (i.e., 2021 and beyond). These items have been standardized throughout both the VA Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs facilities. Installing a different manufacturer system will create significant duplication in cost for the facilities, nullify the aforemention developed migration plan and in most cases the equipment is not compatible ane will not function properly.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as Unrestricted and will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The items for which brand name approval is being requested is a component to the overall project.
This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award. The estimated cost of this component is $350,000.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
Market Research was conducted by the COR and verified by the Contracting Officer that Avid the sole proprietor and manufacturing of Avid equipment and service is the only source that can provide the requested equipment and service to upgrade the Avid Media Central | Production system technology. This determination was based on the 2019 and 2020 developed mirgration plan to upgrade the system and a letter of affidavit from Avid as manufacturer and sole provider.
Approval of the items as brand name only is critical for the overall efficiency of the current in place Avid Media Central Assest Management system.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
New components must be able to tie into an existing and operational system including the use of software. At this time, there are no competing vendors whose products are fully compatible with the existing system being used at both the VA Saint Louis, Missouri and Salt Lake, Utah Healthcare System Department of Veterans Affairs facilities.
10. if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Not applicable.
11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
