JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Marine Corps Support Facility, Blount Island, Jacksonville, FL

2. Description of the Action Being Approved.

Award of a sole source contract in the amount of to , for the overhaul of Set Alpha Side Connectors (Generation

3), one portion of the Navy lighterage system, under the Woman Owned Small Business program pursuant to FAR 19.1506.

3. Description of Supplies/Services.

This requirement is for maintenance, overhaul, and repair services critical to sustainment of United States Navy (USN) prepositioning equipment supporting the Maritime Prepositioned Force (MPF). Specifically, the overhaul of the Improved Navy Lighterage System’s (INLS) Roll On/Roll Off Discharge Facility (RRDF) sub component Side Connector (SC) system. The INLS RRDF SC is a government developed/government owned design specifically for a military application. The RRDF functions similar to a barge like platform that allow interface between the ship’s ramp and landing craft that provides movement of vehicles and equipment from ship to surface connector. The Improved Navy Lighterage System (INLS) RRDF Side Connector sets contain ~20 (quantity) INLS RRDF SCs and associated support gear. There are six RRDF SC sets in existence identified as Set Alpha, Bravo, Charlie, Delta, Echo, and Foxtrot respectively. The SCs are single points of failure for the RRDF and their maintenance and upkeep is critical to the Navy mission that supports the MPF Program. The SC life cycle overhaul process is a reoccurring requirement to maintain readiness and configuration management. The government anticipates each set to be overhauled numerous times within their respective service life. The second overhaul is called Gen 2 and third call Gen 3. The instant requirement is for the overhaul of Set Alpha (Gen 3). Each set overhaul is limited to a 12 Month Period of Performance (PoP). The PoP is based upon equipment availability from each of the ships or home ports and the set availability is aligned with the Maritime Maintenance Cycle (MMC) Ship schedule. Therefore, each set must be completed within a 12 month period of performance.

4. Statutory Authority Permitting Other Than Full and Open Competition.

5. Rationale Justifying Use of Cited Statutory Authority.

FAR 19.1506 (b) Women-Owned Small Business Program Sole Source Awards provides the following:

(b) A contracting officer shall consider a contract award to a WOSB concern (including EDWOSB concerns) eligible under the WOSB Program on a sole source basis (see 6.302-5(b)(7)) before considering small business set-asides (see 19.203 and subpart 19.5) provided none of the exclusions at 19.1504 apply and--

(1) The acquisition is assigned a NAICS code in which SBA has determined that WOSB concerns are substantially underrepresented in Federal procurement;

(2) The contracting officer does not have a reasonable expectation that offers would be received from two or more WOSB concerns (including EDWOSB concerns); and

(3) The conditions in paragraph (c) of this section exist.

(c)

(1) The anticipated award price of the contract, including options, will not exceed--

(i) $6.5 million for a requirement within the NAICS codes for manufacturing; or

(ii) $4 million for a requirement within any other NAICS codes.

(2) The EDWOSB concern or WOSB concern has been determined to be a responsible contractor with respect to performance.

(3) The award can be made at a fair and reasonable price.

meeting the government’s requirements, to include: management, quality, schedule, and cost. has consistently exceeded the government’s requirements by providing delivery of acceptable services prior to the required delivery date. . The incumbent, , is known to be experienced performing the type of work required to support this requirement. They are also known to have facilities in the greater Jacksonville area (North FL/South GA) that fall within the required 45 mile distance from BIC. is a WOSB and has satisfactorily performed this work in the past.

(c)(3) By comparing the work on the previous side connector sets and the similar commercial work done by , the Contracting Officer believes we can make a fair and reasonable determination concerning price.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The market research summary above demonstrates there are no other WOSB sources currently available to perform this service.

Blount Island Command (BIC) conducted market research in July 2020, as a follow-on to previous market research conducted in January 2018 and November 2018 respectively, (see attached MFRs), to identify potential sources using a Dynamic Small Business search under NAICS Code 811310 (Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance Services), for Florida. This search revealed a total of 102 women owned small businesses (WOSB) within the State that possess this NAICS code. The requirement specifies that the contractor must provide a facility within a 45 mile radius to accomplish the required maintenance because the Government Quality Assurance Specialist is required to conduct inspections at specified times during the repair process. Of the 102 WOSB businesses, a total of 13 women owned small businesses (WOSB) are within a 45 mile radius of Blount Island Command that possess this NAICS code as determined by their designated corporate address(es).

Out of the 13 WOSB businesses, only one, , performs similar types of work according to the company information. The Contract Specialist contacted the principle, on 30 July 2020 at 0930 EST. When asked the type of work and facility the company possessed. explained that he has a small shop and a lot of the work he does is on-site at the customer facility. He stated he does not perform any mechanical or machine shop type of work. When given a brief overview of the requirement stated that work was outside his companies capabilities. The contract specialist informed him that the details of the call would be documented and thanked him for his time.

Additionally, BIC issued an unrestricted sources sought notice on 12 August 2020 with a response date of 21 August 2020. Only one response was received from

, the WOSB incumbent that has performed this work previously. Based upon this research and the acquisition history as detailed below, no other WOSB within the required 45 mile radius of BICmd possesses the capabilities required to perform these services.

This requirement was previously satisfied under M67004-19-P-1005 for overhaul services of Set Delta (Gen 2) Side Connectors for a total cost of and the period of performance was 3 Apr 2019 – 1 August 2020. There were two no-cost extensions granted because of excusable delays and supplier delays directly related to COVID19. M67004-18- C-0001 was issued for providing overhaul services of Set Charlie (Gen 2) Side Connectors for a total cost of and the period of performance was 03 Mar 2018 – 02 Mar 2019. M67004-16-C-0008 was issued for completing overhaul services of Set Bravo (Gen

2) Side Connectors for a total cost of and the period of performance was 09 May 2016 – 08 May 2017. The total cost of Set Bravo (Gen 2) was .

In FY15, a competitive unrestricted Basic Ordering Agreement (BOA) (M67004-15-G- 1002) was executed by Blount Island Command (BIC). There were two offers in response to the solicitation for this BOA. Both interested contractors were small businesses. As a result of evaluations, Alloy Crane and Hoist was determined to be the only responsive, responsible offer submitted for the BOA. The total value of the BOA was with a period of performance was 29 July 2015 through 28 July 2020. Two BOA Orders were issued under the BOA for work on Set Alpha (Gen 2) and Set Bravo (Gen 2) Side Connectors. BOA Order 0001 was issued for Set Alpha (Gen 2) at a total cost of with a period of performance from 04 August 2015 to 03 August 2016. BOA Order 0002 was issued for with a period of performance from 04 March 2016 to 03 March 2017. The total of all job orders awarded under this BOA is which exhausted the allowable work under the BOA as only remained for the ceiling under this BOA.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

MCSF BIC has no plans to abandon consideration for a WOSB set-aside. Market research will be conducted prior to subsequent acquisitions for the purpose of determining whether new potential WOSB sources emerges in the local industrial capacity for consideration of a competitive acquisition.
