1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Regional Procurement Office West, Network Contracting Office 20 (NCO 20), procuring on behalf of Veterans Integrated Service Network 20 (VISN 20) Prosthetics; Alaska VA

Healthcare System catchment area.

2. Nature and/or Description of the Action Being Processed: This action justifies the establishment a short term bridge contract for Home Oxygen Services and Deliveries in

Alaska. This contract will maintain current services to, prevent a break in services, allow the proper competition while the follow-on contract is put in place, and provide time transition to a new vendor if necessary.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Contract

36C26023P1188 is for VISN 20 Home Oxygen Services and Deliveries performed by

Procare Home Medical, Inc. (Procare) expires 3/31/2023. This contract covers the catchment areas for the Alaska Health Care System. Procare provides home respiratory care, equipment and supplies for eligible Veterans who meet the administrative and medical criteria for these services in accordance with Joint Commision regulations. The period of performance will be

04/01/2024 – 06/30/2024, and the value is $300,000.00.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Home Oxygen Services and Deliveries are critical in providing patient care and cannot be interrupted. An interruption to these critical services could result in significant impact to a wide population of veteran care, to include possible lose of life. Procare has satisfactorily provided the required services for the past five years, and is the only contractor situated to

Effective Date: 04/01/23 perform this requirement seamlessly and without a lengthy transition process. This bridge will allow the time necessary for the evaluation, contract reviews, award, and on-boarding time for the potential new contractor. The follow-on requirement will be for 5 years, and the estimated effective date of award is 07/01/2024.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought was issues in August 2023 with no response beyond the incumbent. No additional efforts have been made for this specific action as this is a single source bridge with the incumbent and intentionof a follow on competitive 5 year award.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The pricing for this bridge is a considered fair and reasonable as it is in line with the current pricing of 36C26023P1188 with a 2% raise in pricing as it was with each ordering period. A separate determination of fair and reasonable pricing will be completed and included in the contract file.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted: Limited market research was conducted for this specific action due to its nature. Sources Sought Notice Alaska-Home-Oxygen was posted to SAM.gov 8/24/2023 and closed 8/28/2023. One response was received from the incumbent, Procare. However, more extensive market research will be conducted for the follow-on action.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

Procare was contacted via email for updated pricing.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As stated in section 5, a long-term five year contract(s) is currently being procured, however we do not have time to get this in place before the current contract expires and a break in service would have a significant impact on veteran care.

12. Requirements Certification: I certify that the requirement outlined in this justification is a

Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
