About this file
This justification document requests approval for a sole source bridge contract to NetCentrics Corporation for network redesign support services. The Department of Defense Washington Headquarters Services requires these services to maintain a separate IT infrastructure for the Military Commissions Defense Organization at Guantanamo Bay to ensure fairness and independence. The one-month bridge contract from March 30 to April 29, 2020 would provide continuity while the longer-term requirement is competitively procured, with an anticipated award by the second quarter of fiscal year 2020. A notice of intent to sole source posted from February 20 to March 2 did not generate any challenges. Pricing will be determined fair and reasonable based on historical prices from the incumbent's current contract.

1. AGENCY AND CONTRACTING ACTIVITY: The Contracting Activity is the Department of Defense (DOD), Washington Headquarters Services (WHS), Acquisition Directorate (AD), Enterprise Security Services Directorate (ESSD). Requiring Agency: Joint Service Provider and Office of Military Commissions (OMC).
2. DESCRIPTION OF ACTION: This action requests the approval to issue a follow-on bridge contract for Network Redesign Support Services, while a competitive acquisition is being pursued. This action will be a firm-fixed price contract with a total estimated value of $332,502.68. The anticipated period of performance is for one base month with a one month option pursuant to FAR 52.217-9, Option to Extend Term of Contract. The period of performance will commence on March 30, 2020.
Network Redesign Support Services are currently being provided under Contract Number HQ0034-11-D- 0002-0005 with an expiration date of March 29, 2020.

3. DESCRIPTION OF SUPPLIES/SERVICES: The Joint Service Providers and Office of Military Commissions requires a follow-on bridge contract for Network Redesign Support Services in order to maintain continuity of support the Office of Military Commissions, while a competitive acquisition is being pursued. The overall objective of this acquisition is to implement, transition, operate, and maintain a logically/virtually separate IT infrastructure for the Military Commissions Defense Organization (MCDO) to ensure that no other entity has access to MCDO files and emails. 4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”

5. REASON FOR AUTHORITY CITED: Federal Acquisition Regulation (FAR) ) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”. OMC is responsible for the court proceedings for the detainees held in GTMO. Within OMC, the MCDO requires Network Redesign Support Services to maintain a separate command structure to help ensure fairness and independence of the legal system.
Failure to issue a sole source bridge contract to the incumbent, NetCentrics Corporation will create an unacceptable lapse in service of providing Network Redesign Support Services to maintain a separate IT Infrastructure for the OMC MCDO. NetCentrics Corporation is currently providing Network Redesign Support Services to the OMC. Implementing a new vendor to provide these services could result in unnecessary delays, interruptions in services, increased costs, and unnecessary hardship for OMC and there mission to provide secure court proceedings for the detainees held in GTMO. Therefore, a bridge contract to NetCentrics Corporation is required to ensure continuity of support for these essential services while the Government is working a competitive acquisition.
6. EFFORTS TO OBTAIN COMPETITION: On February 20, 2020, Washington Headquarters Services (WHS) Acquisition Directorate (AD) issued a “Notice of Intent to Sole Source” this requirement to NetCentrics Corporation on beta.sam@gov. The Notice of Intent was posted for ten days and closed on March 2, 2020. No vendors responded to the notice to challenge the bridge contract to NetCentrics Corporation.
7. FAIR AND REASONABLE COST DETERMINATION: The Government will make a determination of fair and reasonable pricing, using the procedures in FAR 15.404-1- Proposal Analysis Techniques;
specifically, FAR 15.404-1(b)(2)(ii) “Comparison of proposed prices with independent Government cost estimates.” Since this requirement will be solicited to the incumbent vendor, historical prices paid from the current contract were used to develop the Government estimate and will be utilized to determine fair and reasonable pricing.
8. MARKET RESEARCH: Market research has been limited to the pre-solicitation notice described under efforts to obtain competition, which was posted for 10 days on bet.sam@gov. No vendors challenged this bridge effort.
WHS/AD will solicit this effort as a follow-on bridge contract in order to maintain continuity of support to the Joint Service Provider and the Office of Military Commissions. The bridge contract will be issued as the most logical and cost effective strategy and solution to the Government which will avoid unacceptable delays in fulfilling the agency’s requirement and a potential gap in performance of critical services while a competitive acquisition is taken place.
9. ANY OTHER FACTS SUPPORTING THE USE OF SOLE SOURCE: There are no additional facts. A sole source contract to NetCentrics Corporation is required to ensure continuity of support for Information Technology Network Support Services while the Government is working a competitive acquisition.
10. INTERESTED SOURCES: To date, no other sources have expressed an interest in writing.
