The requests 4/8 Year Service Maintenance of (QTY:117/EA) CYPRESS Automatic Activation Devices.
IV. Statutory authority permitting other than full and open competition.
FAR 6.302-1, "Only Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements"
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
For this requirement, AFI 11-410, Personnel Parachute Operations, states that only authorized products can be used for USAF military version, and only the CYPRES Automatic Activation Device is acceptable. The Technical Manual 09770A-12A&P states how to maintain and properly operate the military version of the CYPRES Automatic Activation Device. No other version is covered in the Technical Manual. Although multiple companies carry the commercial version of the CYPRES Automatic Activation Device, only SSK Military Industries carries the military version and is the only authorized company to inspect and perform maintenance and/or repair on these devices. AirTec GmbH, the manufacturer of the CYPRESS AAD, has designated SSK Industries, Inc. as the only provider authorized to perform the 4 & 8 Year CYPRESS maintenance in the United States. As of this time, market research has not identified alternative service providers that are authorized by the manufacturer to perform service and also registered to do business with the Government. Therefore, it was determined that with the consideration of the organization's critical mission and minimum needs there is reasonable basis to conclude that the unique services available from a limited number of source of suppliers with unique capabilities is applicable under the authority and application of FAR 6.302-1.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
During market research, previous for CYPRES maintenance requirements were reviewed and found that all Air Force contracts were conducted as a sole source requirement. This will be posted on the GPE with an intent to sole source prior to solicitation and award. If other interested parties express interest in the requirement, a review of their capabilities will be conducted. Additionally, contact will be made with the manufacturer, AirTec GmbH, to determine if a vendor other than SSK Industries, Inc. performs the service, if any components or product warranties will be compromised or void.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Prices will be determined fair and reasonable based on a review of available previous acquisition history.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
The Contract Specialist conducted extensive market research which found that no mandatory source per FAR Part 8 could fulfill the requirement. Additionally, because the manufacturer holds the patent for the CYPRES Automatic Activation Devices, further market research was limited to previous acquisition history, which all previous contracts for the CYPRES Automatic Activation Devices were solicited through GPE as Brand Name/Sole Source. Those solicited as brand name resulted in only SSK Military Industries bidding due to SSK Military Industries being the only U.S. vendor authorized to inspect and perform maintenance and/or perform repair on the military version of the CYPRES Automatic Activation Device.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
While other companies provide CYPRES maintenance, only SSK Military Industries, Inc is capable of maintaining CYPRES units and is registered to do business with the government.
X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The goal of the 355th Contracting Squadron is to utilize the most efficient and affordable services in order to meet the customer's needs in a timely manner. The unit makes a priority of developing competition to the maximum extent practicable. In this case, competition was barred by an AFI and did not leave any room to source through additional vendors.
