J&A for Contract HSFLGL-17-C-00002, Mod P00061 Food Services, FLETC Glynco GA
(1) Agency and Contracting Activity: The Department of Homeland Security (DHS), Federal Law
Enforcement Training Centers (FLETC), Student Services Division and Procurement Division proposes to enter a contract on a basis other than full and open competition.
(2) Nature and/or description of the action being approved: The FLETC has a requirement on a sole source basis to obtain food services at an estimated cost of . The acquisition will be under the Randolph Sheppard Act Program, 20 U.S.C 107 (a), with the Georgia Vocational Rehabilitation Agency, Business Enterprise Program, 5238 Royal Woods Parkway Suite 200, Tucker, GA 30084. The purpose of this procurement is to provide continued food services at the Main Dining Hall, building 75 and the Student Center Grill, building 260, for the same level of effort as currently provided under contract HSFLGL-17-C-00002. Extending the period of performance for three months, effective October 1, 2021 through December 31, 2021 will ensure continued food services support until the new contract is awarded.
(3) Description of Supplies/Services: The requirement is to provide for an extension of the management, supervision, personnel, equipment, tools, materials, supplies and services necessary to continue food services, effective October 1, 2021 through December 31, 2021. The Contractor shall perform to the standard requirements of the contract. The funding for this action under purchase requisitions (PRs) have been approved for this modification. The funding for the three-month period is a total estimated amount of
(4) Identification of Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C 253(c)(1), as implemented by Federal Acquisition Regulation (FAR) Subpart 6.302-1, entitled “Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements”.
This modification is being issued to extend the current contract in accordance with FAR clause 52.217-8, Option to Extend Services that was included in the current contract at time of award.
(5) Demonstration that the Nature of the Acquisition Requires use of the Authority Cited: The current contract expires on September 30, 2021. There is a need to provide food services for the requesting agency. The extension for the current contract is necessary between the current contract and execution of the follow-on contract. The FLETC needs the continuity of services without interruption. These services are an integral part of training and are critical to support FLETC mission. To not provide these services could severely impact the success of FLETC.
(6) Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable: FLETC intends to directly negotiate with the Georgia State Licensing Agency for the follow-on contract under the Randolph-Sheppard Act program and as authorized in accordance with 34 CFR 395.33 (d).
(7) Determination by the Contracting Officer that the Anticipated Cost to the Government will be
Fair and Reasonable: The Contracting Officer will utilize the current contract pricing to include the current labor rates incorporated by FY2021 wage determinations SCA No. 2015-4477, Rev 14, dated May 1, 2020 and CBA No. 2018-11756, Rev 2, dated September 18, 2020, which have been determined fair and reasonable.
