Department of Army Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000
2. Description of Action: Army Sustainment Command (ASC) required a Cost- Plus-Fixed-Fee and Cost-Reimbursable bridge contract with Technica, LLC, to continue to provide Enhanced Army Global Logistics Enterprise (EAGLE) services at Fort Irwin, CA (FICA). ACC-RI awarded contract W52P1J-20-C-0028 as an Undefinitized Contract Action (UCA) with fiscal year (FY) 2020, Operations and Maintenance type funds on 19 July 2020. An acquisition plan was not required because this procurement did not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).
This action was a bridge contract to ensure continuation of critical services for ASC until ACC-RI awards the follow-on task order. The current milestone for award of the follow-on EAGLE Task Order is . The legacy task order, W52P1J-12-G-0018 Task Order 0003, expired on 19 July 2020.
3. Description of Supplies/Services: The Government had a requirement for Technica LLC to provide logistics support services at FICA Logistics Readiness Center, and other tactical units. The Readiness Center includes four primary divisions: Plans and Operations; Installation Maintenance division; Installation Supply & Services Division; and the Installation Transportation Division. The Maintenance Division provides field and sustainment level maintenance support to tactical units and Government civilian activities. The Supply and Services Division provides supply and services support to include Central Issue Facility operations, hazardous material warehousing operations and retail supply operations through the Installation’s classes of supply II, III, III(P) IV, and IX supply support activity. The Transportation Division provides Personal Property Shipping Office operations, and personnel movements’ support, unit movement planning support, and transportation motor pool management for the Installation.
Technica LLC will provide complete technical, operational, and logistical support functions required to maintain FICA in mission ready condition.
The period of performance for this action included
4. Authority Cited: 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, Unusual and compelling urgency.
5. Reason for Authority Cited: As described in FAR 6.302-2(a)(2), when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
ACC-RI competitively awarded legacy Task Order W52P1J-12-G-0018 0003 to Technica LLC in September 2014, as a competitive requirement under the EAGLE program. After having completed all available evaluated option years, along with the evaluated FAR 52.217-8 six month extension, delays in preparation of requirements documents in support of the competitive follow-on required a stand-alone follow-on contract to ensure continuity of services.
Between 16 April 2019 and January 2020, numerous iterations of Procurement Package Information (PPI) were received from ASC in support of the follow-on competitive effort. Many of these changes to PPI came as a result of questions and areas of concern raised by eligible EAGLE Basic Ordering Agreement (BOA) holders upon review of the draft solicitation, which was released on 20 May 2019.
6. Efforts to Obtain Competition: IAW FAR 5.202(a)(2), ACC-RI shall not synopsize this action. Because this was a sole source action, effective competition was not applicable. The Government achieved subcontracting competition by including FAR clause 52.244-5, Competition in Subcontracting in the contract, which states that the contractor shall select subcontractors on a competitive basis to the maximum practicable extent.
7. Actions to Increase Competition: ACC-RI issued a follow-on procurement action for EAGLE services at FICA, to be competed among EAGLE BOA holders that are certified by the SBA for participation in the 8(a) program. The request for proposal (RFP) was issued on 23 July 2020, with anticipated award of the task order in
8. Market Research: Market Research, performed between January and February 2020, for the competitive follow-on indicated EAGLE BOA Holders could potentially perform these services. ACC-RI posts an annual announcement wherein interested industry partners can submit a proposal to become an EAGLE BOA holder. Only EAGLE BOA holders are eligible to propose on actual EAGLE requirements for services across the EAGLE enterprise. The RFP for the competitive follow-on was issued on 23 July 2020, and multiple vendors have expressed interest to date.
While any 8(a) EAGLE BOA holder that meets the required FICA-specific average annual dollar values for Maintenance, Supply and Transportation services could be capable of performing the requirement, Technica LLC served as the incumbent and is the only contractor that could continue performance of the urgent requirement without degradation, interruption or cessation of critical services within the available timeframe while the follow-on competition is completed.
9. Interested Sources: To date, no other sources had expressed a written interest in this requirement.
