JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ 08733.
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves on a Sole Source basis a Firm Fixed-Priced contract with Teledyne Risi Inc., 19735 Dearborn St. Chatsworth, CA (CAGE:
0EUB8) for the procurement of equipment in support of the Kuwait Air Force F/A-18 E-F Foreign Military Sales (FMS) Platform.
3. Description of Supplies/Services.
This acquisition is for the procurement of a quantity of two (2) Electronic Sequencer Test Sets (Type: TTU-515/E), Part Number: 2018AS100-3, NSN: 6625-01-473-2030 required to eliminate false removal errors for the Navy Aircrew Common Ejection Seats ejection sequencer, and allow for true failures.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Teledyne Risi, Inc. is the Original Equipment Manufacturer (OEM) and the only source capable of meeting the Government’s requirements for the Electronic Sequencer test sets. Any attempt to procure a different part number would require the Government to fund a Preliminary Design Review, Critical Design Review, First Article Test and Test & Evaluation effort for a new vendor. The Government would have to fund personnel to be on the Source Selection Team to review proposals. Any change in form, fit or function would require changes to the existing Integrated Logistics Support (technical publications, spares inventory, calibration), which would incur additional costs for update in the amount of $750,000 to $1 million. These costs would not be expected to be recouped through competition. The process required to obtain an alternate asset is cost-prohibitive and would force the FMS Partner to utilize an asset that is not supported, compatible, or interchangeable with the USN-approved configuration. No other source is capable of supplying the required test set. Teledyne builds the electronic sequencers for the NACES ejection seat and owns the data for these sequencers. Teledyne is the only known source with sufficient technical data, drawings, software and trained technical personnel to satisfy this requirement.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The F/A-18 Program technical team conducted Market Research and internet searches. The Support Equipment Part Number, Nomenclature, and National Stock Number were utilized when searching. The Federal Procurement Data System, Dynamic Small Business Search, Haystack, Google, Bing, and Yahoo search engines returned queries from Aerobase Group and WB Parts, Inc. These two vendors were identified as after-market resellers not capable of providing a ROM at this time. The Electronic Sequencer Test Set carries an Acquisition Method Code of 3H recommending the parts be acquired directly from the OEM as the U.S. Government does not have data in its possession to acquire these items from any other source. Teledyne Risi Inc., is the OEM and the only source capable of meeting the Government’s requirements for the Electronic Sequencer test sets.
A Request For Information was posted on 02 September 2020 through 07 September 2020 to the Beta.Sam web portal. No responses were received. The synopsis required by FAR 5.201 was published on the Beta.Sam web portal on 08 September 2020 through 23 September 2020. No responses were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of field pricing support, if necessary. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price for the supplies covered under this J&A.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR Lakehurst does not have adequate and proprietary rights to compete future contracts for the parts covered by this document at this time.
If another requirement emerges and potential sources for that requirement are identified, NAVAIR will assess whether competition for future requirements is feasible.
