II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This new individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, follow-on, firm-fixed price requirements type contract. This contract is non-commercial and is not a bridge action.

This contract is for a repair of the Power Supply used on the B-1, from Symetrics Industries LLC (CAGE) code 22830. In accordance with FAR Part 16, a 1-year basic contract with four, 1-year option ordering periods is considered to be appropriate for this acquisition. The estimated total value of this award is $ with an estimated award date of 22 March 2020

This is a services contract. The dollar values listed below reflect the anticipated value of the acquisition. Under the contemplated contract, Symetrics Industries LLC will provide the repair of the B-1 Power Supply.

No Fault Found (NFF) Type of Appropriation: 97X4930 Total Estimated Dollars for PR Line Item 0003: NFF costs are less than the cost of repair. They are applied through de-obligated funds from the cost of repair, thereby reducing the dollar value of the contract. Cost estimation is unnecessary.

Over and Above (O&A) Is negotiated on an as needed basis. O&A is estimated at 10% of total estimated repair dollars based on historical requirements.

Due to the circumstances described below in Sections V, IX and XI, there are no additional actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year’s requirements. If other qualified or approved sources become known at any time during the contract, competition will be utilized to the maximum extent possible.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

The B-1 Power Supply described in Section III is a component of the B-1 aircraft which converts 230 VAC input voltage to 28 VDC and routes it to the Stability Enhancement Function (SEF) DC BUS, which stabilizes the aircraft in case of load shift. The B-1 Power Supply repair data and specifications are not owned or licensed by the Air Force, and require special tools, equipment, and test interface boxes to adequately perform the repair that returns the item to a serviceable condition. Symetrics is the only known vendor that possesses the necessary repair data to repair the B-1 Power Supply described in Section III. Accordingly, Symetrics is the only known source that can provide the services described in Section III. Therefore, this acquisition is for the continued performance of a highly specialized service.

The item identified in Section III contains critical characteristics and, at a minimum, meets the requirements of a critical application item as defined in the Aviation Critical Safety Item Management Handbook. The complexity of this item and its criticality to safe operation of the aircraft requires the source of repair be an approved source possessing the data, experience, skills, and equipment necessary to restore this item to a serviceable condition. Symetrics Industries LLC is currently the only known qualified source possessing the required tech data, test equipment, and special tooling to perform this repair. completed repair from September 1994 to January 2011, however agreed to license data exclusively to Symetrics Industries LLC in April 2017. The Government does not possess validated/verified technical data for the repair of the power supply. Only Symetrics Industries LLC possesses the data/expertise to perform the required work. Symetrics Industries is licensed by to complete repair, however does not own data. Per a phone call with a representative for on 29 Jan 20, has not licensed any other company and are not willing to sell the data to the government.

Reverse engineering the repair process is not feasible within allowable timeframes.

Based on previous Consolidated Sustainment Activity Group (CSAG) efforts, reverse engineering the repair process is estimated to take a minimum of 5 years from the initiation of a CSAG Sustaining Engineering project. This timeframe includes the budget request period, purchase request processing, contract negotiation and award, period of performance, qualification testing of the reverse engineering process and source approval.

The 422 SCMS believes that award to any other source would result in unacceptable delays in fulfilling the Air Forces requirement. Such unacceptable delays will impact the Air Force mission by causing the backorder posture to continue to increase and will have continued visibility as a Mission Impaired Capability Awaiting Part (MICAP) driver.

Ultimately a lack of repair parts may cause aircraft to be grounded.

Accordingly, Symetrics Industries LLC is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

On 17 July 18, this requirement was synopsized and posted in BETA.SAM.GOV for 30 days under FA8117-18-SS-0021. As of 16 August 18 two businesses showed interest by the response date; , and . See Section X for details. Two sources indicated interest, however to date no source approval packages have been received from these sources. Additional internet market research was conducted by 01 July 19. No additional sources were found.

This requirement will be synopsized in http://www.beta.sam.gov as a notice of proposed contract action IAW Far 5.201. Expected date of publication is 17 July 2018.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. IAW FAR as supplemented, the contractor will be required to submit Certified Cost or Pricing Data and/or Other Than Certified Cost or Pricing Data. A detailed cost analysis and price analysis will be performed. The Contracting Officer will request a technical evaluation from the Defense Contract Management Agency (DCMA) to aid in the evaluation of the contractor’s proposal. The Contracting Officer will seek audit assistance from the Defense Contract Audit Agency (DCAA) if necessary.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

Market research, in accordance with FAR 10, was conducted by a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer.

This research included inquiries into internet sites including Google, the Thomas Register, Haystack, and similar item manufacturer’s websites and was conducted over a period ending 29 Jan 20. This is a non-developmental item that is a military unique requirement. Other sources manufacture similar items but none have been identified as having access to the data described in Section V necessary to meet the requirement described in Section III. Further, this requirement cannot be modified nor be satisfied with a commercial or modified commercial item.

A Sources Sought Synopsis was also conducted; see Section VI for more details. Based on this market research, Symetrics Industries LLC was found to be the only source able to fulfill the requirement described in Section III.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Symetrics Industries is licensed to complete repair however does not own data. Per a phone call with a representative for on 29 Jan 20, has not licensed any other company and will not sell data to the government.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

As a result of continued refusal by the OEM to provide data as well as the duplication of cost or unacceptable delay of developing additional sources per Sections V and IX, there are no known additional actions which can be taken to remove barriers to competition and therefore, specific actions and milestones cannot be established.

Per PGI 206-304(a)(S-70 – As indicated by signature on the Coordination and Approval Document, the previous Justification and Approval has been reviewed and the Approval Authority determines that all stated actions to remove barriers to competition have been accomplished.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2 (c).
