4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C.
Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-
1(a)(2)(ii)(A), Only One Responsible Source and No Other Supplies or Services Will
Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Government has previously procured Computrition Suite Point POS software with a Back
Office module, and now requires additional hardware to utilize the procured software. Although it is commercially available off-the-shelf (COTS) software, it has been modified, allowing the
Government to interface with the Marine Corps Total Force System (MCTFS), and provide the tools necessary for a paperless and cashless environment. The POS units will incorporate both card scanners and readers to read the Department of Defense (DOD) RAPIDs Common Access
Card (CAC) for patron identification and entitlement verification. POS terminals will also be used to record cash collections from authorized paying personnel. The unique DOD public key infrastructure (PKI) requirements, along with the Marine Corps stringent hardware/software certification process makes this process different than how the standard COTS software was designed to be utilized. The POS Back Office system is run in a Windows Server environment with an Oracle 12c database. Consequently, the POS Hardware and configurations must be compatible with this modified Computrition software that the Government has procured.
The HQMC C-4, Information Assurance (IA) Analyst Enterprise Branch, requires all new hardware to be tested prior to being approved to operate on the Marine Corps Enterprise
Network (MCEN). This requirement was previously coordinated with MARCORSYSCOM which was provided with the proposed hardware configuration for testing.
The Marine Corps Network & Infrastructure Services (MCNIS) assigned a team to work with the software vendor to test and certify this hardware configuration with the required DOD Security
Technical Implementation Guides (STIGs) configuration standards required for DOD IA and IA-enabled devices/systems. This testing and certification are unique to the salient characteristics of this specific hardware and software configuration. Changing to another brand would be a waste of these resources and the Marine Corps could lose over 210 man-hours, and approximately
$10,000 in support salaries associated with the required hardware certification. Switching to another brand (even though the specifications may be the same) would essentially require rework of all previous IA testing and certifications, putting the program at greater risk for delays and potential failure.
Similar products, or products that have not been pretested and certified, do not meet, the agency’s needs. The proposed hardware was based on the Marine Corps’ recommended hardware solution to comply with the current MCEN Windows 10 environment. Computrition based all software testing and development around HP technology and will only guarantee that the modified software will work on the specific HP model. Without the purchase of this HP POS hardware suite and service maintenance agreement, the United States Marine Corps stands to lose $1.3 Million dollars associated with software design and interfacing. Utilizing uncertified and untested hardware has a strong potential to render the software useless. Additional funding to purchase replacement computers, if they don't work with the modified software, will result in mission failure.
The DOD Chief Information Officer released a memorandum (dated 20220608) regarding
Microsoft Windows 11 migration action, which mandated migration to Windows 11 by 2025.
Subsequently, the Marine Corps released a Marine Administration (MARADMIN) 340/22 directing the Marine Corps to have all end-user devices compliant with Windows 11 by 2025. In addition, Marine Corps Cyberspace Operations Command (MCCOG) released Tasking Order
22-3085, directing all applicable MCCOG managed MCEN End User Device (EUD) to operate on Marine Corps Enterprise Desktop Standardization (MCEDS) 1.0.9.0 no later than 30 October
2023. The new requirement is to be compliant with Windows 10 that is upgradeable to Windows
11, which will be referred to as HP Engage One Pro. As a result, the current HP9 POS Models are obsolete and cannot support the required MCEDS image software.
The 40 additional HP Units being procured under this effort have virtually the same characteristics of the current POS Units being replaced. As stated above in paragraph 2 of this section, new hardware would require new IA testing and certifications to ensure it can operate on the MCEN, creating a delay and duplicative work. Due to the characteristics of the 40 additional units being virtually the same, the costs and time associated with this testing is reduced compared to a new hardware unit. Additionally, the current Contractor is familiar with the characteristics of the HP units and is aware of the installation and testing processes necessary to bring the units online. The period of performance of the current contract is scheduled to end in
September 2023. The amount of time and effort to complete software installation and unit testing of a different product will, as noted in paragraphs 3 and 4 of this section, create duplicative costs and work that would delay the command from meeting the timeline requirements set forth in paragraph 5 of this section. Likewise, using any other brand or model of computer hardware would require extensive system testing and likely jeopardize the ability for the current contractor to perform the required software-related services before expiration of the period of performance.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible
This effort will be synopsized on SAM.gov in accordance with the requirements for FAR 5.2. All responses will be evaluated prior to award of the modification.
The original solicitation was issued as a total small business set-aside on FedBizOpps based on market research that indicated two or more responsible small business concerns would compete.
The resulting contract, M95494-18-C-0027, was awarded as a small business set-aside.
The requiring activity conducted market research and determined that due to the requirements set forth by the Department of Defense Chief Information Officer memorandum (dated 20220608), MARADMIN 340/22, and MCCOG Tasking Order 22-3085, as detailed in paragraph 5, only the specific brand name hardware will suffice in this instance. Resource Point of Sale LLC is already currently under contract to provide this brand name hardware, and this justification merely increases the quantity of a previously approved brand name justification associated with the contract prior to executing an in-scope modification to contract M95494-18-C-0027. The
Contracting Office will ensure that in accordance with FAR 13.501(a)(1)(iv), the brand name justification will be synopsized.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The fair and reasonableness of the price will be based on an analysis of the contractor’s price quote, including backup information supporting the price with published price lists or comparison with other quotes submitted.
8. Actions to Remove Barriers to Future Competition.
The Marine Corps intends to compete future contracts for the types of supplies/services covered by this brand name J&A. Market research will be conducted to determine contractor and product capabilities and their abilities to meet the Marine Corps needs related to this requirement.
