About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition for a firm fixed price service contract for Amplicon Metagenomic Sequencing. The proposed contract is for 12 months with no option periods and an estimated value of $66,400. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as Novogene was the only vendor capable of extracting DNA from paraffin embedded samples and performing the required sequencing and bioinformatic analysis. Market research was conducted, and no other sources were found that could meet the government's requirements. The Contracting Officer will determine the price to be fair and reasonable. The related federal contract opportunity, Solicitation Number N34398-24-P-0701, has been awarded to an unknown vendor for an unknown amount on 2024-02-21.

NAVAL MEDICAL RESEARCH UNIT SAN ANTONIO
JUSTIFICATION & APPROVAL FOR USE OF OTHER THAN FULL & OPEN COMPETITION
FY'24 Page 1
1. Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition."
This Justification and Approval (J&A) is executed by Naval Medical Research Command (NMRC), 503
Robert Grant Avenue, Silver Spring, MD 20910, on behalf of the requesting agency, Naval Medical Research
Unit San Antonio (NAMRU-SA), 3650 Chambers Pass, Building 3610, JBSA Fort Sam Houston, TX 78234.
2. Nature and/or description of the action being approved.
The proposed action is for a sequencing service contract agreement to receive paraffin embedded samples, extract genetic material, sequence the microbial DNA, and bioinformatic analysis of the data. The Government intends on awarding a Firm Fixed Price contract for a period of performance for 12 months with no option periods. The proposed source is:
Novogene

3. A description of the supplies or services required to meet the agency's needs (including the estimated value).
NAMRU-SA has a need for genomic DNA extraction, 16s and ITS sequencing and bioinformatic analysis.
Estimated Dollar Value.
The estimated value of this contract is $66,400.00 for a period of performance of 12 months with no option periods.
4. An identification of the statutory authority permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C.
2304(c) (1) as implemented by FAR 6.302-1; only one responsible source and no other supplies or services will satisfy agency requirements.
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
While other vendors were able to offer similar sequencing and bioinformatic support, none of the vendors we contacted were capable of extracting DNA from paraffin embedded samples. NAMRU-SA does not have the equipment, personnel, or the expertise to do the extraction onsite. Consequently, Novogene was the only vendor contacted that responded and was able to fulfill all the government's needs.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
Market research was performed, the results of which are in paragraph 8. This requirement will be posted to
SAM.gov in accordance with FAR 5.202. No other known sources have expressed an interest, and no other source is expected to express interest in this effort.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis prior to award. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor's commercial price list and will be determined fair and reasonable.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
Market research was conducted by technical experts from 5 June 2023- 5 July 2023. This research consisted of market survey through search engines of open market vendors. Search engines utilized include Google, FPDS
NG, and GSA Advantage. The government's technical experts determined that Novogene is the only vendor contacted that could fulfill all the government's requirements stated herein.
9. Any other facts supporting the use of other than full and open competition.
The government's requirement is for a firm fixed price service contract for Amplicon Metagenomic
Sequencing (WBI) which requires the following tasks be performed on each sample:
1. DNA extraction and sample QC
2. PCR amplification
3. Amplicon library preparation
4. NovaSeq PE250 (0.03M raw tags)
5. Standard analysis
Novogene was the only vendor contacted by NAMRU-SA that could provide all the above-mentioned tasks.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
To date, no other sources have written to express an interest. This requirement will be posted on SAM.gov in accordance with FAR 5.203. Any sources expressing interest in response to the synopsis will receive consideration.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
