JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRDL1-20-R-0243
1. Contracting Agency: Defense Logistics Agency - DLA Land Warren.
2. Description of Action: The proposed action is to award a contract to AMBAC International Corporation (CAGE 01843) or L3 Technologies Inc. (CAGE 02978) for National Stock Number (NSN) 2910-01-073-0124 Pump Assembly, Fuel Injection Metering.
The NSN 2910-01-073-0124, Pump Assembly, Fuel Injection Metering (Injection Pump), is used on the M88A1 vehicle.
This will be a new action utilizing a Firm-Fixed Price (FFP) 5-year Indefinite Delivery, Indefinite Quantity (IDIQ), Long Term Contract (LTC).
The PRON is EH0L0227EH. Army Working Capital Funds (AWCF) will be used.
3. Description of Supplies/Services: AMBAC International Corporation (CAGE 01843) or L3 Technologies Inc. (CAGE 02978), will provide the Pump Assembly, Fuel Injection Metering, NSN: 2910-01-073-0124.

This fuel pump sits in the "V" of the engine where it pressurizes and distributes fuel to 12 individual injectors, one at each cylinder. It is mechanically driven by a shaft operating off of the timing advance unit.

B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-
100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate technical data package (TDP), data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is: 10 United States Code (U.S.C.) 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), “When the supplies or services required by the agency are available from only one responsible source, or, for DoD, National Aeronautics and Space Administration (NASA), and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”
5. Reason for Authority Cited:
The Injection Pump is a critical component of a highly specialized Air cooled, V engine configuration, diesel, supercharged (AVDS)-1790 engine assembly which operates in a unique military weapons system. The design of the Injection Pump is unique in that it is packaged in such a way to fit within the valley of the AVDS-1790’s cylinders neatly and align axially with a shaft which drives its operation. Development of a similar pump would also be required to fit within this unique space claim without interference with existing components also collocated in the valley of the engine all while delivering fuel at the volume and pressure specific to satisfy the fuel demand of an AVDS-1790 engine.
The Government does not have complete build to print TDP.
Only the identified sources AMBAC International Corporation and L3 Technologies Inc.
have demonstrated the requisite technical and engineering expertise to perform all efforts required to provide the Injection Pump. Also, AMBAC International Corporation and L3 Technologies Inc. have demonstrated the unique and proven manufacturing capabilities to repeatedly manufacture quality Injection Pumps.
In addition, the approved sources’ items have met the North Atlantic Treaty Organization (NATO) requirements for successful completion of NATO Laboratory Test for Diesel and Spark Ignition Engines AEP-5, Allied Engineering Publication while operating in an AVDS-1790 engine. This test is required for components which are critical for engine and vehicle operation and crew safety. Malfunction could result in catastrophic loss of equipment and life due to failure of the vehicle’s engine caused by a faulty injection pump during a combat situation. If another possible source of supply for this item were identified, qualification testing would be required.
A complete TDP of the Injection Pump has not been developed for competitive use.
There are currently no plans to acquire a competitive TDP due to lack of funds that for future procurements due to the reasons cited above.
Due to the costs associated with developing a competitive TDP that cannot be recovered, the Government is not actively pursuing the development of a competitive TDP for future procurements.
8. Market Research:
Market Research efforts included a Source Sought posted to Beta.Sam on 23 June 2020. No responses were received.
Market research was performed by Ground Vehicle Systems Center (GVSC) Heavy Combat Vehicle (HCV) Engineering on 20 April 2020 by reviewing vendor catalogs and available product literature published by Denso Inc. and Stanadyne Inc. to determine if their commercial Injector Pumps are able to meet Government's needs or could be modified to meet the Government's needs. While these two sources manufacture injector pumps and head assemblies for heavy duty applications, they lack a solution with the dimensional requirements, geometry and mounting provisions needed to fit within the unique space claim of the M88 Family of Vehicle’s (FOV’s) application
