C.1 Scope of Work The contractor shall replace a portion of the water distribution system in the well/pump house building and vicinity at the US Forest Service Esterbrook Work Center near Esterbrook, Wyoming. The new system will include two new pumps and motors in the existing wells, new pressure controllers for each, a new alternating control panel for switching service between the two to extend the lifespan of the pumps, and all associated new wiring and new pipe. The contractor shall also reconfigure the piping in the well house (as seen in the C.12 – Photos) to be more efficient and less hazardous. Plans for reconfiguration shall be provided to the CO prior to implementation. The existing fibrewound pressure tanks shall be replaced with new pressure tanks that match the existing quantity and capacity. Finally, the new system needs to be protected against freezing during use in the winter months.

All work shall be performed in accordance with the design specifications and requirements found in this Statement of Work (SOW), attached drawings, site plans, and product manufactures’ specifications and installation instructions.

C.1.1 Removal of existing pumps and motors, to be left in custody of COR. Removal and disposal of existing fixtures and hardware (controllers, pipe, valves, wire, pressure tanks).

C.1.2 Plumbing and installation of two new submersible pumps (10 GPM ea, Berkeley L7P4EMGS or equivalent), two new submersible motors (1hp, 3-phase ea, Pentek P43B0010A3-C or equivalent), variable frequency drive (Pentek PID10 or equivalent), alternating control panel (Pentek VFD-ALT or equivalent), and associated piping (1” polyethylene)/wire (12/3 well wire)/hardware.

C.1.3 Plumbing and installation of two new pressure tanks (120 +/- 2 gal, Dayton 16X844 or equivalent), and associated piping/hardware.

C.1.4 Reconfiguration of existing pump-to-controller-to-pressure tank plumbing network to reduce footprint of existing system, to be approved by the contracting officer. This system can be seen in section C.12 – Photos, Interior South Wall and Well #1. In-kind replacement of pleated filters.

C.2 Project Location & Description The project is located on the Medicine Bow – Routt National Forest on the Douglas Ranger District near Esterbrook, Wyoming. The improvements shall be made within the vicinity of building 13574 – E W C Well/Pump House, located at 42.415599°, -105.361781°. Aerial imagery of the site can be seen in C.3 Maps. This water system is used all year by fire personnel stationed at the Esterbrook Work Center.

The water system includes two wells. Well No. 1 was drilled in 1964 and reaches 81 ft below ground surface (BGS). Well No. 2 was drilled in 1980 and the pump currently sits at 260 ft BGS.

Currently Pump No. 1 is the only one in operation, and both pumps have an indeterminate age.

Three fibrewound 120-gallon pressure tanks reside in the well house on site, installed in 2011, and two have slow leaks in their bladders, while the third has failed.

C.3 Contractor Requirements The Contractor shall provide everything--including, but not limited to, all materials, equipment, supplies, transportation, labor, and supervision--necessary to complete the project. The existing pumps and motors, upon removal from their respective wells, shall become property of the federal government and left in USFS custody with the contracting officers representative.

The contractor shall be responsible for all aspects of removal and installation and all work is incidental to the pay items on the schedule. The final measurement, fit, and operation of the upgraded water system are the responsibility of the contractor.

C.3.1 Drawings and Plans. The specifications contained in the following are original design documents and may be used for guidance in upgrading the system. These drawings are hereby made a part of this solicitation and any resultant contract: SITE NO.017 EWC Water Sys Improvements - 1980 (Attachment I)

C.3.2 The Contractor is required to have a minimum of three years’ experience in this field of work and shall provide all labor, supervision, management, transportation, tools, equipment, materials, and supplies necessary to perform the work as described in this solicitation and SOW.

C.3.3 All plumbing work shall comply with all Federal, State, County, and Local Codes and regulations.

C.3.4 Permits, Licenses, Insurance and Notification: The Contractor shall possess all necessary licenses, certifications, insurance, and permits in conjunction with Scope of Work, and provide timely notification of such actions as required by Federal, State, and Local Codes and regulations. The Contractor shall furnish copies of all licenses, permits, insurance documents, and modifications to the Contracting Officer, or the Contracting Officers Representative, and the Environmental Protection Agency as outlined in 40 CFR part 61.

C.3.5 Reporting of Asbestos Containing Material: The US Environmental Protection Agency reporting threshold for regulated asbestos-containing materials (RACM) is 260 linear feet on pipes, 160 square feet on facility components, or at least 35 cubic feet of facility components where the amount of RACM previously removed from pipes and other facility components could not be measured before stripping. Quantities under this threshold and total quantities of asbestos removed and disposed of shall be reported to Contracting Officer daily during the term of the contract. Quantity records shall be maintained using electronic computer files and hard copy files. Hard copies shall be stored on site, and available always for inspection. Quantities under this threshold and total quantities of asbestos removed and disposed of shall be reported to the Contracting Officer with a chain of custody on the Department of Transportation (DOT) waste manifest, on a weekly basis during the term of the contract.

C.3.6 Existing Physical Conditions: The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government or its Contractors. It is the Contractor’s responsibility to verify all dimensions and conditions related to this project/contract before proceeding with the work. All dimensions shall be verified by the Contractor.

C.3.7 Commencement of Work: The Contractor shall notify a Contracting Officers Representative at least three (3) days before work is started.

C.3.8 Contractor’s 24-hour Point of Contact: During all times when work is in progress, the contractor shall maintain an individual meeting the definition of “Competent Person” available on call 24 hours a day. This person shall be capable of responding to the COR within one hour of notification and possess authority sufficient to direct immediate correction of health and safety deficiencies, problems associated with natural disasters, fires, and similar incidents. The telephone number or numbers for contacting this person or persons shall be provided to the Contracting Officer, Contracting Officers Representative, Forest Engineer, and Douglas Ranger District office front desk.

C.3.9 Site Inspections: While performing work, the Contractor is subject to on-site inspections by the Contracting Officer, the Contracting Officers Representative, the MBRTB Safety & Occupational Health Specialist, MBRTB Forest Engineers, and Federal, State and Local inspectors for fire, safety, and personnel health. If work is in violation of specification requirements, Federal, State or Local Codes and regulations, the Contracting Officer may issue a stop-work order to be in effect immediately and which shall remain in effect until resolution of the violation. If required by the Contracting Officer, a new amended Work Plan shall be submitted by the Contractor for approval.

Restart shall not be accomplished without the approval of the Contracting Officer.

Standby time and the cost required to resolve the violation and approval for a restart shall be at the Contractor’s expense.

C.3.10 Storage of Materials: Materials shall be stored in a place and in a manner which protects them from damage and contamination. During periods of cold weather, plastic materials shall be protected from the cold. No flammable or hazardous materials shall be stored inside Government buildings. The Contractor shall regularly inspect materials to identify damaged or deteriorating items. Damaged or deteriorated items shall not be used and shall be removed from the site as soon as they are discovered. Stored materials shall not present a hazard or an inconvenience to Government employees, Contractors, or visitors.

C.3.11 Transportation Plan: Transportation shall conform to all Federal, State, and Local Codes, and regulations to include 40 CFR 240-280 and The Resource Conservation and Recovery Act (RCRA).

C.3.12 Disposal: Waste disposal shall be accomplished in accordance with all Federal, State, and Local Codes and regulations. The Contractor shall meet or exceed all US Department of Transportation, Environmental Protection Agency, and Occupational Safety and Health Administration regulations, to include placarding and covering of loads. A copy of the waste shipment record shall accompany each load of waste being disposed. The Environmental Protection Agency waste shipment record, or equivalent, should be prepared listing the Contractor as the generator.

C.3.13 Properly contained waste shall be transported off Federal property to an approved landfill for disposal. All material shall be disposed of in accordance with applicable County and State regulations.

C.3.14 Protection of Existing Improvements. The Contractor shall repair any damage caused to the Esterbrook Work Center by their employees or subcontractors in accordance with FAR 52.236-9, and at the direction of the CO.

C.3.15 Accessibility: The EWC Well/Pump House is a government-owned facility on Federal property. The Contractor (and its subcontractors) may only access the job site for work specifically detailed in this SOW; access for any other reason is prohibited.

C.3.16 Denied access: If the Contracting Officer or the Contracting Officers Representative determines that the Contractor’s services were interrupted due to emergency (i.e., fire), the Contractor will be notified, and work will be rescheduled at a time when satisfactory to both parties.

C.3.17 Government and personal property found out of place by the Contractor’s employees in performance of the contract shall be turned in to the Douglas Ranger District office.

C.4 Estimated Start Date & Contract Time Estimated Start Date: September 16, 2023. Contract end date: October 16, 2023.

C.5 Restrictions on Work Work shall be restricted to daylight hours Monday through Friday and no work may be conducted on Federal Holidays. Use of the project site will be shared with USFS personnel: work and equipment shall not impede normal flow of traffic and personnel on the compound, and the water system shall be operational outside of normal working hours (0800-1700).

C.7 Camping and Housing Camping is not permitted in US Forest Service campgrounds. The Contractor may be permitted to camp elsewhere on US Forest Service land, in which case the Contractor shall request a permit from the Douglas Ranger District Office. Camping on Forest Service land is not a right;

permission may be revoked for failure to comply with the terms of the permit. The Contractor may use a self-contained travel trailer or recreational vehicle to camp on National Forest System lands near the project sites subject to the approval of the CO. All waste material shall be transported off-site to a station equipped to handle such waste.

Housing will not be made available by the US Forest Service.

C.8 Technical Requirements

C.8-1 Definitions Contracting Officer (CO): The Contracting Officer is the Government official with the authority to enter, administer and/or terminate contracts, and make related determinations and findings (Acquisition.gov).

Contracting Officers Representative (COR): The Contracting Officers Representative is an individual designated and authorized in writing by the Contracting Officer to perform specific technical and administrative functions.

Competent Person: This person shall have experience in administration and supervision of construction projects of similar scope, including work practices, protective measures for job sites, personnel, and disposal procedures. This person shall have had a minimum of 2 years on-the-job experience. A “Competent Person” is additionally defined in 29 CFR 1926.32, .59, .62 and 49 CFR 172 Definitions.

Statement of Work (SOW): The SOW details what the Contractor must do in the performance of the contract. Documentation developed under the contract, for example, is specified in the SOW. Security assurance requirements, which detail many aspects of the processes the Contractor follows and what evidence must be provided to assure the organization that the processes have been conducted correctly and completely, may also be specified in the SOW.

Acceptance: Acceptance means the act of an authorized representative of the Government by which the

Government assumes for itself, or as an agent of another, ownership of existing supplies, or approves specific services as partial or complete performance of the contract.

Supplies: Supplies means the end items furnished by the Contractor and related services required under this contract.

Defect: Defect means any condition or characteristic in any supplies or services furnished by the Contractor under the contract that is not in compliance with the requirements of the contract.

C.8-2 Specifications Contractor shall submit specifications for material purchases for approval prior to order.

C.8-3 Contractor-Furnished The Contractor shall submit for approval a site-specific Work Plan to the Contracting Officer for this project. The plan shall be in detailed, plain English language and cover the work procedures to be used during all operations and include the names and qualifications of all individuals to be designated as Competent Persons. The plan shall describe the following:

• Scheduling/Define Ordered Work: All work shall include milestones and lead times.

• Hours of Operation: The Contractor shall perform work during regularly scheduled work hours of 0730 (7:30 AM) to 1700 (5:00 PM) Mountain Daylight Time (MDT), Monday through Friday, excluding Federal legal holidays. The Contractor shall coordinate with COR to determine work schedule.

• A notification list of personnel and organizations to be contacted by the Contractor in the event of an incident, emergency, or contingency shall be supplied to the Contracting Officer and to the Contracting Officers Representative by the Contractor.

• The Contractor shall require a safety briefing for all employees before starting Work on the project per US Occupational Safety and Health Administration (OSHA) regulations to include fire and emergency procedures, medical services, health and safety hazards, and work procedures.

• The Contractor shall have in place a contingency plan for potential emergencies, accidents, and incidents.

• Post Project Deliverables: Contractor shall submit a post project submittal which shall include:

o A cover letter signed by the Competent Person stating that the project is complete and listing all problems encountered and corrective action taken.

Letter should include an overview of all work performed during the entire project.

o Debris disposal information to include copies of manifests.

C.8-4 Government-Furnished Property

• The well/pump house and restroom facilities will be unlocked prior to regularly scheduled work hours on days the contractor is working by a USFS representative.

• Upon request of the Contractor, the Government will make available adequate supplies of 120V AC power.

C.8-5 Bid/Solicitation Information

• Contract Award Date, Performance Period, and Pre-Solicitation Meeting o The estimated Contract Award Date is September 15, 2023.

o The estimated Notice to Proceed date is August 16, 2023.

o Period of Performance. All work shall be completed 30 calendar days after the

Notice to Proceed has been issued by the Contracting Officer. The Contractor shall maintain progress at a rate which shall assure completion within the contract Period of Performance.

o The Contractor shall be assessed actual damages, per day, for any work not completed within the contract time, unless a contract time extension has been approved by the Contracting Officer. Actual damages include but are not limited to time and travel spent on the project by Government Officials.

o Pre-Solicitation Meeting and Site Visit. A one-time, pre-solicitation project site tour will be conducted on September 6th, 2023, 10:00 AM, Mountain Daylight Time (MDT). The pre-solicitation meeting will be conducted at the Esterbrook Work Center (42.415599°, -105.361781°). Contacting the COR following the pre-solicitation meeting and pre-award shall warrant exclusion from consideration for the project. Direct all questions to the CO.

Contractors are responsible for providing their own transportation to/from the project site. The Government will not furnish transportation. It is presumed that travel to and from the project site will be required; the Contractor is responsible for arranging all travel and billeting.

C.9 Contractor’s Key Personnel

C.9.1 The Contractor shall assign to this contract the following key personnel: Project Foreman. The Project Foreman shall possess all necessary licenses and insurance in conjunction with plumbing, construction, hauling, and disposal as required by Federal, State, and Local Codes and regulations. Said licenses and insurance should be current and in good standing.

C.9.2 The Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, termination of employment, or other extenuating circumstances. The Contractor shall notify the Contracting Officer within 1 calendar day after the occurrence of any of these events and provide the information as required by paragraph 8.3.

C.9.3 The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.

Proposed substitutes should have comparable qualifications and requisite licensing to those of the person being replaced. The Contracting Officer will notify the Contractor within 3 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

C.10 Security and Safety Requirements Contractor personnel allowed on site shall follow all check-in and security requirements as directed by the Contracting Officer, Contracting Officers Representative, the Douglas Ranger District office, and as listed below:

C.10.1 Personnel List: The Contractor shall supply the COR with a list of employees who shall be working on Esterbrook Work Center job site. The personnel list will be provided to the Douglas Ranger District office by the COR.

C.10.2 Visual Identification: While on Government property, Contractor personnel shall wear uniforms, clothing, or badges identifying said personnel as Contractor employees.

C.10.3 Access/Deliveries: Contractor shall notify the COR 48 hours in advance when deliveries of equipment and supplies are to occur. The Contractor shall receive his or its subcontractor’s own deliveries. Government personnel are not allowed to receive deliveries for any Contractor or subcontractor.

C.10.4 General Disruption: General disruption by Contractor is limited to the immediate work areas. Contractor products, tools, and equipment shall stay within the immediate work areas.

C.10.5 Tools and Equipment: The Contractor is responsible for the Contractor's equipment and materials supplied to the site. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools and other equipment shall be secured at the end of each working day. All construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the site.

C.10.6 Weapons: No weapons of any kind are allowed on site either in vehicles or on persons.

C.11 Electronic and Information Technology Standards The Government and Contractor shall comply with requirements which address access to information and communication technology (ICT) under Section 508 of the Rehabilitation Act and Section 255 of the Communications Act.
