Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID – 36C262-21-AP-2317

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office -22 on behalf of the VA San Diego Healthcare System. Transaction #664-21-2-5961-0006

2. Nature and/or Description of the Action Being Processed: The University of California - San Diego (UCSD) is awarded a contract to provide parking passes for 440 vehicles to park on UCSD owned property immediately in front of the VA San Diego Medical Center, located at 3350 La Jolla Village Drive, San Diego, CA 92161. This contract was issued per FAR part 13.5.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The Contractor shall provide VASDHS 440 dedicated parking passes. The passes are needed to mitigate parking congestion during ongoing construction. The passes will be utilized by Veterans, employees and other visitors to the VASDHS main hospital..

4. Statutory Authority Permitting Other than Full and Open Competition:

(x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority): .

UCSD owns the property directly in front of the VA San Diego medical center where these parking passes will be utilized.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

This contract was issued to UCSD because they own the property directly in front of the VA San Diego medical center. An intent to sole source, 36C26221Q0448 was posted to www.beta.sam.gov on March 9, 2021 and there were no interested parties who responded that they could also provide parking spaces in the same proximity.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The price for this contract is $689,040.00. Dedicated parking passes sold by UCSD to its faculty, staff and students are priced at $200 per month. UCSD’s offered pricing for this contract is $174 per parking pass ($174 per month x 440 vehicles x 9 months) or $689,040.00. The montly price represents a 13% reduction in price from the pricing offered to its own students, faculty and staff and is therefore assessed as reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research conducted included the posting of the notice of intent to sole source and a market survey of the costs associated with dedicated parking passes available at UCSD.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: |

There were no objections to the notice of intent to sole source.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

Once the construction on site is completed, there should be sufficient parking available for VA Staff and Visitors to the VASDHS Medical Center or VASDHS will plan to purchase this property from

UCSD.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
