DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5

1. Contracting Activity: Department of Veterans Affairs, VISN 08, 673 James A Haley Veterans’ Hospital (JAHVH), Acute Care, 1300 Bruce B. Downs Blvd. Tampa, FL 33612. (673-23-3-084-0321)
2. Nature and/or Description of the Action Being Processed: This is a Firm Fixed Price (FFP) request for Other Than Full and Open Competition for brand name only procurement of Hill- Rom smart beds manufactured by Hill-Rom, a large business. FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for patient beds manufactured by Hill-Rom in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified AcquisitionProcedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Brand Name Hill -Rom, Centrella Smart Bed, Progressa ICU Bed and Compella Bariatic Bed. This is to procure specialty beds to remotely monitor and track patient’s body temperature, heartbeat, blood, oxygen, and blood pressure. The system transfers all patients signals to the supervisor and caregiver. The delivery date is September 15, 2023 The estimated total value of this procurement is (redacted)
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Currently Acute Care Services (medical-surgical, critical care, and bariatric patients) are using specialty hospital beds manufactured by Hill-Rom, a large Business. During the last Joint Commission Survey conducted by Theresa M. Sullivan, Chief of Quality Management

Effective Date: 02/01/2022 Page 2 of 4 in August of 2022 there was a finding concerning rust on the beds being used in the MedSurg areas, and upon subsequent facility inspection, it was found that most of the beds had rust present in the framework. The requirement is to replace specialty beds that pose a risk to patients due to rust. The replacements must be the same make and brand for ICU and MedSurg to match the existing beds at JAHVH. The specialty patient beds from Hill-Rom are the only specialty beds that remotely monitor and track a patient’s body temperature, heartbeat, blood, oxygen, and blood pressure. The system transfers all patient signals to the supervisor and caregiver. Hill-Rom has two new technologies that enable the beds to provide sensing capabilities. The Watchcare Incontinence Management System elevates the patient experience and enhances patient safety through real-time incontinence alerts. Contact-Free Continuous Monitoring powered by EarlySense enables the Centrella Smart+ Bed, Compella Bariatric Bed, and Progressa ICU Bed System to accurately monitor a patient’s heart rate and respiratory rate in real-time without any leads or contacts simply by placing a patient in the bed. The technology allows healthcare providers to identify signs of patient deterioration, initiate early intervention, and promote patient safety. Both new technologies are proprietary to Hillrom bed platforms.
Other types of specialty beds such as Stryker, model Procuity, Invacare, model Heavy-Duty, Joerns model#RCUHLB850, and Umano model ook snow. Stryker Procuity, Invacare Heavy-Duty, ook snow, and Joerns do not have this new technology available on their hospital bed. Hill-Rom specialty beds are the only beds that could meet the government’s needs without the Veterans Health Administration experiencing substantial duplication of the cost that could not be expected to be recovered through competition and can cause an unduly delay in patient support.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Hill-Rom
GSA website was searched at www.gsa.gov located Hill-Rom beds under FSS 36F79721D0160. Hill- Rom hospital beds are available thru one source, Hill-Rom under GSA contract#V797P-4434B which expires on April 30,2026 under MAS schedule 6511A, category A-69.
Searched website utilizing Google search engine, located other types of hospital beds manufactured by Joers, Invacare, Medline and Stryker. Located other specialty beds such as Invacare Heavy-duty, Bariatric, full -electric bed with half-length bed rails. Joerns model#RCUHLB850, Expandable Fall Prevention Bed and Stryker. Attachment 1: Request for Sole Source Justification >SAT-$7.5M under FAR13.5 hand adjustable speed control. Per the customer the specialty beds manufactured by other firm will not satisfy the need to standardize the use of specialty beds manufactured by Hill-Rom.
FPDS was also searched and reveled that beds were purchased by James A Haley in November 2021 for the New Bed Tower.
Email correspondence sent to Hill-Rom sales rep, on the inquire if Hill-Rom has SDVOSB authorized distributors. Hill-Rom, responded and stated that there are SDVOSB’s authorized to resell Hill-Rom products, DiSorb Systems, Inc., SDVOSB and Janz Corporation, SDVOSB.
Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The Government will award a Firm-Fixed Price contract to the responsible quoter using a comparative evaluation. The comparative evaluation will be performed in accordance with FAR 13.106-2(b)(3). Once one quotation is found acceptable, it is compared to the remaining ones, and the “best” one is chosen for the best value to the government.
Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Sources used to conduct market research: Vendor Information Pages (VIP) Searched GSA eLibrary @www.gsa.gov. Searched Website utilizing Google engine search. Telephone calls to customer , searched FPDS website at https:// www.fpds.gov/fpdsng_cms/index.php/en Contacted Hill-Rom sales rep. The methods used were suitable to locate capable SDVOSB’s to support the need of JAHVAH.

The Contracting activity will continue to encourage brand name or equivalent specifications.
Contracting Office will continue to monitor the new specialtcy beds introduced in the marketplace in order to identify products that may meet the hospital’s specialized needs at a lower cost.
