2. Nature and/or Description of the Action Being Processed: This action is for Brand Name Only Justification and Approval. The washer disinfectors at the Little Rock facility have reached the end of its lifecycle and must be replaced.

FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1. The specific paragraph must be cited. Most likely, only the -1 or -2 authorities will be cited. Please be aware that failure to adequately plan for future requirements does not constitute appropriate use of the unusual and compelling urgency statutory authority.

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The John L. McClellan Memorial Veterans Hospital washer disinfectors are at end of life. This washer disinfector will be used to wash and disinfect all surgical instrumentation to include lumened, non-lumined, and flexible/rigid endoscopes. The system must integrate with the medical center’s existing instrument tracking system, ultrasonic washers, and cart washer. All equipment within the Sterile Processing Service (SPS) is Steris. Consistency in technology increases quality control and quality assurance program. The cart washer and ultrasonic washer have at least 10 years before they reach end of life. Therefore, to replace this equipment at this time would result in a duplication of cost of approximately $200,000.00.

In addition, SPS staff at both facilities use the same equipment. The SPS staff rotate between the facilities and they are trained on the use of the Steris washer disinfector. The purchase of the same brand equipment will allow continuity of care and mitigation of patient risk due to different standard operating procedures (SOPs) between washer disinfector equipment and user error. This allows for standardization, ease of use, and efficiency for staff and the facilities.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice for this requirement was published on FBO and responses received from two contractors. This effort will be synopsized in beta.SAM utilizing a combined synopsis/solicitation.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Contracting Office anticipates that the pricing will be fair and reasonable based upon a comparison of competitive offers that meet the name brand requirements.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: A search of VIP was conducted using NAICS 339113/keyword “washer disinfector”, this search yielded three (3) SDVOSBs. A sources sought was issued via Beta.Sam. Two (2) responses were received from SDVOSBs. In addition, searches of GSA, SBA Dynamic Small Business Search (DSBS), FPDS, and Google were conducted. These searches produced multiple manufacturers and contractors, however, it has been determined that only three contractors (Steris Corporation-large business, 1st American Medical Distributors, and AB Martin Inc.) are capable of providing Steris brand washer disinfectors.

Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed when the equipment has meet its life expectancy.
