LIMITED SOURCE JUSTIFICATION

Disclosure Database and Related Systems

1. AGENCY: Federal Election Commission (FEC)

2. CONTRACTING ACTIVITY: FEC PROCUREMENT OFFICE

3. DESCRIPTION OF ACTION: Award contract to support unique to the FEC mission, data and systems. This is a Follow on Order to contract FE-09-G-027 Beginning 2014 for one year, to allow the FEC to properly define the requirements in the Performance Work Statement (PWS) and compete the requirement.

The Proposed Contractor is Salient, formerly ATSC.

Name of Proposed Contractor: Salient 4000 Legato Rd.

Suite 600 Fairfax, VA 22033

The current contractor either inherited rudimentary versions of the Disclosure Systems or created them and has been supporting them for over eight years. No IT staff currently support these critical systems, although small inroads are being made in the area of the FEC Website.

Because the FEC data and mission are unique and the data and business rules are very complex and interdependent, only those with detailed institutional knowledge of the FEC systems as applied to the FEC mission would be able to support these systems with any timely and consistent performance without severe and unacceptable delays in delivery.

4. DESCRIPTION OF SUPPLIES/SERVICES: The estimated value for one year of this service contract is $1,500,000

One FTE (1920 hours per annum) Program Manager/Project Manager/Analyst/Coder with mastery of Disclosure applications, eReview modules, Data Entry, Data Integrity, FEC Website applications support, ADRO, OAR, Info Management and Searchable Applications.

Technical skills - Program Management, Project Management methodologies, Business Analysis, Requirements Analysis, Relational Databases, Database programming - SQL, PL/SQL, Informatica, Miscellaneous Software Engineering tools, TOAD, Microsoft Project.

Description of task - Communicates with government Program Manager and various stakeholders to assess and prioritize requirements, competing priorities and risk management, supervises a team of developers all cross-trained across all systems and technologies involved. Provides weekly and monthly status reports to government management. Directs and coordinates technical effort on all supported applications. Performs analysis, coding, testing, documentation support as needed using above described technologies.

One FTE (1920 per annum each) must have mastery of Federal Election Commission Public Disclosure data and systems, Data Entry, Data Integrity, FEC Website applications support, ADRO, OAR, Info Management, eReview modules and Searchable Applications.

Java environment: Java, J2EE, EJB, GWT, JDeveloper, Struts, Tiles, JavaScript, CSS, VC++, SQL, PL/SQL. They support all of the Disclosure Systems, Data Capture, Searchable Applications, eReview, OAR and Info Management.

Description of task - Works with contractor Program Manager to ensure all prioritized work is flowing smoothly through the queue. Should have experience developing fully functional Java applications accessing Oracle. Communicates with end users and technical staff to gather and clarify requirements Suggests process, data and application improvements. Codes and tests then work with users during User Acceptance Testing. Works with government technical staff on questions or knowledge transfer.

.NET/Java Programmer:

One FTE (1920 per annum each) must have mastery of Federal Election Commission Public Disclosure data and systems eReview modules, Data Entry, Data Integrity, Info Management.

Java and .Net environments, prefer staff who perform as both Java and .Net Senior Developer; C#, ASP.NET framework, Microsoft Visual Studio, Telerik grid controls, IIS services, J2EE, jQuery, HTML.

Description of task - Works with contractor Program Manager to ensure all prioritized work is flowing smoothly through the queue. Should have experience developing fully functional .NET and Java applications accessing Oracle. Communicates with end users and technical staff to gather and clarify requirements. Suggests process, data and application improvements. Codes and tests then work with users during User Acceptance Testing. Works with government technical staff on questions or knowledge transfer.

Java Web programmer:

One FTE (1920 per annum each) must have mastery of Federal Election Commission Public Disclosure data and systems, FEC Website applications support.

Java environment: Java, J2EE, EJB, Struts, AJAX, JavaScript - DOM and jQuery, CSS, Eclipse/JDeveloper, Tomcat, Apache, SVN, XML, DHTML, SQL/PLSQL

Description of task - Works with contractor Program Manager and FEC IT Manager to ensure all prioritized work is flowing smoothly through the queue. Communicates with end users and technical staff to clarify requirements. Maintains existing Java applications, develops enhancements and resolves issues. Suggests process, data and application improvements. Codes and tests then work with users during User Acceptance Testing. Works with government technical staff on questions or knowledge transfer.

One FTE Senior Analyst/Senior Database Developer/Crystal Reports Developer with strong knowledge of eReview who provides Project Management, Status Reports, meeting facilitation for eReview and coding and testing support to the Reports Analysis Division's modules for reviewing filings, RFAI approval workflow, RFAI circulation process involving OGC, Audit and ADRO, sending RFAIs to political committees/other entities and reports assisting their day-to-day activities. In-depth knowledge of FEC business processes and FEC data. Provide support for Information Management module and Disclosure applications as needed, analyze requirements, develop enhancements and coordinate UAT and production deployments. Business Analysis and Requirement gathering skills and knowledge of complex business logic. Knowledge of Disclosure data and processes, data integrity issues. Must be able to communicate well with users to gather requirements.

Technical Skills: Oracle 11g, SQL, PL/SQL, Crystal Reports XI, MS Office, Windows.

One 50% FTE Senior Analyst/Senior Database Developer/Java Programmer/Crystal Reports Developer who thoroughly understands end-to-end FEC business processes, FEC data, Disclosure Applications, eReview Reports, Law Manager Reports, Crystal Reports, Business Objects Administration, PL SQL, knowledge of FEC Website applications, Data analysis support for data related requests, Searchable applications and general IT miscellaneous projects as needed. Business Analysis and requirement gathering skills and knowledge of complex business logic.

Must be able to communicate well with users to gather requirements. Develop reliable applications, including design, development, testing and on-going support.

Technical Skills: Oracle 11g, SQL, PL/SQL, Crystal Reports XI, Java, J2EE, MS Office, Windows.

5. Authority:

ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.);

Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6.

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA would not have been previously issued under sole-source or limited sources procedures (FAR 8.405-6(a)(1)(i)(C));

6. REASON FOR AUTHORITY CITED:

a. Background: This contract has been competed twice before. The current contractor supported and enhanced systems that they inherited and developed many new systems that are critical to the unique FEC campaign finance requirements determined by Federal regulations and statutes, and new requirements from the Commission. This contractor has amassed a profound knowledge of the unique FEC election workflows, the FEC Disclosure Database with complex triggers and stored procedures, and all of the systems supported by the Disclosure Database.

This contractor worked with IT staff to perform a massive Data Integrity initiative that further demonstrated just how deeply the data relationships and procedures are interconnected and subject to corruption without that knowledge. The schedule includes frequent releases across all systems, often weekly, sometimes same day and many efforts on all at the same time. The nature of the work is that some tasks are several months, many are a few weeks, some are just hours and some are days. There are about 50 production releases per year.

b. Alternatives: Since being without these services is not a viable option for the FEC, and there is insufficient time to compete this requirement, there are no other alternatives to this one-year limited sources follow-on Contract.

c. Justification: Because the FEC is a one of a kind entity, there is nowhere else a contractor would acquire the knowledge of the Disclosure Database and the systems it supports. The only way to get this skill is from working at the FEC. Should the FEC attempt to use a different contractor, replacing the current contractor, the learning curve is estimated by the users based on work with past contractors to be nearly a year to begin to be of service. These systems must be operational and supported very often immediately. The FEC branches such as Public Disclosure, Data Entry, Reports Analysis Division, OGC, cannot comply with regulations for timely publishing of Committee and Candidate reports, Matters Under Review, Requests for Additional Information etc., without resources that thoroughly understand their requirements as the current contractor has demonstrated for about 10 years.

d. Prior Acquisitions: There have been other contractors in the past;

however, the FEC’s Contracting records are incomplete and do not contain these contract numbers.

e. Impact: Inability of the FEC to comply with Federal Regulations for nine months to a year while a new contractor begins to build the knowledge of the one of a kind FEC requirements and systems.

7. EFFORTS TO OBTAIN COMPETITION: The contract was competed twice before. During the one year period covered under this J&A, the FEC will edit the Performance Work Statement and competitively seek other potential sources for these services.

8. ACTIONS TO INCREASE COMPETITION: The FEC intends to edit the Performance Work Statement, providing more detailed non-proprietary information about the required services, to allow more contractors to compete.

9. MARKET RESEARCH: On June 16, 2014, the FEC issued a Sources Sought Notice (SSN) on FedBizOpps. 25 Contractors responded to the SSN; however, the technical evaluators determined that only five (5) Contractors, including the incumbent, had the capability to perform the services. Of the five (5) capable Contractors, only one, the incumbent, currently has the personnel qualified, and experienced, to fulfill the requirement. As this is a closed system, unique to this agency, the only source able to provide immediate support of this mission critical system would have to come from inside the FEC, already knowing the systems. As no one in the FEC supports these systems at present, this opportunity does not currently exist.

11. OTHER FACTS:

b. Acquisition data availability: See limited Contracting Office records.

c. Unique workflow processes: The data coming into the FEC must be processed and published to the FEC Website within 48 hours. Similarly, several branches have very short turn-around times in complying with Federal Regulations. Attempting to bring a new contractor on board with this short timeframe, would not suffice as the learning curve would take many months and then be only a drop in the bucket of the knowledge required to successfully meet all the deadlines required of various branches.

d. Subcontracting Competition: The contractor uses approximately 30% subcontractors.

13. MANAGEMENT REVIEW/APPROVAL: IAW FAR 8.405-6(d)(2), the requirement herein described is a valid requirement for the activity named in this Justification. The technical and requirements information contained in this Justification represent the minimum needs of the Government. The only way to satisfy this requirement is by limiting the competition as described herein.

14. FAIR AND REASONABLE COST DETERMINATION: I hereby determine that the anticipated price for this contract action will be fair and reasonable. The techniques identified at the following FAR sections will be used to ensure award will be fair and reasonable: FAR 15.404-1(b)(II); (v); and (VII). Certified Cost and Pricing data will not be obtained. Additionally, I have determined that this order represents the best value consistent with FAR 8.404(d).
