Limited-Sources Justification (LSJ) For orders or BPAs exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the GSA Schedule 70 Program, 41 U.S.C.
152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Information Technology Acquisition Center (ITAC) proposes to award an order pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved.
DHS/OPO intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(a) for the procurement of services to provide Homeland Security Enterprise Network (HSEN) Program Management Office (PMO) support to proposed Contractor: Global Tech Inc., 1900 Gallows Rd #800, Vienna, VA 22182.
3. Description of Supplies/Services.
The DHS HQ HSEN Program Office provides technical and management support to the HSEN to enable information sharing between DHS Components, Trade Partners, and other government agencies (OGAs) to include shared internet, intranet, and extranet services. The HSEN Program is managed within the DHS Headquarters Office of the Chief Information Officer (OCIO), Information Technology Operations (ITO) Enterprise Operations Division (EOD) organization and includes functional areas for: (1) Program Management, (2) Enterprise Architecture, (3) Enterprise Engineering, (4) Engineering Operations, and (5) Enterprise Operations Center (EOC) and Network Operations Center
(NOC).
ITO/EOD has an immediate mission need to acquire continued program management support services in an uninterrupted manner, pending the award of the acquisition of support services for the HSEN functional areas identified above. Currently the required program management support services are being provided by Global Tech Inc.
The DHS HQ HSEN Program Office supports the entire HSEN Program (Architecture, Engineering, Engineering Operations, EOC, and Program Management) and consists of NOC analysts, Engineering and Architecture analysts, and Program Management analysts which enables connectivity and information sharing among DHS Headquarters, Components, and mission operations. Any lapse in contractual coverage for the HSEN Program Management support services could result in a serious loss of support for the HSEN operation, which is critical to the DHS mission.
The HSEN Program Office is responsible to ensure the DHS Information System Network is complying and operating within the FISMA, security, and Government regulations of an http://uscode.house.gov/
LSJ No.: FY22-037 Page - 2 - of 5 information system, without this support, the Department of Homeland Security would be unable to operate its Information System Network and would not meet mandated federal policies. Global Tech Inc. is required for continuation of IT program and/or project management services to include project integration planning, scope planning and management, resource analysis planning and management, schedule development management and analysis, risk planning analysis and management, project cost estimation, quality planning and management, and project performance planning. Additionally, the Contractor is required to support project control monitoring and closeout services.
The period of performance shall be one (1) three (3) Month base period with two (2) one month option -period for a total value of $1,687,581.50.
The period of performance is:
Base (3-months) 2/10/2022 to 5/31/2022 Option 1 6/01/2022 to 6/30/2022 Option 2 7/01/2022 to 7/31/2022
4. Authority and supporting rationale.
8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
Rationale:
The services being provided by Global Tech Inc. are mission critical, and only the incumbent can properly provide for continuity of services at a sufficient level to meet mission requirements for IT Program and for Project Management Services. The Contractor provides IT program and/or project management services to include project integration planning, scope planning and management, resource analysis planning and management, schedule development management and analysis, risk planning analysis and management, project cost estimation, quality planning and management, and project performance planning.
Additionally, the Contractor is required to support project control monitoring and closeout services Any lapse in contract coverage for the HSEN Program and Project Management Services could result in a serious loss of support for the HSEN operation which is critical to the DHS mission.

Currently, the required Program Management Services are being provided by Global Tech Inc. via the General Services Administration (GSA) Multiple Award Schedule (MAS) contract GS-10F0376U, Task Order, 70RTAC20FR0000115. Task Order 70RTAC20FR0000115 was issued as an interim task order. The period of performance consisted of a base period of six (6) months, with two 3-month option periods, starting August 10, 2020 and ending August 9, 2021. It also included the FAR 52.217-8 Extension of Services clause which allowed an additional 6-months of performance. The current task order end date is February 9, 2022. Task Order 70RTAC20FR0000115 was issued with the full intention of having adequate periods of performance to allow award for a competitively awarded contract.
The Government is currently in the process of soliciting a new competitive procurement;
however, it is projected to be awarded in May 2022. In the interim, the Government requires continuation of the services until completion of the new competitive acquisition and to allow for sufficient transition time for a successor contractor. A new interim task order for ongoing services is required for a three (3) month base period with two (2) one-month option periods.
The services provided by Global Tech Inc. are mission critical, and only the incumbent can properly provide for continuity of services at a sufficient level to meet mission requirements for program management support. If a new task order was competed and awarded, the awardee may require 30-60 days for transitioning-in, to include onboarding and training of staff to establish the necessary skills for this requirement. Additionally, there would be a learning curve with the new contractor during which service degradation would impede mission critical operations.
The potential cost of disruption of services may result in substantial financial loss to the agency as any delay in performance may have a direct negative impact to the operations and functionality in support of an agency’s mission. The potential dollar impact that would be caused by disrupting operations and starting up with another contractor is difficult to estimate. It is not a price impact, but a mission impact. Global Tech Inc. provides critical project management support including project control monitoring for DHS consisting of tracking the intake of service requests (SRs) from all DHS Components for network changes and enhancements. Without this critical support, continuity of operations would be affected.
DHS Headquarters (HQ) would not be able to accommodate the numerous SRs of approximately 100 per month, which when implemented, provide mission critical network enhancements for the DHS Components to meet the individual mission needs for Customs and Border Protection (CBP), Immigration and Customs Enforcement (ICE), Federal Emergency Management Agency (FEMA), Transportation Security Administration (TSA), United States Citizenship and Immigration Services (USCIS), United States Secret Service (USSS), United States Coast Guard (USCG), and HQ sub-components.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to Global Tech Inc. for the HSEN program management services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the

Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the task order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted to determine which contract vehicles can appropriately meet the Program Management requirement. The following vehicles were reviewed: DHS Enterprise Acquisition Gateway for Leading-Edge Solutions Next Gen (EAGLE NextGen), GSA Federal Supply Schedules, Government-wide Acquisition Contracts (GWACs), and other contract vehicles. The GSA Multiple Award Schedule (MAS) was determined to best meet the requirement. Market research revealed that the incumbent, Global Tech Inc. is among the awardees on the MAS. Market research of the MAS awardee capabilities indicated that, while a number appeared capable of providing the required program management services, only the incumbent, Global Tech Inc., who is currently providing the services has the corporate knowledge and understanding of the DHS HQ HSEN Program to efficiently deliver the highly specialized program management services within the required timeframe and provide continued support with no break in service until the new competitive action is awarded.
7. Any other facts supporting the limited-sources justification.
None
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited sources) before any subsequent acquisition for the supplies or services is made.
The Government is currently in the process of awarding a new competitive contract action for Program Management Services for the DHS HQ HSEN Program Office.
9. DHS intends to post this requirement on SAM.GOV pursuant to FAR 8.405-6(a)(2)(i).
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
