INVITATION TO BIDDERS

NOTICE IS HEREBY GIVEN, pursuant to Section 103, Article 5A of the General Municipal Law that sealed bids are sought by the City of Oneonta for

Sealed bids will be received by the Purchasing Agent, John Janitz, at his office at City Hall, 258 Main Street, Oneonta, New York until 2:00 p.m., May 22, 2025 at which time bids will be publicly opened and read.

Specifications may be requested from the Purchasing Department during regular office hours and will be emailed to bidders on request, and are available on the Internet at www.govbids.com under the link for the “Empire State Purchasing Group”.

The City of Oneonta encourages the submission of bids by companies that are certified as Minority– owned, Women-owned and Disadvantaged Business Enterprises.

SPECIFICATIONS

A. Bidder to furnish and deliver items described in the BID ITEMS DESCRIPTION and for the quantities required. All of the supplied equipment shall conform to the specifications and Exhibits as described herein.

B. The required equipment shall be manufactured by Clow Valve Company or approved equal. Fire Hydrant shall be manufactured in accordance with AWWA Standard C502, be listed by Underwriters Laboratories, Inc. And have Factory Mutual Research approval.

C. Fire Hydrant shall be designed for 250 psi working pressure and tested to 500 psi Hydrostatic pressure.

D. Fire Hydrant shall be a “Traffic Model”, complete with safety flanges and steel stem coupling.

Nozzle section must rotate 360 degrees.

OPERATION & MAINTENANCE

Operation and Maintenance Manuals must be supplied for all items described herein by the successful bidder prior to delivery.

WARRANTY

A Warranty must be supplied for all items described herein by the successful bidder prior to delivery.

BID ITEM DESCRIPTIONS

ITEM NO. 1 FIRE HYDRANT:

Four (4) Fire hydrants shall be Clow Medallion; 5 ¼” Fire Hydrant, i-Hydrant Model Dry-Barrel or approved equal as shown in Exhibit A, furnished with optional upper stem jam nut installed. Inlet shall be 6” mechanical joint. 5-6” bury depth.

One 4 ½” pumper connection & two 2 ½” hose connections with all threads conforming to National Standard APPA No. 194. Open left. Include one 5” Storz connection. Furnish with factory applied “Super Coat” finish (red). Made in America. Provide 10-year limited warranty. Quote price per units delivered, F.O.B.

Oneonta, New York. The use of Common Carriers for the delivery of the product, is not acceptable.

ITEM NO. 2 RETROFIT KIT:

Three (3) i-Hydrant Retrofit Kit for Clow Medallion Fire Hydrant: As shown in Exhibit B or similar. Quote price per units delivered, F.O.B. Oneonta, New York.

The use of Common Carriers for the delivery of the product, is not acceptable.

INSTRUCTIONS TO BIDDERS

For all items, bidder must supply a firm price for the ensuing year, from date award becomes effective until award for subsequent year.

It is required that bidder submit complete ORDER LOCATION with bid to assist the City of Oneonta when it is ready to place orders. The City of Oneonta will assume no responsibility or penalties for ordering from an incorrect location if bidder does not submit the required information.

The City of Oneonta reserves the right to order more or less than the approximated quantities at the price bid. Material received by the City which is considered to be of poor workmanship, consists of unsound material or which does not meet specifications, may be cause for the City to reject and return same without recourse or charge to the City.

All paper work, such as Bills of Lading, SDS sheets, etc. required for shipping of any of these items must be completely and accurately filled out by vendors and given to shipping agency.

Paperwork must be accurate in order for the City of Oneonta to receive materials.

Delivery dates and availability of all items to be stated.

The City of Oneonta reserves the right to allow all municipal and not-for–profit organizations authorized under the General Municipal Law of the State of New York to purchase any goods and/or services awarded as a result of this bid in accordance with the latest amendments to NYS GML 100 through 104. However, it is understood that the extension of such contracts are at the discretion of the vendor and the vendor is only bound to any contract between the Entities and the vendor.

The City of Oneonta reserves the right to reject any and all bids.

In the event of a tie bid, the winning bid will be determined by a coin toss, as stated in the City of Oneonta’s Purchasing Policy.

All bids must be made upon the forms provided, complete with the specifications attached and contained in a sealed envelope addressed to the Purchasing Agent and be clearly marked, “2025 i-Hydrant Bid.” All bids must be received by 2:00 p.m., on May 22, 2025

Bidders are advised not to rely on next day mail services. Faxed or Emailed Bids will not be accepted.

The bid price submitted shall be exclusive of all federal, state and county tax and shall be the delivered price to the City of Oneonta. All quantities are estimated and items will be ordered as needed.

The non-collusive bidding certifications and the certification of compliance with the Iran Divestment Act, attached herewith, must be signed and submitted with the bid.

NON COLLUSION BIDDING CERTIFICATION

(Required by Section 103-d of the New York State General Municipal Law)

103-d. Statement of non-collusion in bids and proposals to political subdivisions of the State or fire district.

1. Every bid or proposal hereafter made to a political subdivision of the state or any public department, agency or official thereof where competitive bidding is required by statute, rule, regulation or local law, for work or services performed or to be performed or goods sold or to be sold, shall contain the following statement subscribed by the bidder and affirmed by such bidder as true under the penalties of perjury: Non-collusive bidding certification.

a) By submission of this bid, each bidder and each person signing on behalf of any bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of perjury, that to the best of its knowledge and belief;

CERTIFICATION OF COMPLIANCE WITH THE IRAN DIVESTMENT ACT

As a result of the Iran Divestment Act of 2012 (the “Act”), Chapter 1 of the 2012 Laws of New York, a new provision has been added to State Finance Law (SFL) § 165-a and New York General Municipal Law § 103-g, both effective April 12, 2012. Under the Act, the Commissioner of the Office of General Services (OGS) will be developing a list of “persons” who are engaged in “investment activities in Iran” (both are defined terms in the law) (the “Prohibited Entities List"). Pursuant to SFL § 165-a(3)(b), the initial list is expected to be issued no later than 120 days after the Act’s effective date at which time it will be posted on the OGS website.

By submitting a bid in response to this solicitation or by assuming the responsibility of a Contract awarded hereunder, each Bidder/Contractor, any person signing on behalf of any Bidder/Contractor and any assignee or subcontractor and, in the case of a joint bid, each party thereto, certifies, under penalty of perjury, that once the Prohibited Entities List is posted on the OGS website, that to the best of its knowledge and belief, that each Bidder/Contractor and any subcontractor or assignee is not identified on the Prohibited Entities List created pursuant to SFL § 165-a(3)(b).

Additionally, Bidder/Contractor is advised that once the Prohibited Entities List is posted on the OGS Website, any Bidder/Contractor seeking to renew or extend a Contract or assume the responsibility of a Contract awarded in response to this solicitation must certify at the time the Contract is renewed, extended or assigned that it is not included on the Prohibited Entities List.

During the term of the Contract, should the City of Oneonta receive information that a Bidder/Contractor is in violation of the above-referenced certification, the City of Oneonta will offer the person or entity an opportunity to respond. If the person or entity fails to demonstrate that he/she/it has ceased engagement in the investment which is in violation of the Act within 90 days after the determination of such violation, then the City of Oneonta shall take such action as may be appropriate including, but not limited to, imposing sanctions, seeking compliance, recovering damages or declaring the Bidder/Contractor in default.

The City of Oneonta reserves the right to reject any bid or request for assignment for a Bidder/Contractor that appears on the Prohibited Entities List prior to the award of a contract and to pursue a responsibility review with respect to any Bidder/Contractor that is awarded a contract and subsequently appears on the Prohibited Entities List.
