4. Authority:

FAR Part 13.106(b)(1)(i) - Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

5. Applicability of Authority:

This justification and approval is for the purchase of Global Imaging Server Equipment for

NOAA. The use of this brand name product is essential to the Government’s requirements, for

Office of Satellite Products and Operations’ (OSPO) infrastructure connectivity requirements, thereby precluding consideration of the products of another company.

The current situation requires brand name hardware and software as Global Imaging as it is currently in use at NOAA and has been a brand that is currently certified to run in the agency’s network that can provide the level of security needed for the system to be fully accredited.

National Environmental Satellite, Data, and Information Service (NESDIS) is the agency responsible for the operation of the NOAA geostationary and polar orbiting meteorological satellites. The OSPO provides a wide array of operational products and operates various computer and communications systems on a 24-hour, seven days a week schedule. The Global

Imaging Servers are manufactured, installed and supports turnkey earth stations to receive, process and disseminate real-time data and imagery from earth-orbiting spacecraft. Complete systems including antennas, receivers, and processing chains are available for geostationary and polar orbiting server platforms. The support is necessary to support the processes of the Suitland

Program Office.

6. Contracting Officer Determination – Fair and Reasonable Cost:

The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Actions anticipated to ensure the reasonableness of the price will be accomplished with the procedures and criteria contained in FAR Subpart 15.404, as appropriate. In addition, the Contracting Officer will use various price and cost analysis techniques and procedures to ensure a fair and reasonable price including comparison of competitive published price lists, comparison of the proposed prices with the independent

Government cost estimate, and unit pricing under Federal Supply schedule which have been determined fair and reasonable.

7. Market Research:

Market research was conducted in accordance with FAR Part 10. In accordance with FAR 8.002 and 8.003 there are no mandatory sources of supply for the requested items under this requirement. Therefore in accordance with FAR Subpart 8.004 Use of Other Sources, the use of

GSA Federal Supply Schedules was given first consideration as an acquisition vehicle to satisfy this requirement. A review of GSA Advantage and NITCP BPA’s determined that the requested

Global Imaging Servers Hardware and Software is not under any of the GSA schedules, nor under any of the NITCP BPAs. No further consideration was given to these vehicles.

The next option was to conduct market research through Open Market in accordance with FAR

Part 10. Based on market research, it was determined that this product could be purchase via open market from only one source, Global Imaging. Global Imaging is the manufacturer of the

Global Imaging Servers Hardware and Software and the only vendor authorized to provide maintenance support. Therefore, this procurement will be an open market sole source procurement issued only to Global Imaging for quote.

Global Imaging is the software designer and owns all of the intellectual property rights for the

Servers. Vendor, Global Imaging, does not sell specialized software renewals through resellers or distributors – they sell directly to their customers so they are the only source for the products.

Vendor has provided justification letter for procurement file. The requirement shall be conducted under the FAR 13.106(b)(1)(i) as a sole source purchase to Global Imaging Inc.

8. Statement of Actions to Overcome Barriers to Competition:

In an effort to remove or overcome barriers to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the Government’s requirements. The NOAA staff meets regularly with equipment manufacturers and vendors and attends manufacturer and industry training to keep current on technology. Vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. As an integration lab, the agency will continually revisit the brand name equipment currently being used and will research for the manufacturers and products that will be in the Government’s best interest as best value for future replacement equipment at the agency’s site and at sites the agency supports. Since there is a continual revisit to the brand names currently being used by the agency for the present equipment, if/when alternatives to the requested equipment become available, they will be reviewed for approval to use.

9. Requiring Agency Certification:

I certify that the supporting data under my cognizance which form the basis for this justification are accurate and complete to the best of my knowledge and belief.

Sam Patterson Date

NOAA NESDIS

10. Contracting Officer Certification:

The undersigned has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Further, I certify that this justification is accurate and complete to the best of my knowledge and belief.

Paula Mensah Date
