2. Description of Action:

This justification and approval is being requested to procure all necessary labor, material, services and travel to maintain continuity of mission critical services necessary to support operations of USCENTCOM CCJ8. The services, materials and travel will be procured on a Time and Materials basis.

This action represents an interim bridge contract to continue follow-on services to the incumbent contractor after expiration of Contract Number N00178-04-D-FG17 on May 30, 2017, however due to the current burn rate, the funding ceiling will be reached by May 24, 2017. Booz Allen Hamilton is the incumbent contractor providing all contractor personnel, supervision and other items and services necessary to support the required efforts for Technical Support for Operations Research (OR), Decision Analysis, and Analytic Studies; Joint Operations Planning and Assessments; Modeling, Simulation and Campaign Analysis; Database Programming and Data Analysis; and Wargaming.

This contract is currently being re-competed and GSA Region 4 FAS/AASD requires additional time to complete the competitive acquisition by the estimated award date of September 24, 2017.

During the re-compete process there was an internal investigation into whether an Organizational

Conflict of Interest (OCI) arose. This investigation, as discussed in Section 5 below, delayed the re-compete process.

The period of performance for the bridge contract will provide services from May 24, 2017 to

September 23, 2017.

3. Description of Supplies or Services:

The contractor shall provide on-site technical expertise and capability for Assessments, Operations Research and Systems Analysis (ORSA) enabling senior leaders to make well-informed decisions for matters regarding strategy, planning, resourcing, and contingency operations in the USCENTCOM AOR. Decisions are typically related to making, or advocating for, adjustments to plans, policy, resources and authorities. The contractor shall provide

Modeling and Simulation (M&S), Operation Assessment, Campaign Assessment, Joint

Operations Planning, Wargaming, and use of analytic techniques in both traditional and innovative ways.

4. Authority:

The Federal Acquisition Regulation (FAR) Subpart 6.302-2 under the authority of 10 U.S.C.

2301(c) (2) — Unusual and Compelling Urgency.

5. Applicability of Authority:

Services are presently being performed under a contract issued by the Naval Special Warfare

Center (NSWC) on 05/30/2014 with a twelve-month base period of performance, two (2) twelve

(12) month option years ending 05/30/2017, utilizing the competitive open market process, a

Cost Plus Fixed Fee contract was awarded to Booz Allen Hamilton. Due to the current burn rate, the funding ceiling will be reached by 05/24/2017, one week earlier than originally anticipated.

A new competitively awarded task order is being worked with the Request for Quote expected to be released by the end of May 2017. This competitive task order was originally expected to be

be released by the end of May 2017. This competitive task order was originally expected to be awarded by May 24, 2017; however, during the market research phase of the competitive follow-on, a potential Organizational Conflict of Interest (OCI) investigation arose and subsequently delayed the progress of the acquisition team. An overview of the potential OCI investigation and the subsequent delay is provided below.

In preparing for the competitive follow-on, the Government released RFI number RFQ1154020 on November 08, 2016. On March 22, 2017, a potential OCI arose related to improper disclosure of the "capability statements” of three of interested vendors that responded to the RFI.

The GSA contracting team, including the contracting officer, and the client, assessed the situation to determine if an actual or potential OCI was created by the disclosure. Additionally, the affected vendors were given the opportunity to comment on the disclosure. Ultimately, the contracting officer determined on April 26, 2017, that at the present time, given that the incident arose in the Pre-RFQ stage of the acquisition, no actual or potential OCI occurred. The OCI investigation resulted in approximately a one-month delay, in which no progress could be made with the competitive follow-on. The resolution of the OCI investigation found that the disclosure is deemed to have not created or cause an unfair competitive advantage for any involved parties.

The Government has determined that no remedial steps or are actions necessary, but reserves the right to institute remedial actions if they should become warranted in the future. Currently the competitive follow-on task order is being reviewed through GSA internal acquisition approval process and the RFQ is expected to be released by the end of May 2017.

A review of the requirement and acquisition planning conducted by a GSA Senior Contract Officer concluded there was an insufficient amount of Procurement Acquisition Lead Time (PALT) (<44 calendar days) to appropriately award a competitive and FAR compliant open market contract. As a result, a four (4) month non-competitive bridge contract is necessary to provide continued mission critical contractor support to the USCENTCOM CCJ8 requirement.

The additional four (4) months will provide the Government adequate time to conduct proper acquisition planning, solicit, compete, and award a new contract. Due to the nature of the services being acquired, the Government cannot experience a break in coverage without severely impacting the USCENTCOM CCJ8 mission and combat operations. It is extremely important that the incumbent contractor, Booz Allen Hamilton, remain in place during this bridge contract period as the support provided by this requirement is critical to the continued operations of

USCENTCOM CCJ8.

6. Efforts to Obtain Competition:

In accordance with FAR 5.201(b) (1) the solicitation will be published in FEDBIZOPPS.

However, due to the current contract (N00178-04- D-4024 FG17) reaching its ceiling prematurely and ending sooner than expected, this bridge contract is required to be in place by 24 May 2017 to avoid a lapse in coverage. The Government would be seriously injured if it complied with the 15 day time requirement of FAR 5.203(a) for synopsis of the proposed contract action; therefore, in considering the circumstances of the instant acquisition the Contracting Officer has determined to

establish a shorter response time in accordance with FAR 5.203(b). Additionally, in accordance with FAR 6.305(b) this J&A will be posted to FEDBIZOPPS within thirty (30) days from contract award.

A Request for Information (RFI) notice was posted to FEDBIZOPPS to find if there were any other vendors that could perform the four month bridge with short notice to start at the end of the current contract. No responses were received from any other vendors by the closing time of the RFI. Therefore this bridge will be awarded sole-source to Booz Allen Hamilton (as the incumbent). As noted above, however, the long term follow-on task order GSA is currently working will be competitively solicited against the GSA One Acquisition Solution for Integrated Services (OASIS) contract. The competitive award will be made to the awardee that represents the best value to the Government as detailed in the solicitation.

7. Contracting Officer Determination – Fair and Reasonable Cost:

The Government developed an Independent Government Cost Estimate (IGCE) based on available historical cost data from the ongoing contract. Therefore, the IGCE is based on the current level of support (labor categories, hours, and rates) for a period of four (4) months. As a result, the GSA Senior Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable consistent with FAR 15.404-1(b) (2) (ii).

8. Market Research:

Market research revealed that there are no known sources besides Booz Allen Hamilton can provide the required services without unacceptable delays or performance risk. The Government has determined that, as the incumbent, only Booz Allen Hamilton has the ability to provide the qualified and cleared personnel necessary to continue operations without disruption by May 24, 2017.

A RFI was posted to FedBizOpps on 09 May 2017 seeking interested contractors who could meet the PWS requirements without requiring a transition period. The RFI closed on 17 May 2017 with no positive responses received. Accordingly, as the research reflects that a new contractor cannot perform the work without a transition period, the Government has elected to issue a sole source bridge to the incumbent contractor. is the Government has determined that currently the incumbent is the only vendor capable of performing during this extension period without significant impact to the Government’s mission through unacceptable delays in bringing a new contractor up to a fully operational performance level.

9. Other Supporting Facts:

The GSA Senior Contracting Officer has determined that the need to execute this J&A and subject bridge contract did not result from a lack of advanced planning by the requiring agency.
