1. Identification of the Requiring Activity and Contracting Activity:

The requiring activity is the United States European Command (USEUCOM). The contracting activity is the General

Services Administration (GSA) Federal Acquisition Service (FAS), Mid-Atlantic Region - Philadelphia, PA.

This document is hereby identified as a Justification (LSJ) for an Exception to Fair Opportunity.

2. Nature and/or Description of Action Being Approved:

USEUCOM requires a Construction Security Services solution in accordance with (IAW) the Intelligence Community

Directive (ICD) and DoD policies. These services will be required on Patch Barracks located in Stuttgart, Germany at

USEUCOM existing operational sites.

The Government awarded the current 12-month Base period plus three 12-month option periods task order in the amount of in accordance with FAR 16.505(b)(1)(iii)(B) Fair Opportunity via the GSA OASIS Unrestricted

Pool 1 contract on 04 June 2019 with a period of performance from 11 June 2019 through 10 June 2023.

The action being requested is to increase the task order scope to include construction security services for the EUCOM

Building # 2302 at Patch Barracks for the remainder of Option Period 1 and for Option Period 2, as it conducts renovation activities.

3. Description of Supplies/Services Required To Meet the Agency's Needs:

The contractor shall provide a Construction Surveillance Technician (CST) Team Lead and team of CSTs with subject matter expertise on construction surveillance, technical surveillance, Temporary Electronic Security System (TESS) design, installation and operation to USEUCOM in order to successfully protect the integrity of the facilities throughout their renovation. The purpose of a CST is to detect and deter the implementation of clandestine monitoring devices into

US Government facilities that house and/or process classified materials/discussions.

In support of the USEUCOM Construction Program, the Contractor shall provide non-personal services of a Site Security

Personnel (SSP) team composed of Construction Surveillance Technicians (CST) in order to successfully protect the integrity of the facilities throughout their renovation. The SSP Team functions as an extension of EUCOM’s Special

GSA, FAS Mid-Atlantic Region

This document is prepared in accordance with FAR 16.505(b)(2)(ii)(B)

Source Selection Information - See FAR 2.101 and 3.104 which spans the awarded OY1 and OY2.

4. Identification of the Exception to Fair Opportunity and the Supporting Rationale:

In accordance with FAR 16.505(b)(2)(i)(C) the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original.

This task order was awarded as a competitive task order through the GSA OASIS contract following market research across GSA Schedule 84 and GSA OASIS. Date of issuance of the solicitation occurred on 22-February-2019 with pre-proposal conference held on 06-March-2019. There were no attendees. The solicitation was closed on 27-March-2019 with two no-bids and one bid. Since only one proposal was received, a trade-off was not performed in order to determine the award decision to PAE Government Services, Inc. (PAE). Since award, PAE has performed the services required to the Government’s satisfaction.

Since this task order was awarded, renovation plans accelerated in an adjacent building (Bldg 2302) on the EUCOM campus which will require increased security and surveillance support in parallel to the initial building’s (Bldg 2301) renovation. EUCOM has an immediate need for five additional Contract Surveillance Technicians to provide the same security support services for up to 12 months during this renovation with a start date of mid-May 2021.

GSA is determining that conducting a new acquisition for this type of effort that is estimated at under for up to 12 months of performance will yield only one bidder, the current incumbent, PAE Government Services, Inc. The original acquisition was for a term of four years (Base + 3 option years) with a value of but only resulted in one offer. It is therefore highly likely that conducting a new acquisition for 1/4th of the period of performance at an even lesser fraction of value would not be in the interest of economy and efficiency because it likely would not yield any additional offerors.

Additionally, the logistics of ramping up a new award during a pandemic with complex travel restrictions and limitations as well as US/Germany SOFA agreements would cause undue delay and added cost to the effort. Awarding to the incumbent contractor would therefore represent the best interests in costs and time.

5. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:

In order to determine whether the contractor’s proposed cost is fair and reasonable, the Contract Specialist and

Contracting Officer will review the proposed cost against various price analysis techniques IAW FAR 15.4040-1(b)(2). It is anticipated that the rates proposed for this effort will reflect either a close similarity or the same rates as currently being paid to PAE under the existing CSSS task order. If the contractor’s proposed price appears to be questionable for reasonableness, a justification from the contractor will be required in order to determine whether the proposed price is fair and reasonable. The Contracting Officer will determine the cost to be fair and reasonable before award.

6. Other Facts Supporting the Justification:

None.

7. Actions the Agency May Take to Remove or Overcome Any Barriers that Led to the Exception to Fair Opportunity

Before Subsequent Acquisition For the Supplies or Services:

The work for this effort is ending upon completion of the additional twelve (12) month performance period to coincide with the completion of building renovations.
