For All Actions At or Below the Simplified Acquisition Threshold Use for FAR Part 8, FAR Subpart 13.1, or FAR Part 16, Including Brand Name

Christian Copyright Licensing International, LLC is the only vendor which can satisfy the needs of IMCOM Religious Support Office.

c. Justification: This is a very unique requirement based on Federal Copyright Law. Under federal copyright law, religious organizations are exempt from copyright restrictions for music when a song or selection is played or rendered during worship services at a house of worship.

This exemption is known as Religious Service Exemption (Section 110[3]) of the federal code.

The exemption reads:“…performance of a non-dramatic literary or musical work of a dramatic or musical work of a religious nature or display of a work, in the course of services at a place of worship or other religious assembly shall not constitute infringement of copyright.”

Although this exemption exists, it does not offer protections for the reproduction of lyrics, public display of lyrics (such as projecting them on a screen or reproducing them in a church bulletin for the congregation to follow). Therefore, the Government requires licenses for these and the other actions listed in the agency’s requirements. CCLI acts a clearinghouse or distributor for large Christian music production companies. It sells the necessary licenses and subscriptions for major production companies

d. Impact: if the justification is not approve, it will impact IMCOM Religious Support Office service. The Religious Support Office seeks to standardize musical delivery capabilities for worship services throughout CONUS and OCONUS. Failure to approve a sole source award to Christian Copyright Licensing International, LLC will be detrimental to IMCOM Religious Support Office.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at 5.202 . (Fill in exception).
