JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Undersea Warfare Center
Division, Code 02, Newport, RI.
2. Description of the Action Being Approved
Award of a basic ordering agreement on a sole source basis with options for material in support of the High Frequency
Sail Array (HFSA) Sensors Program to PAVE Technology Company.
3. Description of Supplies/Services
The Naval Undersea Warfare Center Division Newport, Code
1535, requires electrical feedthrough (seal) connectors as part of the DT-100 HFSA Module.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open
Competition
In accordance with 41 U.S.C. 1901, as implemented in Federal
Acquisition Regulation (FAR) 13.501(a)(1)(ii): Only one responsible source and no other type of supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The Government’s platform design team selected PAVE Fiber
Optic and Electrical Feedthrough connectors for their unique pressure rated bi-directional capability. No other manufacturer has the expertise to make this part without investing in significant non-recurring engineering costs.
If a vendor other than the proposed is able to manufacture the feedthroughs a full qualification of the design and DT-
100 Module would be necessary. This would include multiple platform design reviews and first article testing.

The Government estimates this requirement satisfies the need for at least the next three years.
Based on the above, the additional cost and schedule delays associated with approving a new Fiber Optic/Electrical
Feedthrough manufacture for these parts cannot reasonably be anticipated to be offset by potential savings from competition.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
The Naval Undersea Warfare Center Division Newport
(NUWCDIVNPT) has historically posted the intent to award a
Firm Fixed Price purchase order on a sole source basis to
PAVE Technology Company on SAM.GOV (formerly Federal
Business Opportunities). NUWCDIVNPT will do so again, and invite all responsible sources to submit a capability statement for the consideration of the Government to determine whether to conduct a competitive procurement. To the knowledge of the technical code and Contracting Office, no other sources have expressed interest previously.
7. Determination of Fair and Reasonable Costs
The contracting officer will conduct price and/or cost analysis using FAR Parts 13.106-3 and/or 15.404-1(b)and
15.404-1(c) methods, in accordance with FAR 13.003(g)(2.)
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A is fair and reasonable.
Significant quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements and will be sought again. This information should be sufficient to support the fair and reasonable cost determination of this procurement.
8. Actions to Remove Barriers to Competition
The Government is currently contemplating two different acquisition strategies going forward either of which might result in dissolving this sole source requirement. They are as follows:
Due to the risk of a sole source the program is discussing exploring industry for another vendor product to qualify.
The present requirement is sufficient to bridge the gap if the program elects to go in this direction.
1. The program is discussing replacing the current internal design with another, which would replace these specific feedthroughs.
The above further supports the conclusion of this J&A and that the additional cost and schedule delays cannot be offset by competitive benefits.
