JUSTIFICATION AND APPROVAL (J&A) for FAR Subpart 6.3 Other Than Full and Open Competition

DataConnect Software License and Maintenance

1. Identification of the agency and contracting activity: The Defense Health Agency, Enterprise Medical Services (EMS) Contracting Division (CD), Building 1000, Suite 208, JBSA Ft. Sam Houston, TX 78234, plans to award a delivery-order contract, on an exception to fair opportunity basis, based on the statutory exception and supporting rationale provided herein.

2. Nature and/or Description of Action being approved: Approval is requested for a new firm-fixed price Delivery-Order (DO) via FedBizOps on a sole source basis for DataConnect software licenses and maintenance support.

Actian is the sole manufacturer or DataConnect licenses and maintenance. There are no known resellers on National Aeronautics and Space Administration Solutions Enterprise-Wide Procurement (NASA SEWP) or on other Government-Wide Acquisition Contracts (GWAC) including GSA.

The requested period of performance is 1 Dec 2019 to 30 Nov 2020.

3. Description of Supplies/Services: The new requirement is for Commercial off-the-shelf (COTS) DataConnect (formerly Data Integrator) software and maintenance support. The purchase will be for a replacement of the current Actian Data Integrator version 10, which is now end-of-life and end-of-support. The requirement will be for 12-months. Fiscal Year 2020 Operations and Maintenance funds are available for the action. The total contract value is estimated to be

4. Statutory and Regulatory Authority Permitting Other Than Full and Open Competition (see FAR 6.302), or the Specification of the Statutory and Regulatory Provision Providing Exception to 8(a) Program Competitive Requirements (see FAR 19.805-1): 10 U.S.C.

5. Rationale Justifying Use of the Statutory Authority Cited: Actian is the only manufacturer capable of meeting the minimum requirements. Actian is the Original Equipment Manufacturer (OEM) for the licenses and owns the proprietary rights to their products. There are no known resellers.

The Joint Medical Asset Repository (JMAR) provides users with total visibility of Department of Defense (DoD) wide medical asset data. This web-based application provides access to integrated joint-service medical asset information for any user, any tie, on any machine. DoD recognizes JMAR as the single integrated, authoritative source for joint medical logistics information provided to the Joint Total Asset Visibility system. JMAR supports the missions of medical logisticians everywhere. Medical logisticians use various communication methods to locate needed medical commodities and get them to the right place at the right time. JMAR is their tool of choice to accomplish this and is the single authoritative source for acquiring, managing, and providing timely and accurate joint medical asset visibility information. It captures, integrates, and stores data in a central repository with Web-based access that supports the current peacetime and theater environment.

The DataConnect Software, formerly Data Integrator software provides a unique, real-time, event-driven, message-based infrastructure. With this infrastructure in place, multiple applications, both internal and those of your trading partners, can be integrated efficiently and cost-effectively. DataConnect offers rich connectivity to a range of data sources, and distributed integration approach, and reusable components to speed implementation. The software is fully integrated into the JMAR application. It would require 500 – 800 development and testing hours to convert specialized code allowing JMAR to utilize a different vendor’s software. Given the steep learning curve, it would take 4-6 weeks of on-the-job training for JMAR’s developers to become productive using a new vendor’s tool once the specialized code was converted. In addition, JMAR has invested more than in initial startup costs for the DataConnect software for training and maintenance. Purchasing version 11 will allow for continued continuity and use of DataConnect software with required maintenance support for security patches.

The purchase of similar software in today’s market would cause clear risk to JMAR schedules and added cost (estimated more than for purchase, training and implementation.

Purchase of an alternative software would total more than the amount spent thus far on the Data Integrator software not including other unforeseen issues with customer sites. At this time the cost/ risk factors are not mitigated by increased competition.

There is only one responsible source capable of providing the requirements identified for this action per letter dated 19 September 2019 from Marc Monahan, Vice President of Finance, Actian Corporation.

Therefore, sole source will save the government substantial duplication of cost for code development and training not recoverable through competition and prevent a critical DoD program from severe delays.

6. Efforts to Obtain Competition: Until such time as the infrastructure is changed, there are no efforts to overcome barriers to proprietary software systems other than offering the requirement to vendors qualified to meet the requirement. No other manufacturer’s products have been identified that will meet program needs, and no authorized resellers have been identified.

7. Determination that Anticipated Cost to the Government will be Fair and Reasonable:

The Contracting Officer hereby determines that the anticipated costs to the Government will be fair and reasonable via this method of procurement. Price fairness and reasonableness will be based on analysis of market research and product/service information on the technical capabilities and prices/costs for same/similar items and comparisons to both historical pricing and proposed prices.

Market Research: In accordance with FAR Part 10, market research was conducted on 22 October 2019 by researching federal purchasing portal General Services Administration (GSA) Advantage, Ability One, Solutions for Enterprise-Wide Procurement (SEWP) for goods and services to verify contractors qualified to sell to the government. Other than the OEM, no resellers were identified.

The government intends to negotiate a Firm Fixed Price Delivery Order for DataConnect products via FedBizOps. DHA actively monitors the development and availability of new solutions through extensive, on-going market research, technical analysis of emerging technologies, and evaluations of the vendor to determine the best technical solution at the lowest cost.

11. Actions to overcome barriers:

Efforts to Obtain Competition. Until such time as the infrastructure is changed, there are no efforts to overcome barriers to proprietary systems and software maintenance other than offering the requirement to certified partners. No other manufacturer’s products have been identified that will meet program needs.

Actions to Increase Competition. No other manufacturer’s products have been identified that will meet program needs. However, the Government will continue to conduct market research on an annual basis to ascertain if there are changes in the market place that would enable future actions to be competed.
