Justification and Approval for Other than Full and Open Competition Sole Source Acquisition
FAR Subpart 6.3 Other Than Full and Open Competition
1. Identification of the agency and contracting activity: Defense Health Agency (DHA), Component Acquisition Executive (J-4), Contract Operations – Falls Church (CO-FC), 7000 Arlington Blvd., Suite 5101, Falls Church, VA 22042-5101.
2. Nature and/or Description of Action being approved: Approval is being requested for an award of a sole source Firm Fixed Price (FFP) contract to support the existing level of effort.
This sole source award does not provide for new work or a change in scope.
Approval is being requested for a contract to be awarded to Booz Allen Hamilton, Inc. (BAH) to complete work that is currently being performed under contract number HT0011-17-C-0006, for Office of the Deputy Assistant Secretary of Defense (ODASD), Wounded Warrior Care and Transition Policy (WWCTP), expiring on January 15, 2018. The contract will prevent a gap in necessary services and will provide the agency with sufficient time to complete the evaluation of offers submitted for the follow-on contract. The period of performance for this contract will be a one month base period, and five – one month option periods, for a total of six potential months beginning on January 16, 2018.
3. Description of Supplies/Services: BAH shall provide professional and management support services for the following programs within the Warrior Care Program (WCP) office: Disability Evaluation System, Special Compensation for Assistance with Activities of Daily Living, Communications and Outreach, and the United States/United Kingdom Task Force. Professional and management support service tasks include strategic planning and policy development, operational oversight of programs, data analysis and analytical reporting to inform policy decision making process, and quality assurance of WCP programs. The anticipated initial funded base period of performance will be one month from January 16, 2018 to February 15, 2018. The estimated price of the 1 month base period is The contract will also have five – one month option periods. The estimated price - if all 6 months were exercised is The contract will also include FAR 52.217-8 clause (Option to Extend Services). The estimated price associated with FAR 52.217-8 is The total estimated price for 6 months and an additional 6 months in accordance with the 52.217-8 clause is FY 18 Operations and Maintenance funds will be utilized for this FFP contract.
4. Statutory Authority Cited permitting other than full: The statutory authority permitting “other than full and open” competition for this acquisition is 10 U.S.C.2304(c) (1) as implemented by Federal Acquisition Regulation (FAR) and in accordance with FAR 6.302- 1(a)(2)(iii)(B) – “Only One Responsible Source and No Other Supplies or Services Will Satisfy the Agency Requirements”; and services are deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements (10 U.S.C. 2304(d)(1)(B)).
5. Reason for Authority Cited: The incumbent BAH possesses the operational infrastructure and knowledge required for successful performance. The contractor can continue to provide the support required during this short duration transitional contract without a loss of efficiency and negative impact to the Warrior Care Program (WCP) support function. Only BAH can start performance within this short period of time and prevent a gap in services. These services must continue uninterrupted in order to meet the needs of our wounded warriors.
Although there are other sources available that can meet the Government’s requirements, none would have the infrastructure or expertise available to support a fully functional Warrior Care Program (WCP) without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. This is a follow-on transitional contract funded for an initial one month period, with five (5) one-month option periods and includes the clause - FAR 52.217-8 Option to Extend Services for an additional 6 months period.
The Government has already received offers for the competitive small business set-aside logical follow-on contract. The Government is currently in the evaluation stage of those offers and expects to make an award for the logical competitive follow-on contract in 2nd quarter 2018. The Government is utilizing this current sole source contract to BAH to provide additional time needed to conduct the evaluation and then provide an overlapping transition period to the follow-on contract awardee. An overlapping transition period of at least 30 days is anticipated once there is an award of the competitive follow on contract.
6. Efforts to Obtain Competition: Bids, proposals, or quotations have not been solicited from additional sources as prescribed by FAR 5.207(c)(15). A direct award will be made to the incumbent BAH based on the expected short term of the contract and the authority of FAR 6.302-1(a)(2)(iii), the Government may make and award to the incumbent in the case of follow-on contracts. However, proposals were solicited from small businesses only, offers were received, and are currently in the source selection evaluation stage for the logical competitive follow-on contract with an anticipated award date of 2nd quarter 2018.
The proposed action will be synopsized in accordance with FAR 5.207, noting that pursuant to FAR 5.102(e) the Government only needs to provide copies of a solicitation issued under other than full and open competition to firms requesting copies that were not initially solicited, but only after advising the requestor of the determination to limit the solicitation to a specified firm or firms as authorized under FAR 6.3.
Due to the limited amount of time between the J&A approval period and needed contract award date, an additional Request for Information (RFI) will not be posted. In accordance with the Defense Federal Acquisition Regulation (DFARS) Procedures, Guidance, and Instruction (PGI) 206.302-1(d) the Contracting Officer has received a waiver, dated December 10, 2017, from the Head of Contracting Activity to not post the RFI.
7. Actions to Increase Competition: The current bridge contract (HT0011-17-C-0006) for these services will end January 15, 2018. The Agency began preparations for a new contract competition in late 2015. This request for sole source contract is not due to the Agency’s lack of planning. The new contract was competed as a 100% small business set-aside using full and open competition after exclusion of sources and garnered significant interest from the marketplace.

8. Market Research: The Government conducted market research as a routine course of action in pursuit of a logical follow-on contract. Research indicated that no existing vehicle is present that can meet this complex requirement. The sensitivity and complexity of the work coupled with the geographical challenges make this requirement challenging. Although there are other sources available that can meet the Government’s requirements, none would have the infrastructure or expertise available to support a fully functional WCP without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. Services would have to be fully operational on the period of performance start date, without a transition in period.
9. Other Facts: This sole source contract is being implemented in order to keep the current services operational until the competitive small business logical follow-on is awarded.

1. A Justification and Approval (Tracking #JA17-0030 (Award HT0011-17-C-0006)) was approved on December 19, 2016, citing the authority of FAR 6.302-1(a)(2)(iii)(B). There have been significant changes through requirement development, solicitation, and current evaluation of offers to competitive follow-on contract. The follow-on was solicited as a 100% small business set-aside for full and open competition after exclusion of sources and posted to the Federal Business Opportunities portal. Competitive offers were received and the Government is currently in the source selection evaluation process.

14. Fair and Reasonable Cost Determination: Current contract prices will be utilized for determination of fair and reasonable pricing. The Independent Government Estimate and knowledge of the Contracting Officer will further support this decision. Certified cost and price data is not required for this contract due to exception in FAR 15.403-1 (c)(3).
