Addendum to 52.212-1 Instructions to Offerors – Commercial Items. (APR 2014)

INSTRUCTION TO OFFERORS

Prior to the submission of quotations, a site visit will take place in order for offerors to gain visual knowledge of the vehicle barrier system. The site visit will take place at the Naval Observatory Complex on February 23, 2016 at 8:30 AM EST. A separate site visit for the vehicle barrier system located at 1111 18th Street NW will take place promptly after the Naval Observatory Complex visit is completed. Quotations will only be accepted from Offerors who attend the site visit in its entirety.

One representative per company, no representatives from potential sub-contractors will be permitted. The attached facility access forms and vehicle information (make/model/year/color) must be sent to the Contract Specialist in accordance with the instructions below.

The Offeror shall submit quotations in accordance with the following format:

Times New Roman, 12 pt. font, single spaced, one-sided, all page limitations are inclusive of any cover pages, cover letters, and table of contents.

Part A: General Business Information/Representations and Certifications Part B: Past Performance References (maximum 3 pages) Part C: Technical Quotation (maximum 15 pages) Part D: Price Quotation Part E: Statement of Contractor Responsibility

PART A: General Business Information/Representations and Certifications The Offeror shall provide:

1. Name, title, telephone number, fax number, and email address of the point of contact.

2. Nine-digit DUNS. The DUNS is used to verify that the vendor is registered in the System for

Award Management (SAM). By submitting a proposal, the Offeror acknowledges the Government requirement to be in the SAM database prior to award of any contract.

Information about SAM may be found at www.sam.gov.

3. Nine-digit TIN. The Taxpayer Identification Number is necessary for electronic payment.

4. FAR 52.212-3, Offeror Representations and Certifications – Commercial Items. If the

Offeror has completed the annual representations and certifications electronically through SAM at www.sam.gov, then the Offeror shall provide a statement indicating this has been completed. Upon receipt of this statement, the Government will verify that the annual representations and certifications have been completed in SAM.

PART B: Past Performance References The submission of all references shall include the following information:

1. Contract Number(s)

2. Name, email address, and phone number of a point of contact at the Federal, State, Local

Government or Commercial entity for which the contract was performed.

3. Dollar value of the Contract.

4. Detailed description of the work performed.

The number, type and severity of any quality, delivery or cost problems in performing the contract, the corrective action taken and the effectiveness of the correct action

PART C: Technical Quotation The offeror shall identify the methods that will be used to fulfill the objectives outlined in the Performance Work Statement and demonstrate its understanding of the requirement listed in the Performance Work Statement (PWS), as well as its knowledge of the service to be provided.

PART D: Price The offeror shall provide pricing in the format of the Pricing Breakdown sheet located on page 15 of this

RFQ.

PART E: Statement of Contractor Responsibility The Offeror shall submit a statement of Contractor Responsibility demonstrating financial stability.

Site Visit Facility Access Forms and Vehicle Information shall be submitted in electronic format and emailed to Gabriella Marino, gabriella.marino@associates.usss.dhs.gov, no later than February 18, 2016 at 2:00 PM EST.

RFQ Questions shall be submitted in electronic format and emailed to Gabriella Marino, gabriella.marino@associates.usss.dhs.gov, no later than February 26, 2016 at 3:00 PM EST.

The response shall be submitted in electronic format and emailed to Gabriella Marino, gabriella.marino@associates.usss.dhs.gov, no later than March 9, 2016 at 4:00 PM EST. Hard copy quotations will not be accepted.

Performance Work Statement Vehicle Barrier Systems Maintenance

1. GENERAL INFORMATION

A. Overview / Background This contract is for maintenance service, inspections, and emergency repair services for six (6) vehicle barrier systems at two locations, to ensure that the barriers are in full operating condition 24 hours a day, 365 days a year. These barrier systems are a critical part in supporting the protective mission of the USSS and require continuous maintenance to ensure that the barriers are in top operating condition.

This contract shall cover preventive maintenance and other items not covered by the warranty for those units only until the warranty expires, at which time those units will be fully covered under this contract.

Additionally, the United States Secret Service and the Naval Observatory Facilities are partnered in studying for future renovations and upgrading of the vehicle gate systems maintained by both agencies surrounding the Naval Observatory Complex. The contractor shall have the experience and knowledge to integrate the new technology into existing preventative and corrective maintenance programs. Any new cost incurred to educate the service technicians with the necessary knowledge or certifications will be the sole expense of the contractor.

B. Objective The purpose of this contract is to minimize the barrier systems failures through a proactive preventive and corrective maintenance program.

C. Security Requirements

Security Requirements

The contractor and his/her employees and sub-contractors shall be citizens of the United States.

Contract employees shall undergo a favorable Suitability Assessment as determined by the US Secret Service’s Security Clearance Division’s, Clearance and Access Branch (SCD-CAB) prior to performing any work within US Secret Services controlled access facilities, or on US Secret Service’s information technology systems. Additional Suitability Assessments will be required for continued work requirements as determined by SCD-CAB, but no less than once every two years.

When work performance requirements exceed Non-Sensitive standards; additional Suitability Assessment reviews will be required prior to access being granted, specifically;

• Contract employees who provide support in Low Risk positions must have undergone a minimum of a Tier 1/NACI (National Agency Check and Inquiries) level background investigation within the last 10 years; or otherwise be the subject of a favorable US Secret Service controlled Tier 1/NACI background investigation.

• Contract employees who provide support in Moderate or High positions must have undergone a minimum of a Tier 4a/BI (Background Investigation) level background investigation within the last 5 years; or otherwise be the subject of a favorable US Secret Service controlled Tier 4a/BI background investigation.

• For contract employee positions that require access to US Secret Service controlled Information Technology systems, the contract employee must have undergone a minimum of a Tier 4a/BI (Background Investigation) level background investigation within the last 5 years; or otherwise be the subject of a favorable US Secret Service controlled Tier 4a/BI background investigation.

The US Secret Service Contracting Officer Representative (COR) or their US Secret Service designee is responsible for determining the contract employee’s position description level as being either Non-Sensitive, Low Risk, Moderate Risk, or High Risk. The COR or their designee will also make the determination when contract employees require access to US Secret Service controlled Information Technology systems, unless otherwise stipulated within the Statement of Work.

The contracting agency shall submit to the COR the following completed documentation for each contract employee requiring access to US Secret Services controlled access facilities, in order to satisfy initial and/or recurring (as requested by the COR) Suitability Assessments:

• SSF 3237: US Secret Service Facility Access Request

• SSF 4024: US Secret Service Non-disclosure Agreement

• SSF 3030A: Financial Disclosure/Credit Release

For sensitivity positions determined as Low Risk, Moderate Risk, or High Risk; or, for positions that require access to US Secret Service controlled Information Technology systems, the contracting agency shall submit to the COR (only when requested) the following completed form:

• SF 85P: Questionnaire for Public Trust Positions

Facility Access:

Contractor personnel requiring access to USSS facilities will be subjected to criminal, credit and citizenship background checks. Contractors who require additional access to IT systems, personally identifiable information (PII) or regular facility access will be subjected to additional background checks as required by OPM and the US Secret Service. These may include but are not limited to a security interview, fingerprinting, employment verification, education verification, residence verification, and income tax filing checks. All Contractor personnel requiring access to USSS facilities shall complete the following forms, as applicable, which shall be provided by the USSS:

1. Disclosure and Authorization Pertaining to Consumer Reports Pursuant to the Fair Credit Reporting Act

2. SSF 1888 – Security Check

a) The Contractor shall be required to submit information for background investigations of all Contractor personnel and affiliates that need access to the government-controlled sites by completing Secret Service form SSF 1888. These forms shall be submitted at least one week before scheduled access.

3. SSF 3237 – Contractor Personnel Access Application

a) For personnel requiring access to USSS controlled facilities

4. SSF 4024 – Conditional Access To Sensitive But Unclassified Information Non- Disclosure Agreement

a) For personnel not requiring access to, or developing, classified information, submit USSS form SSF 4024, Conditional Access to Sensitive but Unclassified Information Non-Disclosure Agreement. This information shall be submitted to the USSS COR at least 10 days in advance of scheduled access.

a) For personnel requiring access to USSS IT systems

8. Contractor Personnel requiring access to government computers for any duration or to physical facilities shall submit appropriate identification for and be enrolled for issuance of a FIPS-201 compliant ID card if not already in possession of such ID, per DHS policy on HSPD-12.

D. Period of Performance

The resulting contract will be executed upon award and will have a life span of a base year plus two option periods. The Government reserves the right to exercise or not exercise these options.

E. Place of Performance Performance shall take place the Naval Observatory Complex

F. Contract Type The contract type shall consist of both “firm-fixed price” and “time and materials” line items.

H. Government Furnished Property Within thirty (30) days of award of the contract, the Contractor shall conduct a detailed inventory of government owned spare and repair parts. This inventory list shall be provided to the Government along with recommendations for parts to be purchased.

I. Travel

All work shall be performed in the Washington, DC metro area and no travel is anticipated.

2. SCOPE / REQUIREMENTS

2.1. The contractor shall furnish all contract oversight management, labor, equipment, tools, and supplies necessary to provide complete and fully functional vehicle barrier systems. The contractor shall furnish preventive and corrective maintenance and repair services on 6 barrier systems as described below:

Model 3B:

Two (2) at the Naval Observatory, Massachusetts Ave, NW, Washington, DC, Main Gate Two (2) at the Naval Observatory, Massachusetts Ave, NW, Washington, DC, Gillis Gate

Model XB:

One (1) portable unit at the Naval Observatory, Massachusetts Ave, NW, Washington, DC, Near Gillis Gate/Building #16.

Model 8A:

One (1) at 1111 18th Street, NW, Washington, DC (Logan Building)

2.2. The contractor shall provide all barrier components and subsystems necessary to maintain these barrier systems in effective working order. These components and subsystems include, but are not limited to, induction detection loops, signal lights, infrared safety detectors, batteries, audible warning devices, control panels, switches, keypads, buttons, actuator arms, nuts, bolts, connectors, fasteners, wiring, etc.

2.3. The contractor shall minimize barrier system failures through a proactive preventative maintenance program and successful execution of the tasks described below.

2.4. Preventive Maintenance (PM) Services:

2.4.1 The purpose of PM services is to prevent and detect defects before they cause equipment failure.

2.4.2. A PM Service is required at a minimum of once per week for each barrier system. This service shall be billed at a fixed-firm price per week.

2.4.3. The contractor shall prepare and implement a preventative maintenance checklist to ensure optimal performance of the vehicle barrier systems while minimizing down time. The contractor shall submit the check list to the government within 30 days after award of the contract for review and approval. The checklist shall include detailed descriptions of actions performed to maintain, correct, improve, and/or repair a barrier system. It shall also include all required maintenance actions for each type of barrier system per the manufacturer’s recommendations.

Examples of required maintenance for retractable bollards are, but are not limited to: cleaning of bollard pit once a month, checking oil reservoir levels to include presence of contaminates in the oil reservoir system once a month; fill/replace when necessary, insure that all bollard cover plate securing fasteners are in place at all times; repair/replace when necessary to include all weather seals that may be worn to assist with the prevention of debris/fluids from entering the bollard pit, cleaning/clearing drainage lines from point of appearance within the bollard pits to the point of appearance within the storm drain once per quarter, , check the touch screen control panel for bollard deficiencies, repair/implement repair as required, etc. The checklist shall include, but is not limited to, the following requirements:

• Location/Name of barrier system

• Description of parts or items to be maintained

• Description of current condition, vice only checkmark

• Task(s) performed to reflect current or improved condition

• Task(s) performed and/or to be performed for the next inspection for repair , maintenance, improvement, corrections

• Any scheduled task(s) not performed on the scheduled inspection

• Next scheduled service

• Technician who performed the task(s)

• Contractor’s main Point of Contact

• Record number of cycles on each unit that have occurred since last performed maintenance.

• All manufacturers recommended maintenance should also be included.

2.4.4. The approved checklist shall be filled out by the contractor after every preventive maintenance service. A copy shall be forwarded to the COTR, via an agreed upon method once the contract is established, on the next working day.

2.4.5. In the event that new equipment is installed, the approved checklist shall be updated to reflect the new preventative maintenance required as recommended by the equipment manufacturer.

2.4.6. PM services include but are not limited to routine services such as operational testing, inspection, adjustment, cleaning, lubrication and any other periodic services recommended by the equipment manufacturer.

2.4.7. In order to minimize disruption of normal business activities at the Naval Observatory Complex, PM services shall be performed during the weekday, on any day Monday through Friday (excluding federal holidays) between the hours of 6:00 pm and 6:00 am or as mutually agreed upon between the contractor and the government.

2.4.8. The contractor shall develop and submit a PM services schedule for each barrier system for periodic routine PM services. It shall be reviewed and approved by the Contracting Officer Technical Representative (COTR) before execution.

2.4.9. The costs for PM services shall include all labor, minor parts and consumable materials required to perform the services. Minor parts and consumable materials include, but are not limited to connectors, mounting hardware, screws, bolts, cleaning solution, swabs, rags, tape, bollard collars, hydraulic fluid, and other items commonly available and normally used for the servicing and repair of vehicle gate and barrier systems.

2.5. Corrective Maintenance (CM) Service

2.5.1. CM Service is required whenever the barrier system fails to operate as intended or designed. CM services are those services required to return the system to a fully operational status.

2.5.2. CM services shall be provided on an as needed basis. Corrective maintenance shall occur during “normal business hours” as mutually agreed upon by the contractor and the government.

2.5.3. CM Services and parts shall be billed on a time and materials basis. Procurement of any special order parts required to return the gates, barriers, or bollards back to their fully operational status must receive written/e-mail approval from the Contracting Officer’s Technical Representative (COTR). E-mail is sufficient for this action. Additionally, the contractor shall prepare a parts list which details the necessary parts to maintain the vehicle gates and bollard systems and their associated costs. This list shall be furnished to the government within three (3) months after the award of the contract.

2.5.4. The contractor and government shall establish a mutually agreed upon method of communicating the need for corrective maintenance. This communication may include telephone, pager, and/or e-mail. When contacted by the government of a barrier system failure, the contractor shall arrive on site within two hours of the initial notification. A two hour response time is required regardless of date, time of day or weather conditions.

2.6. Program Management

2.6.1. The contractor shall schedule and conduct a monthly maintenance meeting with the government personnel through the Contracting Officer Technical Representative (COTR) at the government’s facility at a mutually agreed upon time and date.

2.6.2. The contractor shall prepare, submit and discuss the monthly status report at the monthly meeting. The report shall thoroughly present the overall condition of the vehicle barrier systems and shall include the following information:

• Summary of all PM services.

• Summary of all CM services.

• Identify equipment failure trends and recommend actions for improvement.

• Suggest upgrades to improve system performance.

• Current inventory of government owned spare and repair parts with recommendations for parts to be purchased.

• Address issues and concerns.

• Track expenditures.

2.7 Standby Service

During special events, the government may require a technician to be on site in the event a barrier should fail. The government shall provide 24 hours notice to the contractor if standby service is required. This service shall be billed on a time and material basis.

2.8 Emergency Corrective Maintenance Services

2.8.1. ECM Service is required whenever the barrier system fails to operate as intended or designed and the government deems it necessary that the corrective maintenance must occur outside of “normal business hours” as agreed upon between the government and the contractor.

ECM services are those services required to return the system to a fully operational status.

2.8.2. ECM services shall be provided on an as needed basis.

2.8.3. ECM Services and parts shall be billed on a time and materials basis.

2.8.4. The contractor shall establish a reliable 24 hour, 7 day a week, 365 days a year, contact number for key repair personnel or alternates for the government to report system failures.

When contacted by the government of a barrier system failure, the contractor shall arrive on site within two hours of the initial notification. Notification includes any means as mutually agreed upon between the contractor and the government. A two hour response time is required regardless of date, time of day or weather conditions.

2.9 Working Environment

2.9.1. The contractor shall maintain a safe environment at all times during the execution of this contract. Removal of debris shall be accomplished on an ongoing basis. The contractor shall maintain the area inside underground pits and around each piece of equipment free of debris, trash, oily or dirty rags and used parts. Proper housekeeping shall be maintained before and after any maintenance or repair is completed. If it becomes necessary for the government to recall the contractor to perform any degree of housekeeping, this will occur at the sole expense of the contractor.

2.9.2. Removal of hazardous materials shall comply with applicable Federal, State and Local regulations, laws and ordinances regarding removal, handling and protection against exposure or environmental pollution. It is further recommended that bio-degradable or natural substances be used to service these systems.

3.0 Warranty

The contractor shall warrant all PM and CM services, repair and replacement parts to be free from defect in material and workmanship for a period of no less than 30 days. Except of instances of damage due to vehicle strikes or misuse, any failure of the same part after repair or replacement within the 30 day period will be corrected by the contractor at no expense to the government.

4.0 Deliverables: The contractor shall be required to provide the following deliverables for the 6 vehicle barrier systems:

• Preventive Maintenance Services

• Corrective Maintenance Services

• Standby Services

• Program Management Services

• Emergency Services

• Inventory list

• Warranty

• Maintaining a safe and clean environment, removal of debris, etc.

• Government will provide specific points-of-contact (POC) to the Contractor with whom he/she shall coordinate.

• Government will provide access to the site for cleared contractor personnel in a timely manner.

• The Government will unlock drawers and control panels for contractor when required.

5.0 Inspection and Acceptance

All tasks and deliverables shall be inspected by the USSS COR.

2.4 Preventative Maintenance

Services: The Contractor shall perform preventative maintenance inspections of all 6 vehicle barrier systems to ensure reliable and continuous operation

The government requires a minimum of 90% up time for all 6 vehicle barrier systems covered by this contract. Each preventative maintenance service shall be performed in accordance with the Performance Work Statement

The Government shall inspect the results of the services.

If the services take more than 2 days to complete, then the Government shall receive a discount of 5% off the total billing amount for the preventative maintenance service visit.

2.5 Corrective Maintenance

Services: The Contractor shall be available and ready to respond to unscheduled or emergency service calls for any repairs required throughout the term of the contract.

The Contractor shall respond to repair calls within a maximum of 2 hours after notification during normal business hours and within 2 hours after notification at times other than normal business hours.

Upon initiation of work, all corrective maintenance will be completed within 2 days.

The Government shall inspect the results of the services.

If the services take more than 2 days to complete, then the government shall receive a discount of 5% off the total billing amount for that corrective maintenance service visit.

The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212- 3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation.

(Applies to offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the offeror’s name and address. The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful and debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of rationale for award;

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer is the lowest priced, technically acceptable in accordance with the Performance Work Statement.

Source Selection Factors/Criteria

Solicitation HSSS01-16-Q-0030 is anticipated to be released in accordance with the attached Performance Work Statement. The solicitation will specify that award shall be made based on a lowest price, technically acceptable basis. The Government will be evaluating:

1. Past Performance;

2. Technical Capability;

a. Fulfillment of PWS Requirements;

3. Price.

Source Selection Overview

The responses received under this Request for Quote (RFQ) will be evaluated in accordance with the instructions contained in this RFQ. Award will be based on a lowest-price, technically-acceptable basis.

Award will be made via a firm-fixed price/time and materials hybrid contract to the Offeror presenting, in the judgment of the Government, the most advantageous offer to the Government.

A. Past Performance (Page Limit: 3 page max.)

The Government will conduct a past performance evaluation based upon the relevant past performance of the offeror and any subcontractors as it relates to the probability of successful accomplishment of the work required by the solicitation. The contractor shall submit three references for past performance.

The offeror shall also provide their past achievements, awards, experience with other government agencies providing like programs, and how many years’ experience in providing similar products.

The government reserves the right to pull relevant past performance information from PPIRS for evaluating past performance.

The submission of all references shall include the following information:

6. Contract Number(s)

7. Name, email address, and phone number of a point of contact at the Federal, State, Local

Government or Commercial entity for which the contract was performed.

8. Dollar value of the Contract.

9. Detailed description of the work performed.

10. Names of subcontract(s) used, if any, and a description of the extent of work performed by the subcontract(s).

11. The number, type and severity of any quality, delivery or cost problems in performing the contract, the corrective action taken and the effectiveness of the correct action.

The Government shall assess risks associated with offeror’s past performance in the following areas:

A. Timely delivery of services.

B. Technical quality.

C. Business-like concern for the interests of the customer.

Each performance risk assessment of the areas listed above will consider the number and severity of problems, the effectiveness of corrective actions taken and the overall work record. Problems not addressed by the offeror will be considered to still exist. However, the degree to which the offeror can demonstrate that it has successfully applied continuous systemic improvement to resolve past performance problems will be evaluated. Under this factor, the USSS will evaluate how well an offeror has performed similar work before. The assessment of performance risk is not intended to be the product of a mechanical or mathematical analysis of an offeror’s performance on a list of contracts, but rather the product of subjective judgment of the evaluators after it considers all available, relevant and recent information. Any deficiencies found in past performance but were found to be corrected that resulted in a successful contract will be taken into consideration, but may not reflect a negative rating if it was corrected. Deficiencies found that resulted in a negative impact to the Government and the successful outcome of past contracts will result in a negative rating.

B. Technical Capability (Page Limit: 15 pages max.)

Technical Capabilities The offeror’s quotation shall demonstrate its understanding of the requirement listed in the Performance Work Statement (PWS), as well as its knowledge of the service to be provided. Best commercial practices used in performing the task under the solicitation shall be provided. The quotation shall contain the contractor’s approach in performing the tasks at hand with accomplished personnel who will understand the requirements and possess the experience to successfully provide the knowledge, skills and abilities necessary to provide outstanding barrier system maintenance.

C. Price

For evaluation purposes, the Total Evaluated Price will be the sum of all CLIN amounts and prices proposed to include options. In addition, for evaluation purposes, adjustments the Government deems appropriate will be made to include Government costs required to accomplish the offeror’s proposed approach with the exception of those costs to the Government that are equal across all offerors. The proposed unit prices and the Total Evaluated Price as previously defined will be evaluated for reasonableness. Also, each offeror’s Price proposal will be evaluated to determine if it is consistent with the offeror’s technical approach and reflects a clear understanding of the solicitation requirements.

Inconsistencies between the Technical and Price proposals may be assessed as proposal risk under the Technical evaluation.

PROSPECTIVE CONTRACTOR RESPONSIBILTY:

In accordance with Federal Acquisition Regulation (FAR) 9.1, the Contracting Officer shall award contracts only to a responsible offeror. No purchase or award shall be made unless the contracting officer makes an affirmative determination of responsibility.

52.212-3 -- Offeror Representations and Certifications -- Commercial Items. (Mar 2015) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.

(a) Definitions. As used in this provision-

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror.

Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation”, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except-

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).

Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate-

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
