52.212-2 EVALUATION - COMMERCIAL ITEMS OCT 2014

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

1. Technical Acceptability/Past Performance

2. Price

USCIS intends to award a firm fixed price delivery order, in accordance with FAR 15.101-2, Lowest Price Technically Acceptable (LPTA) source selection process. Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price. Technical acceptability is comprised of meeting the requirements as outlined in the Product Specification document, and acceptable or neutral past performance. Award will be made on the basis of the lowest evaluated price of quotes meeting the Technical Acceptability for non-cost factors.

USCIS will evaluate offeror’s past performance in accordance with FAR 15.305(a)(2) (but for the comparative assessment) to determine the extent to which their performance demonstrates the likelihood of successful performance in providing requirements similar in size (dollar amount), scope (work that is mailto:Sarah.E.Rizner@uscis.dhs.gov similar to the required products/services), and timeliness of deliveries. The evaluation of Past Performance will include data obtained from the Past Performance Information Retrieval System (PPIRS), and if requested, any recent and relevant Past Performance information provided by Offerors which may include (Federal, State, local government, and private).

The currency and relevance of the past performance information, source of the information, context of the data, and general trends in contractor’s performance shall be considered. As such, recent past performance is defined as within the past three years.

An Offeror without a record of relevant past performance or for whom information on past performance is not available will be rated Neutral Risk. A Neutral rating will not advantage or disadvantage an Offeror.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
