JUSTIFICATION SUPPORTING A REQUEST TO ENTER INTO AN ACQUISITION USING

OTHER THAN FULL AND OPEN COMPETITION - SIMPLIFIED ACQUISITION

Instructions to Requestor: Prepare this document and include it as an attachment to the purchase request. When received in the Contracting Office, the Contracting Officer (CO) will review the data provided, and if it is concluded by the CO that the proposed sole source action is justified, the CO will approve and sign this justification and place it in the purchase order file.

Introduction: Pursuant to Federal Acquisition Regulation 13 .106-3(b )(3)(i), the following data is furnished to the Contracting Officer to support the requisitioning office's request that the items/services identified on the above-mentioned PR be obtained using other than full and open competition. The Requisitioning Office understands that a contract may not be awarded on a sole source basis unless the Contracting Officer approves the request for Other Than Full and Open Competition.

1. Identification of Agency, Contracting Activity and Document. The Department of Homeland Security (DHS), Federal Law Enforcement Training Center (FLETC), Asset and Logistics Management (ALM) Division.

2. Nature and/or Description of Action Being Approved. The purpose is to contract for maintenance support of the existing FuelMaster automated fuel management system located at the Glynco, GA and Artesia, NM training sites through Syn-Tech Systems, Inc.

3. Description of the Supplies or Services Required to Meet Agency's Need & the Estimated Value.

REQUIREMENTS

a. Maintenance/replacement coverage of (1) Fuel Management Unit (FMU), ( 4) Tank

Management Units (TMU), and (1) Portable Programming Head (PPH) at Glynco, GA

b. Maintenance/replacement coverage of ( 625) AIMS modules installed on vehicles at

Glynco, GA

c. Maintenance/replacement coverage of (1) FMU, (3) TMU, and (1) PPH at A1iesia, NM

d. Maintenance/replacement of (275) AIMS modules installed on vehicles at A1iesia, NM

SCOPE OF WORK

a. The po1tion of the maintenance contract for the FMUs, TMUs, and PPHs should include the following:

1. Provide updates to application and embedded software, as required.

2. Provide unlimited .telephonic/electronic diagnostics and support 24/7.

3. Provide necessaty repair patis.

4. Provide on-site visits by FuelMaster technicians if required.

5. Provides repairs for any damages incu1Ted due to "Acts of God".

b. The· portion of the maintenance contract for the AIMs modules should include the following:

1. Provide updates to application and embedded software, as required.

2. Provide unlimited telephonic/electronic diagnostics and support 24/7 ..

3. Provide necessary repair pa11s.

4. Provide on-site visits by FuelMaster technicians if required.

5. Provides repairs for any damages incutTed due to "Acts of God".

4. Proposed Contractor's Unique Qualifications/Nature of Acquisition Requiring Use of Other Than Full and Open Competition. The items to be covered by this maintenance agreement at both Altesia, NM and Glynco, GA were installed and covered under a one year warranty with Syn-Tech Systems, Inc. As such, they are the most qualified to maintain the system.

5. Additional Suppo11ing Facts for Use of Other Than Full and Open Competition.

a. Explanation of why proposed action cannot be competed. The items to be covered by the maintenance contract are proprietary to SynwTech Systems, Inc.

b. If the propo ed action is a followwon acquisition, an estimate of the cost to the government that would be duplicated, how the estimate was derived and why full and open competition has not been developed or is not available. This contract will establish the initial maintenance support for the FuelMaster automated.fuel management system being used at Glynco, GA and Artesia, NM.

c. If the basis for a sole source action request is Unusual and Compelling Urgency, furnish data, estimated cost., or other rationale as to the extent and nature of the harm to the Government. Not applicable.

6. Evaluation of Other Potential Sources. No other sources were found through market research due to the proprietary nature of the equipment to be maintained.
